52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL
SERVICES (NOV 2021)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
1) Factor 1 – Recent and Relevant Experience: The Government will review the submitted project information. Offerors who provide all information and demonstrate that the project description is comparable in size, scope and complexity with this project, as described in the Performance Work Statement, for one project be given an “ACCEPTABLE” rating. Offerors who do not provide all information or do not demonstrate that the project description is comparable in size, scope and complexity with this project as described in the PWS for at least one (1) project will be given an “UNACCEPTABLE” rating.
2) Factor 2 – Pricing: The Government may determine that a proposal is unacceptable if the prices proposed are materially unbalanced between line items or subline items.
Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly overstated or understated as indicated by the application of cost or price analysis techniques. A proposal may be rejected if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government. To be complete, the Offeror must provide all data that is requested and necessary to evaluate the prices.
(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.
