CALL SPECIFIC PERFORMANCE WORK STATEMENT

FUSRAP DuPont Chambers Works Site

Deepwater, NJ January 2024

This Performance Work Statement (PWS) is for transportation and disposal of the material on the attached radioactive waste disposal (RWD) request form and to provide a certificate of disposal in accordance with the terms and conditions of Blanket Purchase Agreement (BPA).

BPA CALL SPECIFICS:

The United States Army Corps of Engineers (USACE) is conducting the environmental remediation and restoration of the former DuPont Chambers Works Formerly Utilized Sites Remedial Action Program (FUSRAP) site. The work covered under this PWS requires the Contractor to furnish all labor, material, and equipment to perform all work necessary to complete Transportation and Disposal (T&D). This PWS covers the estimated T&D and treatment, if necessary, of approximately 20,000 tons of radiologically and chemically contaminated waste material. Some or all of the material may be commingled with high levels of chemical contaminants potentially requiring treatment.

SITE DESCRIPTION:

The former DuPont Chambers Works site now operated by the Chemours Company (Chemours) is an active chemical manufacturing facility, located in Salem County, New Jersey.

In the 1940s, E. I. du Pont de Nemours and Company (DuPont) performed work for the Federal Government in support of the nation’s early atomic energy program. USACE is addressing residual radiological contamination in specific areas of the property under the FUSRAP. The areas are collectively referred to as the former DuPont FUSRAP site.

USACE has identified the FUSRAP-eligible constituents of concern in site soils that were related to the uranium processing and research activities at the site and that could pose a risk to human health under an industrial land use scenario. Constituents of concern are uranium, thorium, and radium; specifically, Uranium-234 (234U), Uranium-235 (235U), Uranium-238 (238U), Thorium- 230 (230Th), and Radium-226 (226Ra). Other hazardous contaminants unrelated to the uranium processing and research activities are comingled with the FUSRAP waste. To date, RCRA hazardous contaminants encountered have included Lead (D008), Benzene, (D018), 2,4- Dinitrotoluene (D030), Hexachlorobenzene (D032), Hexachlorbutadiene or Hexachloro-1,3-butadiene (D033), Nitrobenzene (D036), Chlordane (D020), and/or Tetrachloroethene (D-039);

and several underlying hazardous constituents (UHCs). Material with contaminants requiring thermal treatment will not be shipped under this call.

WORK TO BE PERFORMED:

This PWS covers the T&D and treatment, if necessary, of approximately 20,000 tons of radiologically contaminated waste (soil and/or debris) from the former DuPont Chambers Works (RT130 Deepwater, NJ 08023) with a period of performance expected to be 36 months. The waste consists of Unimportant Quantities of Source Material (UQSM), which also is contaminated with RCRA hazardous wastes. The waste material is detailed on the attached BPA Request Form (Enclosure 1). The Contractor shall furnish all transportation, treatment, and disposal services, equipment, maintenance, insurance, permits, licenses, labor and supervision necessary for the transportation by rail and disposal of FUSRAP waste materials. Shipping is anticipated to begin immediately upon placement of the Call.

ATTACHMENT 1

DISPOSAL:

The Contractor is requested to provide in their quote their oversized debris size limitation. The contractor shall stipulate waste sizing restrictions for this Call.

All materials to be disposed of will be UQSM and will require additional hazardous waste treatment to meet Land Disposal Restriction (LDR) requirements. The BPA Call total costs shall be based on 20,000 tons of material with the following breakdown as an estimate:

90% Pozzolanic treatment only 10% Chemical Oxidation treatment

The evaluation for award of this BPA Call will be based on transportation, disposal, and treatment of up to 20,000 tons of material with the above breakdowns for treatment, with mobilization of 20 railcars. Billing shall be based on transportation, disposal and actual treatments required (if any), and actual mobilization costs. Note that material may require no treatment, pozzolanic stabilization, or chemical oxidation; but evaluation and award of the BPA Call will be based on the estimated percentages above.

TRANSPORTATION BY RAIL:

The Contractor shall provide for rail transportation of waste material from environmental remediation activities conducted by the Government under separate contracts. The scope of this task order is limited to T&D outside of the DuPont facility (waste handling, loading, and transportation within the facility are under separate contract(s)). Chemours has one rail spur that is currently in use. All rail cars designated for pickup are transported to the eastern edge of the Chemours property under a separate contract. This rail spur is served by CSX. This rail area has sufficient track space to accommodate approximately 50 rail cars. The railcar fleet needed for the project is expected to vary from approximately 5-50 cars and will be coordinated in detail after the Call is placed.

The waste shall be shipped bulk in gondola railcars. Railcars shall be low-walled, open-top, 110-ton mill gondolas, with the following dimensions: length 52’6”, height 5’6”, width 9’6”. Each railcar shall have a unique/distinguishable company marking for identification and tracking purposes. Currently at the project site, approximately 109 tons is typically placed in each railcar.

