About this file
This document is a Questions and Answers #2 from a Pre-Bid Conference related to an Invitation for Bid (IFB) issued by the Illinois Department of Central Management Services for JPMC Drugs and Pharmaceuticals (Contract #21-416CMS-BOSS4-B-22340). The IFB covers the procurement of drugs and pharmaceuticals, and the questions provide clarification on topics such as the need to re-do BEP Good Faith Effort, the definition of "original" vs "proposed" pricing, the estimated contract value, and the language around being a primary wholesaler with the ability to distribute all drug manufacturer brands and source pharmaceuticals directly from manufacturers. The contract has an estimated value of $3,000,000.
The pricing terms require the vendor to provide revised price lists with the original and proposed WAC/PHS prices, as well as the proposed WAC/PHS price plus markup. The IFB and contract documents will be amended to ensure consistent language around the vendor requirements. There are no details provided regarding any set-asides, incumbents, funding sources, or other salient information.

Questions and Answers #2 – From Pre-Bid 07/14/2021 at 1:00 PM

Q1 Since the IFB was amended, do we have to re-do our BEP Good Faith Effort?
A1 No, the BEP component did not change so you do not have to re-do your BEP Good Faith Effort.
Q2 Please provide clarification of what is ‘original’ vs. ‘proposed’ in the 4th paragraph of Section 2.6. (Economic Adjustment Clause) of the Contract:
Vendor will provide revised Price List(s) and shall include the following columns in an Excel format: NDC#, Drug Name, Manufacturer Name, Dosage, Strength, Unit of Measure, original WAC/PHS Price, Proposed WAC/PHS Price, Proposed WAC/PHS + Mark-up Price. WAC and PHS Price Lists will be separate.
A2 In the event that the contracted vendor requests pricing changes after the first six months after execution of the Contract, the State is requesting that one column of the updated price list shows the ‘original’ contracted price for the item for the purpose of comparing the ‘original’ price and the ‘proposed’ prices.
Q3 Please clarify the estimated contract value – Section A.22.3.2. states $6,000,000, Section A.22.3.3. states $8,000,000 and the estimated value in BidBuy is $600,000,000.
A3 Sections A.22.3.2. and A.22.3.3. are values that the State is asking the vendor to enter on their quote for evaluation purposes so that the State can conduct an ‘apples to apples’ comparison of bids received. The values in Sections A.22.3.2. and A.22.3.3. are not meant to reflect the estimated contract value.
Sections A.22.3.2. and A.22.3.3. have been updated to reflect the value on the Line Items in BidBuy to be entered for evaluation purposes, which is $3,000,000.
Q4 The language in Section A.22.1.8. of the IFB instructions and Sections 1.2.2. and 1.4.5. of the Contract have inconsistent language – is this a typo?
A.22.1.8. The vendor must be a primary wholesaler with the ability to distribute all drug manufacturer brands. The vendor must be able source pharmaceuticals directly from the manufacturer.
1.2.2. The Vendor must be able source directly from manufacturers and be able to source from all drug manufacturer brands.
1.4.5. The vendor must be a primary wholesaler with the ability to distribute all drug manufacturer brands.
The vendor must source pharmaceuticals directly from the manufacturer.
A4 The IFB and Contract documents will be amended. The language in each Section should read:
A.22.1.8. The Bidder must be a primary wholesaler with the ability to distribute all drug manufacturer brands. The Bidder must be able to source pharmaceuticals directly from the manufacturer.
1.2.2. The Vendor must be a primary wholesaler with the ability to distribute all drug manufacturer brands. The Vendor must be able to source pharmaceuticals directly from the manufacturer.
1.4.5. The Vendor must be a primary wholesaler with the ability to distribute all drug manufacturer brands. The Vendor must be able to source pharmaceuticals directly from the manufacturer.
