NOTICE TO OFFERORS
All sources may submit a proposal as applicable. However, the Republic of Korea (ROK)-United States (U.S.)
Status of Forces Agreement (SOFA), precludes the U.S. Government from granting Invited Contractor or Technical Representative Status to any offeror, for this requirement. All sources submitting a proposal, as applicable, including U.S. sources, must already have, or obtain the requisite business licenses directly from the ROK Government, and conduct business in accordance with all applicable ROK laws, including but not limited to, rules and policies regarding labor, taxation, and immigration. Any contractor not already doing business in Korea, must submit adequate verification in its initial proposal - that it has the requisite business licenses directly from the ROK Government to perform the contract and the capacity to conduct business in accordance with all applicable ROK laws, including but not limited to, rules and policies regarding labor, taxation, and immigration. If an initial proposal does not fully demonstrate this authorization and capacity, it will not be further considered for award.
Whether an offeror demonstrates this authorization and capacity shall be determined by the Contracting Officer.
“All offerors interested in competing for this requirement are required to submit their price proposal in Korean Won (KW) only. A proposal submitted in currency other than Korean Won will not be considered for award.”
GUARANTEE MINIMUM AND MAXIMUM LIMITATIONS
The proposed contracting action is to establish a Multiple Award Indefinite-Delivery, Indefinite-Quantity (IDIQ) contracts. The guaranteed minimum of each contract awarded is $10,000.00. The combined total of all delivery/task orders issued against each awarded contract shall not exceed $12,512,987.70. The guaranteed minimum and maximum amounts are for the life of the contract.

INSTRUCTIONS TO OFFERORS – COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES

NOTE: Performance Work Statement (PWS) is attached to the Solicitation as ATTACHMENT 3.
1. INSTRUCTION FOR PROPOSAL SUBMISSION

