About this file

This document is a Certification of Drug Free Workplace form from a Florida state government procurement process. The attachment outlines specific requirements for respondents to demonstrate compliance with a drug-free workplace program as part of a competitive proposal submission. In the event of equal proposals, this certification can provide a preference in the award process under Section 287.087 of Florida Statutes.

The certification requires respondents to implement a comprehensive drug-free workplace program with six key components, including publishing a statement prohibiting controlled substance activities, informing employees about drug abuse dangers, distributing policy statements, notifying employers of drug-related convictions, imposing sanctions on convicted employees, and maintaining ongoing drug-free workplace efforts. The form is designed to be signed by an authorized representative who certifies full compliance with these requirements, with false statements being punishable under law. The document serves as a mandatory attachment to the proposal, potentially influencing the evaluation and selection process for state contract opportunities.

(4) In the statement specified in (1), above, notifying the employees that, as a condition of working on the commodities or contractual services that are being competitively procured, the employees will abide by the terms of the statement and will notify the employer of any conviction of, or plea of guilty or nolo contendere to, any violation of Chapter 893 or of any controlled substance law of the United States or any State, for a violation occurring in the workplace no later than five days after such conviction.

(5) Imposing a sanction on or requiring the satisfactory participation in a drug abuse assistance or rehabilitation program if such is available in the employee's community, by any employee who is so convicted.
