About this file
This document is Attachment III of a federal solicitation for communication equipment for El Salvador (ZB-P-LEC) and contains the contract clauses applicable to the resulting contract.
The attachment incorporates Federal Acquisition Regulation (FAR) clauses by reference and in full text, establishing the legal framework for contractor compliance. Key incorporated FAR clauses include provisions addressing: restrictions on subcontractor sales to the government (52.203-6); contractor code of business ethics (52.203-13); whistleblower rights for contractor employees (52.203-17); prohibitions on requiring certain confidentiality agreements (52.203-19); small business set-asides and utilization requirements (52.219-6, 52.219-8); convict labor restrictions (52.222-3); child labor protections (52.222-19); equal employment opportunity for veterans and workers with disabilities (52.222-35, 52.222-36); employment eligibility verification (52.222-54); combating trafficking in persons (52.222-50); tax provisions on foreign procurements (52.229-12); electronic funds transfer payment requirements (52.232-33); protest procedures (52.233-3); and security prohibitions (52.240-91). The document indicates this is a total small business set-aside, meaning only small business concerns may submit offers and any resulting award will be made to a small business concern. Additionally, Homeland Security Acquisition Regulation (HSAR) clauses are incorporated, specifically addressing contractor's representative requirements (3052.242-72) and contract termination provisions (3052.249-90, effective March 2023). The contract clauses establish compliance obligations for employment, labor standards, security, payment processing, and subcontracting practices applicable to the contractor throughout contract performance.
