Emergency Purchase Statement Summary

This is an Emergency Purchase Statement issued by the State of Illinois Chief Procurement Office for General Services on behalf of the Department of Public Health, Office of Healthcare Regulation. The Illinois Department of Public Health requires contracted clinical monitoring and survey services to address a sudden and significant increase in monitoring requirements for long-term care facilities and Intermediate Care Facilities for Individuals with Intellectual Disabilities (ICF IID) identified as high risk to resident health, safety, and welfare. The emergency procurement was necessitated by a surge in monitoring requirements and complaint and incident investigations that exceeds internal staffing capacity. The Department estimates a need for approximately 960 total monitoring and survey workdays across multiple program areas during a 90-day emergency period, requiring concurrent deployment of multiple monitoring teams statewide. The selected vendor, Certisurv, LLC, located at 535 W Jefferson St., Springfield, Illinois, was chosen based on its ability to rapidly scale operations, provide sufficient qualified clinical personnel, and initiate services without delay. Services include conducting unannounced on-site monitoring visits and complaint or incident investigations at facilities during evenings, overnight hours, and weekends; observing facility operations; reviewing facility and resident records; completing overdue complaint and incident surveys; documenting areas of noncompliance; immediately notifying the Department of conditions posing risk to residents; and submitting written monitoring and survey reports within 24 hours of each visit. The contract was signed on the earliest applicable date, with services to continue until stabilization of identified conditions.

The total estimated expenditure for this emergency purchase is $2,764,800.00, funded through State Appropriated Funds, with the amount designated as estimated rather than actual, requiring submission of an Emergency Final Cost form by the tenth day of the succeeding month. The Department determined that no active State contract was available to meet the full scope of required services. The Agency contracted with a vendor known to have recently completed similar work following open bidding, offering pricing in line with industry standards and sufficient staffing, skillsets, and geographic coverage to meet the concurrent statewide deployment requirement. While the magnitude and urgency of requirements did not allow sufficient time to conduct broader outreach or establish subcontracting arrangements with Business Enterprise Program certified vendors, the Department affirmed that the emergency purchase was made with as much competition as practicable under the circumstances and that best efforts were utilized to include such certified contractors.

Emergency Condition (select the appropriate option from the drop-down menu below):

Involving threat to public health or public safety

Provide a description and reasons for needing this emergency purchase:

The Illinois Department of Public Health needs to procure contracted clinical monitoring and survey services to address a sudden and significant increase in monitoring requirements for long term care facilities and Intermediate Care Facilities for Individuals with Intellectual Disabilities identified as high risk to resident health, safety, and welfare. The current surge in monitoring requirements includes both ongoing monitoring needs and a significant increase in complaint and incident investigations within the Intermediate Care Facilities for Individuals with Intellectual Disabilities program, further exceeding internal staffing capacity. The Department could not address the increased workload through existing staffing resources within the timeframe necessary to protect resident health and safety

Provide the conditions and circumstances that led to the need for this emergency purchase:

The Department has identified a need for sustained high volume monitoring and survey activities requiring the deployment of multiple clinical professionals over a defined emergency period. Based on current operational requirements, the Department estimates the need for approximately 960 total monitoring and survey workdays across multiple program areas during the emergency period, requiring concurrent deployment of multiple monitoring teams statewide. The Department is unable to meet the anticipated needs with current State and contracted staff. A failure to meet these needs will endanger the health and safety of residents and put the Department at risk of regulatory non-compliance.

Reason for selection of this particular vendor:

Due to the volume, geographic distribution, and immediacy of these requirements, the Department evaluated vendors based on their ability to rapidly scale operations, provide sufficient qualified clinical personnel, and initiate services without delay. The Department reviewed available vendors with experience in long term care monitoring and clinical oversight services.

The Department determined that the selected vendor was able to meet the full scope of required services, including the level of staffing and operational capacity necessary to support concurrent statewide deployment. The magnitude and urgency of the requirement did not allow sufficient time to conduct broader outreach, segment the work for multiple awards, or establish subcontracting arrangements with Business Enterprise Program certified vendors without delaying critical monitoring services and increasing risk to resident health and safety.

Description of supplies or services to be provided:

The vendor shall provide qualified Health Facility Surveillance Nurses, Developmental Disabilities surveyors, and associated clinical professionals to support immediate deployment. Services shall include both monitoring of high-risk facilities and completion of overdue complaint and incident surveys within the ICF IID program. Monitoring and survey activities shall be initiated based on Department identified risk indicators, including but not limited to high level deficiencies, complaint backlogs, incident investigations, quality of care concerns, licensure actions, or other conditions requiring intervention.

Services to be provided include
