About this file

This document is a Question and Answer (Q&A) related to a solicitation from the Illinois Department of Central Management Services for JPMC Glass Beads for Traffic Paint, Bid #22-416CMS-BOSS4-B-32825. The solicitation includes an 11% Businesses Enterprise Program (BEP) goal, which has increased from 7% on the previous bid. Vendors that are not BEP certified must utilize a certified BEP subcontractor to meet the goal. The contract is for a term of 5 years, and the 11% BEP goal applies to the total contract spend, whether calculated annually or over the full 5-year term. Vendors can contact BEP certified freight carriers randomly to meet the goal, but must document communications if unable to reach the 11% target before contacting all listed BEP vendors.

The contract value is over $50,000 annually, and the 11% BEP goal will be calculated based on the total annual spend. For example, if the annual spend is $100,000, the primary vendor would be required to pay 11% of that amount, or $11,000, to the certified BEP subcontractor. The increased BEP goal reflects a growth in the number of certified BEP vendors available since the previous bid.

Questions and Answers #1 11/30/22

Q1
If a vendor is not a BEP vendor, then do they have to use a subcontractor to fulfill the 11% BEP requirement?
A1
(Please reference Part I of the BEP U-Plan) Yes, if the primary vendor is not BEP certified and cannot self-fulfill, the vendor must use a certified BEP vendor from the BEP vendor listing as a subcontractor to fulfill the BEP goal.
Q2
Why did the BEP goal increase from 7% on the last bid to 11% on this bid?
A2
The number of certified BEP vendors listed on the first bid was 107 and the new bid has increased to 189 certified BEP vendors. That calculates into a 4% increase and more vendors that have been certified since the last bid.
Q3
Does the vendor have to contact all freight carriers on the BEP listing or can we narrow it down?
A3
If the vendor decides to use freight carriers to fulfill the 11% BEP goal, then the vendor can randomly choose who to contact on the BEP listing. If the vendor reaches the 11% BEP goal, before contacting all BEP vendors on the listing, then they do not have to contact all BEP vendors on the listing. If they cannot meet the 11% BEP goal before contacting all the vendors, then they must document all communication including emails and responses from each BEP vendor on the list. (Please reference Part III of the BEP U-Plan)
Q4
The contract value is over $50,000 annually, based on that do we base the 11% BEP goal over that amount?
A4
(Please reference A.23 of the Invitation for Bid) The certified BEP vendor shall be paid 11% of the total spend for that contract.
Q5
The contract is supposed to be over 5 years, so is the 11% BEP goal based on the 5 years or annually?
A5
The certified BEP vendor shall be paid 11% of the total spend whether annually or over 5 years.
Q6
(Please reference A.23 of the Invitation for Bid) If your contract value was $100,000 per year, would you give 11% of that to the certified BEP freight carrier?
A6
Yes, if the spend for that year was $100,000, the primary vendor would pay the certified BEP freight carrier 11% of $100,000.
