PERFORMANCE WORK STATEMENT

Performance Work Statement

Contract Instructors for Competent Person Fall Protection (CPFP) Course (A-493-0103)

NAVAL SAFETY AND ENVIRONMENTAL TRAINING CENTER

SECTION 1. BACKGROUND AND GENERAL INFORMATION

1.1. General: This is a non-personal services contract to develop and instruct the Navy’s Competent Person Fall Protection (CPFP) Course which covers areas in Afloat, Ashore and Aviation Safety to uniformed personnel and civilians working for the U.S. Government in support of the Navy Safety and Environmental Training Center’s (NAVSAFENVTRACEN) mission. The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn, is responsible to the Government.

Description of Services: The contractor shall provide all personnel, equipment, supplies transportation, instructional tools and materials, and non-personal services necessary to perform course instructor services as defined in this performance work statement (PWS). The only Government Furnished Property (GFP) provided to the Contractor is, two Afloat Fall Protection Rescue Kits to use while instructing the class, to ensure the equipment used in training is the same as that used onboard the ships (see Attachment 8). The contractor shall perform in accordance with the PWS and all regulations, guidelines, and documents cited herein, with the goal of producing a course graduate that satisfies the NAVSAFENVTRACEN mission and the learning objectives contained in the course outline provided in Appendix A.

1.2. Background: The goal of NAVSAFENVTRACEN is to provide quality safety, health, and environmental training to selected personnel in order to enhance skills at the basic, intermediate, and advanced levels in order to prepare personnel in their designated specialty or field.

1.3. Objectives:

Instruct the Navy’s CPFP course which consist of Afloat, Ashore and Aviation Fall Protection.

Two (2) qualified instructors deliver accurate course information to students in a professional manner Student learning – effective distribution of knowledge to ensure the safety of uniformed personnel and

Government civilians.

1.4. Scope: The contractor shall develop lesson plans informing instructors of the information needed to instruct the Navy’s CPFP course for Afloat, Ashore and Aviation. The Course slides outline will be provided by the gov’t.

Contractor-provided materials shall align with the outline provided in APPENDIX A and all other references cited herein (see Section 4.2 below). The contractor instructors shall deliver the course to students approved by NAFSAFENVTRACEN according to the dates and locations (CONUS and OCONUS) as identified in Task Orders issued under this contract. Each course is five (5) days/40 hours in duration (see 1.6.4 below). The maximum class size is 25 students. Each course requires two (2) qualified instructors. The following is a list of the primary locations in which training is conducted:

COR.

1.5. Period of Performance: The period of performance shall be for one (1) 5-year ordering period and FAR 52.217-

8 Option to Extend Services.

1.6. General Information:

1.6.1 Quality Control: The contractor shall develop and maintain a Quality Assurance Plan (QA Plan) in order to ensure only qualified instructors are deployed to teach the CPFP courses and to ensure only NAVSAFENVTRACEN-approved information is delivered to students. The contractor shall detail in its quality assurance plan how it intends to maintain and improve instructor proficiency in delivery of the course content and to track individual instructor qualifications and certifications. This QA Plan shall detail the methodology to be used by the contractor to monitor and grade the performance of its personnel as they carry out the requirements of this PWS. The QA Plan shall address the contractor’s courses of action to improve the performance of under-performing instructors and maintain the skills of instructors performing at or above acceptable standards. An example quality control plan shall be submitted with the quotation.

The maximum class size is 25 students. Student/instructor ratios must be such that there is an adequate number of instructors at all times to ensure effective coverage for the entire course including student remediation during class hours, and student supervision and safety. The Government reserves the right to cancel a convening for any reason. If a cancellation is required, the contractor will be notified no later than fifteen (15) days prior to the first day of the class.

1.6.2 Quality Assurance: The Government shall evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan (QASP). This plan is primarily focused on what the Government must do in order to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s). Methods of assessment may include evaluation of student course critique and test scores and observance of contract instructor performance by Government representatives.

1.6.3 Recognized Holidays: The contractor is not required to provide services on these days.

1.6.4 Hours of Operation: The contractor is responsible for conducting business between the hours of 0800 and 1630 each day of instruction, Monday thru Friday, except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government-directed facility closings. Occasionally, non-standard training days may be required by emergencies and operational commitments; in these cases, as much prior notification as possible will be provided to the contractor. However, the course is designed for whole days and should not vary substantially from this format, e.g., ending after a half-day on the last day, two-hour lunches or ending class two hours early on days in the middle of the course. Extending the training day past the normal ending time can only be done with the local Course Coordinator’s concurrence.

