About this file
This is a Standard Bid Bond form (HECO-10.2, Rev. 06/17) for the Commonwealth of Virginia and George Mason University related to the Enterprise Hall Elevator Modernization project. The bid bond guarantees that the contractor will not withdraw their bid during the specified period following bid opening and commits the contractor to enter into a formal contract with the University in accordance with the Contract Between Owner and Contractor (Form HECO-9) if their bid is accepted. The contractor must submit a properly executed and authorized Standard Performance Bond and Standard Labor and Material Payment Bond within ten days of receiving notice of bid acceptance. The bond is contingent upon the contractor's compliance with all bid requirements and contract terms.
The bid bond amount equals five percent (5%) of the total base bid amount plus all additive bid items. In the event of bid withdrawal during the specified period or failure to execute the required contract and bonds within ten days of acceptance notification, the contractor and surety are jointly and severally liable to the University for the difference between the bid amount and any higher amount the University must pay to engage another contractor to perform the work, not to exceed the bond guarantee amount. The surety must be legally authorized to conduct business in the Commonwealth of Virginia and must provide an affidavit and acknowledgement executed by an attorney-in-fact, including notarization and verification that the Power of Attorney has not been revoked.