(1) These instructions are designed to ensure submission of essential information in order for the Government to understanding and evaluate proposals. Offerors are cautioned to follow the detailed instructions fully and carefully, as the Government reserves the right to make award based on initial offers received, without discussions with Offerors.
(2) No information concerning this solicitation or requests for clarification will be provided in response to Offeror-initiated telephone calls. All such requests must be made in writing and submitted to the above email addresses. All questions must be received no later than 1300 hours on 15 May 2023 (KST). Questions received after this date and time may not be answered.
(3) Offerors are cautioned to submit adequate information to enable the Government team to fully ascertain each Offeror’s capability to perform all of the requirements identified in the solicitation. All commitments made in the proposal shall become a part of the resultant contract.
(4) Offerors are required to submit their proposal in accordance with the instructions provided below through https://sam.gov before closing of solicitation. Award will be made on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for non-cost factors.
(5) The Government intends to evaluate and make award without discussion with the offerors (other than minor clarifications), unless discussions are determined to be necessary.
(6) The Government intends to select a number of vendors in the best interest of the Government, from the list of Lowest Priced Technically Acceptable offerors. Individual delivery/task order requirements will be provided fair opportunity in accordance with FAR 16.505 amongst the multiple contracts awarded.
2. PROPOSAL SUBMISSION: Solicitation Provision for Evaluation of Offers is below:
FACTOR 1. TECHNICAL CAPABILITY
Subfactor 1.1: Prime Contractor's Licenses The Offeror shall submit a copy of the following licenses. The licenses of a subcontractor cannot substitute for the prime contractor’s license.
a. Valid and current business registration (사업자등록증) issued by the Republic Of Korea (ROK) Government
b. Communications License issued by the Korean Communications Commission (KCC)
(정보통신공사업등록증).
Subfactor 1.2: Prime Contractor's Prior Experience The offeror shall submit documentation demonstrating a minimum of three (3) years of experience within the last seven (7) years with a minimum value of ₩100,000,000 per year in installing, relocating, repairing, and removing fiber optics, copper, and Local Area Network (LAN). The experience of a subcontractor shall not be substituted for the prime contractor’s experience. The offeror shall be evaluated on submitted evidence of prior experience as required below:
a. The title of the contract/project
b. The number of the contract/project
c. Clear description of qualifying work experience
d. Length of contract/project (year/month/date – year/month/date)
e. Value of contract/project in Korean Won (₩) for a total amount per year
f. Complete point of contact at Client Organization (name, phone number, email address)
Subfactor 1.3: Staffing Plan The Offeror shall submit a written Staffing Plan with the number of employees/staff and how the Contractor’s employees shall perform install, relocate, repair, remove fiber optic, copper cable, Protected Distribution Systems (PDS), and Local Area Network (LAN) infrastructure in accordance with Performance Work Statement (PWS) and Contract Line Items identified in this solicitation. The plan shall clearly identify the following:
a. Labor categories.
b. Number of employees filling each labor category.
c. Work plan describing how the employees will perform install, relocate, repair, remove fiber optic, copper cable, Protected Distribution Systems (PDS), and Local Area Network (LAN) infrastructure in accordance with Performance Work Statement (PWS) and Contract Line Items identified in this solicitation.
d. Surge plan for periods of heightened levels of work.
e. Employee retention, replacement, and backup plan.
f. Sub-contractor's company name, point of contact (name, phone number, email address), and the percentage of business participation if a portion of the services will be sub-contracted out.
g. Any other information pertinent to the execution of this requirement.
Subfactor 1.4: Organization Chart.
The offeror shall provide an Organizational Chart that clearly shows the existence of sufficient contract oversight to ensure efficient and effective contract performance matching details from the Staffing Plan provided from Subfactor
1.3. for successful performance at all locations, and identifies at a minimum the following:
a. Logical organizational hierarchy showing all functions and all personnel involved in the completion of the overall tasks identified in the PWS.
b. Personnel identified in the Staffing Plan (Subfactor 1.3) are identified in this submitted Organization Chart.
Subfactor 1.5: Key Personnel Qualifications - Contract Manager (CM) and Project Manager (PM) The offeror shall provide a resume of the Contract Manager (CM) and Project Manager (PM) with the following qualifications:
a. Minimum Bachelors of Science (BS) degree in Information Technology or related field.
b. Demonstrating a minimum of three (3) years of experience within the last five (5) years in contract management or project management with satisfactory prior experience relating to telecommunications support (installing, relocating, repairing, and removing fiber optics, copper, and Local Area Network).
c. CM and PM shall be able to communicate and fully be able to carry a coherent conversation in English without constant stoppage due to inadequate English language skills or understanding.
Contract Manager (CM) and Project Manager (PM)’s resume must clearly identify the qualifications above in the following format:
a. Position title held.
b. A clear description of qualifying work experience.
c. Length of work experience (year/month/date – year/month/date).
d. Complete point of contract of employer (business name, point of contact information [name, phone number, email address]).
FACTOR 2. PAST PERFORMANCE
The offeror shall have a minimum of two (2) recent and relevant Past Performance Contract References in installing, relocating, repairing, and removing fiber optics, copper, and Local Area Network.
Recent past performance is “same or similar to” services identified in the PWS. Recent and relevant past performance should also be similar in size, scope, complexity, and contract type in installing, relocating, repairing, and removing fiber optics, copper, and Local Area Network.
a. Past Performance Contract References. The following information shall be included for each past performance reference as applicable, A minimum of two (2) Past Performance Contract Reference submissions are required in the format below:
1. The title of the Contract/Project
2. Contract No. for the Government/Commercial Performance
3. A clear description of qualifying experience
4. Length of Contract/Project (Year/Month/Date – Year/Month/Date)
5. Value of Contract/Project
6. Complete Name of Point of Contact (including email and Phone Number) at Client
Organization/Requiring Activity (RA)
b. Past Performance Questionnaire (PPQ). Each Offeror shall ensure the Past Performance Questionnaire - Attachment #1 is sent to each Past Performance Contract Reference identified in the proposal. The Past Performance Contract Reference will then forward the completed questionnaire directly to the Contract Specialist and Contracting Officer. It is the offeror's responsibility to follow up with the reference to ensure if the required information has been forwarded prior to the closing date of the solicitation. The Offeror shall inform each reference that Contracting Officer will use their response in the evaluation of Past Performance for this solicitation. The Past Performance Contract Reference may submit the completed questionnaire via email to myongsuk.pak.ln@army.mil and james.e.mcgill14.civ@army.mil.
***NOTE: No questionnaires (emailed or otherwise) will be accepted directly from the offeror being evaluated.***
FACTOR 3. PRICE:
a. The Offeror shall provide complete price proposal to include:
1. Schedule of Services (CLINs) – Attachment #2
2. Prices shall be in local currency (Korean Won ₩)
3. Any escalation in option year pricing shall be identified
b. OPTIONS: As part of price evaluation, the Government will evaluate its option to extend services (FAR Clause 52.217-8 - Option to Extend Services) by adding one-half of the Offeror’s final option period prices to the Offeror’s total price. Thus, the Offeror’s total price for the purpose of evaluation will include the base period, 1st option, 2nd option, 3rd option, 4th option and one-half of the 4th option period. Offerors are required only to price the base and four (4) option periods. Offerors shall not submit a price for the potential one-half year extension of services period. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced.
c. A written notice of award furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
d. The offeror shall complete the pricing information for each Contract Line Number (CLIN) identified for the base and four (4) option periods.
3. COMPLETION OF PROVISIONS/CLAUSES (Other Required Documents)
Offeror(s) shall fill out the following FAR or local clauses and submit as the final part of the price proposal:
(1) 52.212-3, Alt 1, Offeror Representations and Certifications--Commercial Items Alternate I
(2) ATTACHMENT: CONTRACTOR’S TAX EXEMPTION DECLARATION
4. SIGNED SOLICITATION AND AMENDMENT: Signed first page of the solicitation (SF1449) and each amendment (SF30) (if any amendment were issued).

