About this file

This document is a question and answer summary related to an Invitation for Bid (IFB) issued by the Illinois Department of Central Management Services for JPMC Janitorial Supplies contract B-43164. The IFB provides details on the janitorial supplies procurement, including that pricing must remain firm for the first 12 months after contract execution. The IFB also has a 4% Business Enterprise Program (BEP) goal, which can be met through self-fulfillment by being BEP certified in the required NIGP codes, subcontracting with a BEP certified vendor, or demonstrating a good faith effort. Bidders are allowed one price adjustment per 12-month period after the initial firm pricing term.

The procurement has a requirement that all bidders must be registered as a BEP vendor in one or more of the NIGP codes listed in the IFB in order to be considered for award. Manufacturing products does not qualify as meeting the BEP goal through good faith efforts. Bidders that are 0% Minority Business Enterprise (MBE) can still participate, as long as they meet the 4% BEP goal through one of the allowed methods.

Questions and Answers #1

June 25, 2024

Q1 The IFB says we are allowed one price adjustment every 12 months. Does the 12 months start at time of award or from January – December?

A1 See Section 2.5.1 and 2.5.4 of the contract attached in BidBuy. Pricing must remain firm for the first year after the execution date of the contract.

(Example: If the contract was executed on 07/01/2024, then your pricing must remain firm until 06/30/25. Once your PPI increase is reviewed and accepted, then the pricing would remain firm for another 12 months from the date of execution of the contract amendment.)

Q2 We are a BEP Supplier and sell all the NIGP codes listed but we are not on the Vendor list. Do you know how long it will take to get our NIGP codes on our BEP status updated?

A2 There is no specific timeframe for the process but email cei.bep.certification or call 312-814-4190 to start the process of extending your BEP certification to other codes. You must be registered as a BEP vendor in one or more of the NIGP codes listed in the IFB in order to self-fulfill the BEP goal of 4%. You can fulfill the goal by subcontracting with a vendor that is BEP certified under one of the IFB’s NIGP codes or complete a good faith effort to meet the goal.

Q3 If we get supplies from other vendors, would they be considered subcontractors?

A3 Yes.

Q4 We are only bidding on the items that we can produce so we wouldn’t have a need or interest in subcontracting it out to another organization.

A4 There is still a requirement on this solicitation of a 4% BEP goal. To be considered for award, you must either self-fulfill this goal by being BEP certified in one of the IFB’s NIGP codes, subcontracting with a vendor that is BEP certified in one of the codes, or providing a good faith effort as to why you were unable to subcontract with a BEP certified vendor. Manufacturing of your own products would not meet the definition of a good faith effort.

Q5 If we are 0% MBE, can we still participate in this bid?

A5 Please see answer A2 above. There is still a requirement on this solicitation of a 4% BEP goal.