The USACE remediation contractor will provide and install rail car liners (burrito bags), load the rail cars, secure the liner, and provide on-facility transportation to the eastern edge of the Chemours site.

The Contractor shall schedule and deliver sufficient quantities of clean and serviceable railcars and any other material necessary to meet the project’s schedule and perform the work. The USACE expects that each car delivered shall be fully functional, mechanically sound, and safe.

USACE reserves the right to inspect conveyances and packaging (equipment) delivered to the project to identify either damage or residual materials from their previous consignments.

Equipment determined to be unacceptable relative to damage or residue will be rejected and replaced by the contractor at the contractor’s expense. The Contractor shall provide in their quote one of two statements: (1) a certification statement that the equipment is free from contamination and can be loaded with Class 7, Class 9, or DOT exempt materials; OR (2) a statement that equipment can be loaded with Class 7, Class 9, or DOT exempt materials, are dedicated to the transport of radioactive substances, and the Government is released from all claims and damages related to decontamination or from contamination on equipment surfaces.

The Contractor shall replace, within 48 hours, any equipment that, at USACE’s sole discretion, does not pass the site’s incoming visual inspection. The cost associated with the maintenance and replacement of equipment shall be the Contractor’s responsibility including railcars, containers, and other transportation equipment provided under this PWS.

The Contractor shall assume all transporter responsibilities, as defined by DOT regulations, for the waste material once the Contractor has accepted it for transportation. Acceptance will occur at signing of the shipping papers as consignor (e.g., at the project site). Signing as the consignor/transporter shall be accomplished within two working days of being provided an acceptable and complete shipping paper package.

Title of the waste material will pass to the Contractor upon receipt of the waste material at the Contractor’s disposal facility unless determined to be non-conforming waste. In accordance with section 2.27 of the Base Agreement, the Contractor shall propose all conditions that would result in a waste being identified as ‘non-conforming waste.’

DEMURRAGE:

The Contractor shall account for all costs related to demurrage and any other handling fees. For cost estimating and scheduling purposes, assume 14 calendar days for railcars to be loaded onsite and available for transport. The Contractor shall provide a daily demurrage rate per railcar for time in excess of this time frame. The clock for determining demurrage starts from the day of receipt by the Government and ends the day the car is provided for CSX transport (outside of the DuPont facility).

SPECIFICS TO THIS CALL:

The Contractor is to provide costs by separate line item for the following items:

• Disposal cost per ton

• Treatment cost per ton for material requiring pozzolanic stabilization (up to 15% debris)

• Treatment cost per ton for chemical oxidation (up to 15% debris)

• Transportation cost per ton

• Fuel Surcharge maximum cost

• Mobilization and demobilization (specify when applicable) per railcar

• Daily demurrage rate

• Total cost for transportation, disposal, and treatment of all material in this PWS. This should include all costs such as mobilization/demobilization, fees, taxes, fuel surcharge, etc. Total cost should not include demurrage but should include all costs from point of receipt of gondola (e.g., drayage).

The Contractor shall provide/describe in their quote the point of contact for coordination of mobilizing and demobilizing equipment.

The Contractor shall provide a qualified individual to sign express mailed manifests/shipping documents as the transporter/shipper within two working days of receipt of the completed shipping documentation.

The Contractor shall specify what billing is based on (e.g., manifested weight or facility certified scale weight).

Contractor is required to track all shipments and provide a daily report to the USACE that includes daily rail car location and status of when the cars will reach the disposal facility or the DuPont site. The Contractor’s quote shall specify the method for tracking shipments daily.

If the RWD BPA contractor proposes a fuel surcharge it is to be mileage based and all backup calculations are to be provided. The proposal shall be the maximum fuel surcharge unit rate for invoicing and explain how the contractor intends to bill the government for actual fuel surcharges below the proposed maximum. Simply stating Fuel Surcharge actuals will be billed is not acceptable. The Government will use actual current fuel prices as provided by the United States Energy Information Administration to determine reasonableness. Any other fees, tolls, or other such costs shall be included in the Contractor’s total cost and not as separate line items.

Disposal shall be permanent and comply with the terms of the BPA. Reporting, to include Certificates of Disposal, shall comply with the terms of the BPA. Contractor shall provide a daily summary of loads shipped, including transport vehicle ID number, manifest/bill of lading number, tare weight of vehicle, loaded weight (by site log) and weight as received by final disposal facility.

Note that various railroads may have varying signature requirements on shipping papers. As an example, CSX will not provide someone on the project site to sign as the Transporter but requires signature on their behalf by an individual approved by CSX. Any such required coordination shall be arranged for by the Contractor.

REGULATORY REQUIREMENTS:

Work under this PWS shall be in accordance with all applicable, relevant, and appropriate Federal, State, and local laws and regulations. The Contractor shall be solely responsible for all its actions and inactions from acceptance of the waste materials at the project site.
