BRAND NAME DETERMINATION USING

SIMPLIFIED ACQUISITION PROCEDURES (SAP)

FOR AN ACTION NOT EXCEEDING THE SIMPLIFIED ACQUISITION THRESHOLD

(AUTHORITY: FAR 13.106-1(b)(1))

1. Agency and contracting activity. Department of Commerce, NOAA Acquisition and Grants Office (AGO), Eastern Acquisition Division (EAD) and Office of Marine and Aviation Operations (OMAO), Aircraft Operations Center (AOC).

2. Description of supplies or services required to meet agency needs (including the estimated value). OMAO/AOC has a requirement to award a contract on a brand name basis for the purchase of a Corporate Aircraft Service Program (CASP) to support the NOAA Beechcraft King Air B300CER, serial number (SN) FM-21/N68RF, and FM-80/N67RF aircrafts for two (2) years. Collins Aerospace is the Original Equipment Manufacturer (OEM) for all of the avionics on board the NOAA King Air B300Cer SN FM-21 and FM-80. The CASP is an insurance policy that provides replacement avionics parts for the entire Collins Avionics installation. The acquisition of the CASP will provide support for FM-21 (N68RF) and FM-80 (N67RF). This protection plan is requested to begin as soon as possible and extend for two calendar years. The current CASP warranty for both FM-21 (N68RF) and FM-80 (N67RF) will expire 16 March 2026. NOAA anticipates renewing the CASP coverage in March of 2026 for the following two years to ensure no lapse in coverage. The purpose of this requirement is to provide NOAA/OMAO/AOC with a fixed-price aircraft protection plan to off-set costly repairs to the NOAA King Air B300Cer SN FM-21 and FM-80 accrued through the normal, yet strenuous, activities. Additionally, the CASP is designed to provide exchange service and repairs to ensure that the NOAA’s King Air fleet is operational or items are repaired safely and on time.

3. Identification of the brand name to be solicited.

4. Supporting rationale. Only one source or brand name is reasonably available as detailed below:

Brand Name – This particular brand name is essential to the requirement and market research indicates similar products do not meet or cannot be modified to meet agency needs.

NOAA/OMAO/AOC owns and operates the King Air B300Cer SN FM-21 and FM-80 which is primarily operated as an Optical Surveillance Platform. This aircraft is tasked with collecting critical data for Coastal Mapping Surveys and performing National Emergency Response Missions after large widespread disasters (hurricane, tornado, flooding). The Emergency

Response mission provides vital information in near real use by FEMA and other Local Emergency Managers to make key decisions. Due to the high failure rate of avionics equipment, it is mission critical, as well as cost effective, to have an avionics protection plan. In addition, this service protection plan will enhance the serviceability and operation of all the Collins instrumentation, which includes required components of the cockpit display system, flight control system, flight management system, inertial navigation systems, GPS, radar altimeter, and weather radar. The aforementioned systems are required for the airworthiness of the aircraft.

Furthermore, an avionics protection plan offers a viable alternative for managing future unscheduled maintenance expenses. The CASP is designed specifically for the Collins avionics components which have been outfitted on the NOAA King Air B300Cer SN FM-21 and FM-80 and, when necessary, provides replacement units in exchange for any inoperable or malfunctioning Collins components in the NOAA King Air fleet.

Exclusive Licensing Agreement/Restrictive Rights/Authorized Reseller – The source has one or more of the following: an established exclusive licensing agreement, proprietary data, limited rights in data, patent rights, OEM required certifications or OEM authorized reseller, copyrights or secret processes with regard to the supplies or services required.

Collins Aerospace is the OEM and only provider that can provide the required CASP; however, they have authorized dealers that can provide the required avionics protection plan to support NOAA/OMAO/AOC King Air B300Cer SN FM-21 and FM-80 aircraft.

5. Market Research.

Market research conducted by the client supports that the Collins Aerospace brand name is the only brand name that provides the required Avionics Protection Plan and accompanying services.

At this time, Collins Aerospace and its authorized dealers are the only sources that have this capability to provide the CASP and no other sources are envisioned in the upcoming year. The Government will continue to conduct thorough market research to gauge the marketplace capabilities for future requirements. As the market of OMAO/AOC aviation requirements evolve, the corresponding avionics protection plan used for the NOAA King Air B300Cer SN FM-21 and FM-80, or subsequent aircraft, will evolve as well. Future requirements will complete adequate market research to determine the capabilities of all avionics protection plans and in regards to the NOAA King Air B300Cer SN FM-21 and FM-80 and their unique requirements. If another potential source emerges due to such actions as Collins Dealers, NOAA will assess whether competition for future requirements is feasible.

Market research conducted by the contract specialist, to include online market research (GSA, SAM, etc.) and reviewing previous NOAA contracts for similar requirements shows that there are multiple small businesses who can support the brand-specific requirement.