(2) The offeror shall submit its proposal in accordance with the following instructions.

(b) Offerors are cautioned to submit adequate information to enable the Government team to fully ascertain each Offeror’s capability to perform all of the requirements identified in the solicitation. All commitments made in the proposal shall become a part of the resultant contract.
(c) Offerors shall submit a complete offer package through https://sam.gov by the closing date and time of this solicitation listed in block 8.
(e) Offeror(s) are responsible for ensuring all proposal are received by the contract specialist and contracting officer by the date/time deadline specified.
(f) Offerors shall be available telephonically with all supporting data necessary to support/discuss their proposals within 24 hours after notification by the Contracting Officer. Times and dates for discussions with each individual entity will be confirmed in writing.
* Note 1: All pricing information shall be submitted in Volume III (Price Proposal) and no other volume.
* Note 2: All volumes (I, II, III, IV) are to be separated. (ex. Volume I – Technical Capability, Volume II- Past Performance, Volume III – Price, Volume IV – Other required documents)
* Note 3: The use of hyperlinks in proposals is prohibited in all volumes.
* Note 4: Any proposal which does not comply with these criteria shall be deemed non-responsive, and shall be eliminated from the competition.
(3) POINT OF CONTACT: Offeror shall provide the Name(s), office/mobile telephone numbers, and e-mail address of person(s) authorized to conduct discussions/negotiations and to financially bind the company.
(4) Contract References to “Day”: Unless otherwise stated herein, all references to ‘day” shall be interpreted to mean ‘calendar day’.
(5) PROPOSAL FILES
(a) Format. All information pertaining to a particular volume shall be confined to that volume. For example, all Factor 1. Technical Capability shall appear in Volume I, all Factor 2. Past Performance information shall appear in Volume II, etc . Price information shall only be presented in Volume III and shall NOT be included in Volumes I and II.
(b) Standard Proposal Instructions. All proposal volumes must:
i) Include a cover, title page, a table of contents, and the body of the proposal.
ii) Provide a list of Tables and Figures for each Volume as applicable.
iii) Provide a Glossary of Abbreviations and Acronyms for each Volume.
iv) At a minimum, all cover sheets shall contain the following information:
- Proposal for W91QVN-23-R-0064, Telecommunications Infrastructure Support Services (TISS), USFK-Wide
- Volume Number and Title
- Name and Address of Offeror
- Identification of either Original or Redacted
- Date of Submission
- Point of contact, name, email address and phone number to support/discuss if necessary for Original copy.
