About this file

This document is Attachment III containing contract clauses that are incorporated into a Department of Homeland Security (DHS) federal solicitation for commercial products and services.

The attachment incorporates numerous Federal Acquisition Regulation (FAR) clauses by reference and in full text, covering standard federal contracting requirements including ethics and conduct (FAR 52.203-13, 52.203-19), System for Award Management maintenance (FAR 52.204-13), small business utilization and set-asides (FAR 52.219-6, 52.219-8), employment and labor standards (FAR 52.222-3, 52.222-19, 52.222-35 through 52.222-54), payment by electronic funds transfer (FAR 52.232-33), and security prohibitions (FAR 52.240-91). Notable clauses include FAR 52.203-17 (Contractor Employee Whistleblower Rights) incorporated with DHS-USCG Deviation 14-01, FAR 52.212-4 (Contract Terms and Conditions for Commercial Products and Services) with Deviation 25-21, and FAR 52.222-90 (Addressing DEI Discrimination by Federal Contractors, effective August 2025), which prohibits racially discriminatory diversity, equity, and inclusion activities and requires contractors to report subcontractor violations. The document also incorporates Homeland Security Acquisition Regulation (HSAR) clauses, primarily referencing commercial item acquisition policies. All incorporated clauses establish mandatory compliance requirements for the contractor and require flow-down to applicable subcontracts.
