About this file
This is a Department of Labor informational poster regarding worker rights under the Davis-Bacon Act for laborers and mechanics employed on federal or federally assisted construction projects.
The poster outlines six primary worker protections. Workers must receive prevailing wage rates as specified in the Davis-Bacon Wage Decision posted with the contract notice. Overtime compensation must be paid at a minimum of one and one-half times the basic rate of pay for all hours exceeding 40 per week, with limited exceptions. Enforcement mechanisms include contract payment withholding, liquidated damages, contract termination, and three-year contractor debarment for non-compliance; falsification of certified payroll records or wage kickbacks may result in civil or criminal prosecution. Apprentice rates apply exclusively to workers properly registered under approved federal or state apprenticeship programs. The law prohibits employer retaliation against workers who file complaints, cooperate in investigations, or testify in proceedings under the Davis-Bacon and Related Acts. Workers who do not receive proper compensation should contact the Contracting Officer or the U.S. Department of Labor's Wage and Hour Division at 866-487-9243 or dol.gov/agencies/whd. Employers are required to display this poster in locations where workers can readily view it.
