About this file

This document is a Sole Source Justification Form from the Illinois Central Management Services for a contract to purchase disposable plastic tray inserts and reusable dishware for food delivery systems currently utilized by residential institutions in the state. The contract has an estimated value of $1,063,872.65 and is proposed to be a one-year term contract with Aladdin Temp Rite LLC as the sole economically feasible source. The contract is needed by September 20, 2022 to continue providing meals to patients and clients who are unable to access cafeteria lines. The state has previously issued several Invitations for Bids but has been unable to establish a successful contract, with Aladdin Temp Rite being the only responsive vendor.

The price for this contract has increased significantly from the previous contract due to factors such as higher material and shipping costs, as well as the need to service an additional Veterans home in Chicago. While the proposed pricing is 29% above what the market Producer Price Index would justify, the state has determined it is necessary to approve this sole source to ensure continuity of service for its client population during these unprecedented times.

Section VI - Business Rationale

1. Provide a detailed explanation of the need for the supplies or services:

Meals are provided via the Aladdin food delivery sanitation systems to accommodate patients/clients who are unable to travel through cafeteria lines. Food may be prepared ahead and stored in refrigerator or kept warm until serving time.

2. Provide a list and describe in detail the specifications required to satisfy the need:

To obtain both disposable and reusable items such as entree dishes, bowls, lids, and various dish sizes to be used in the existing food delivery sanitation systems.

3. Provide detail explaining the justification selected in Section IV to explain why the requested supplies or services are the only ones available that can satisfy the agency or university requirements?

This contract will allow the Agencies to purchase disposable and reusable dishware that fit their existing Aladdin food delivery systems at a constant price.

Requesting Agency/University Central Management Services

4. What are the unique features of the supplies or services that are not available in any other product or by any other vendor? Provide specific quantifiable factors/qualifications:

The tray inserts are manufactured by Aladdin Temp Rite and are specific to the food sanitation systems currently in use by the State. In addition, for compatibility purposes they are designed to nest and fit within the compartmental sections during transport to our Veterans and our other State clientele population.

5. Has the Agency or University considered alternative supplies or services to satisfy their need? Yes No

5a. If yes, name the alternative vendors whose supplies or services were evaluated:

Most recently the State has solicited 3 IFBs (B-15962, B-18785 and B-21775) and no successful contract was produced; however, prior to that Aladdin Temp Rite has been the only responsive vendor to meet the State's needs.

5b. If yes, what were the alternatives for each vendor and why were they unacceptable? Be specific with regard to features, characteristics, requirements, capabilities and compatibility:

The facilities have the Aladdin delivery food system. The trays used to deliver the food must have the correct fitting tray inserts used with them or the lids will not fit tightly, causing spillage of the food during transport.

Other food containers have been ordered and used from small vendors, but have not fit correctly issues have occurred. As a result of these issues, new food trays had to be prepared and to be hand delivered to the unit by Dietary staff.

5c. Explain how the market evaluation was conducted?

*This evaluation is to determine available options within a market. If the evaluation is to determine quality or best suited option, this is not the appropriate source selection. Under no circumstances shall the evaluation consist of testing alternative options. These activities must be conducted in a competitive transparent environment (i.e. IFB or RFP).

Historically, IFBs have been issued by the State in order to evaluate the market for these products. Upon review of the US Bureau of Labor Producer Price Index prior to award or renewal we identify any changes in the market in conjunction with prices received to determine if prices are fair and reasonable. In addition, a comparative analysis is conducted with the previous contract prices vs the new pricing to determine if pricing is In the best interest of the State.

6. Are there resellers or distributors?

Yes No N/A

7. What efforts were made to get the best possible price (i.e. did the agency/university negotiate) and how did you determine the price for this purchase is considered fair and reasonable?

A price comparison was conducted between the previous contract prices versus the new proposed pricing which resulted in an overall 67% average increase. In addition, a review of the Producer Price Index (PPI) (WPU072B) disclosed 38% increase which was 138.2 in June 2019 (when last contract prices were established) to 190.082 in May 2022 (the most recent posting when this pricing was received). So PPl shows a market increase of 38% while Aladdin Temp-Rite's proposed pricing has gone up on average 67% higher due to a number of variables. The impact of Covid-19 resulting in higher materials cost to make the products as well as shipping costs. Aladdin Temp- Rite's proposed pricing is 29% above what PPI justifies; however, it does not supersede the State's need to have these products available for the State's clientele population during these unprecedented times.

8. Will this purchase obligate the State to this vendor for future purchases such as maintenance, licensing or continuing need?

Yes No

8a. If yes, please provide details regarding future obligations and/or needs:

This is a continuing need due to fact that the existing Aladdin food delivery systems are already in use by the State.

9. What will be the financial or other impact to the State if this sole source is not approved and a competitive bid is required?

The State will be forced to make multiple small purchases at higher costs until a new contract is established.

10. Is there any additional information you would like to add to justify this sole source?

Yes, in addition for the following reasons the cost has significantly increased this time versus the last contract established in 6/2019:

1. Increased quantity case count changes on lines 1and 2 (1000/cs to 2000/cs) with a higher price of $133.65 and $170.65 Lines 3 (2000/ cs to 4000/cs) with a higher cost of $145.60. Line 4 (4000/cs to 6000/cs) with a higher cost of 165.40.

2. DVA has opened a new Veterans home in Chicago which resulted in increased estimated quantities in order to service our veterans at the facility.

3. The new mugs offered are $101.28 packaged at 48/cs versus the previous contract price of $78.24 (now obsolete) for the same case.