1.6.5 Place of Performance: The work to be performed under this contract will be performed at US

Government provided facilities in locations as specified in task orders issued under this contract.

1.6.6 Type of Contract: The Government will award an Indefinite Delivery/Indefinite Quantity contract with Firm-Fixed Price provisions for services and travel.

1.6.7 Security Requirements: The contractor shall conform to all DOD, DON, and local security instructions.

Contractor shall conform to all current and applicable DOD, DON, and local command instructions regarding physical security, key control and Common Access Card (CAC). The contractor shall maintain control over assigned keys (if applicable) and CAC cards. After award of the contract, the contractor shall become knowledgeable of all current Foreign Clearance Guide, DOD, DON, State Department and local command instructions pertaining to personal security and anti-terrorist issues.

This will require each instructor to complete required training and forms such as Level One Anti- Terrorist training, Survival, Evasion, Resistance and Escape (SERE) Training, Human Rights Training, and Country Specific and Isolated Personnel Report (ISOPREP), also known as a PRO-file, within the time frames required by the guiding regulations. Training will be accomplished in person, on-line or through other means as arranged by the contractor and the NAVSAFENVTRACEN. The completion of such training shall be reported upon completion to the Contracting Officer’s Representative. Periodic refresher training may be required. The contractor shall conform/comply with all referenced security and safety instructions as required by location. The course taught under this contract is unclassified.

No security clearances are necessary.

Permits/Decals: (if Applicable) Each contract instructor/manager shall obtain a permit/decal as required by the visited activity security office to enter the work sites.

Accident Reports: Any safety related problems shall be addressed immediately with the COR. The contractor shall conduct an investigation into all accidents occurring on government property involving contract employees and report the findings in writing of such an investigation to the COR within three

(3) calendar days after the occurrence. When required, the contractor shall provide input for reporting accidents involving Navy students.

1.6.8 Post Award Conference/Periodic Progress Meetings: The Contractor agrees to attend all post award events convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation Subpart 42.5. The contracting officer, Contracting Officers Representative (COR), and other Government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. At these meetings the contracting officer or designee will apprise the contractor of how the Government views the contractor's performance and the contractor will apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the Government.

1.6.9 Contracting Officer Representative (COR): The COR will be identified by separate communication.

The COR monitors all technical aspects of the contract and assists in contract administration. The COR is authorized to perform the following functions: assure that the Contractor performs the requirements of the contract; perform inspections necessary in connection with contract performance; maintain written and oral communications with the Contractor concerning various aspects of the contract; issue written interpretations of requirements: monitor Contractor's performance and notify both the Contracting Officer and Contractor of any deficiencies; coordinate availability of Government furnished property/training sites, and provide or coordinate site entry of Contractor personnel. A letter of designation issued to the COR, a copy of which is sent to the Contractor, states the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the resulting order.

1.6.10 Course Manager (CM): The CM is appointed by the Safety Occupational and Health (SOH) Department

Head as the manager of a specific course of instruction. The CM has responsibility for the delivery of the respective course of instruction, and ensuring that all required resources are available and in place at the appropriate time. The CM does not have authority to define, change, alter or clarify contract terms or conditions.

1.6.11 Local Course Coordinator (LCC): The LCC is the liaison between the contractor and the COR/CS at the training site. The CC will identify the training room, coordinate the field exercise, arrange audio-visual equipment (if available) and may act as the receiving agent for items shipped to the training site. The LCC will be identified in each task order. The LCC does not have authority to define, change, alter or clarify contract terms or conditions.

1.6.12 Safety Occupational and Health Department Representative: The NAVSAFENVTRACEN’s SOH representative is appointed by the SOH Department Head as the personnel authorized to review course materials and presentation. The SOH representative will conduct planned and unscheduled course reviews. All reviews will be coordinated with the COR. The SOH representative does not have authority to define, change, alter or clarify contract terms or conditions.

1.6.13 Contractor: The contractor is responsible for the performance of the work. The name of this person and an alternate who shall act for the contractor when the manager is absent shall be designated in writing to the Contracting Officer and COR within five (5) days of award. The Contractor or alternate shall have full authority on all contract matters relating to daily operation of this contract. The Contractor or alternate shall be available between 8:00 a.m. to 4:30 p.m. EST, Monday thru Friday except Federal holidays or when the Government facility is closed for administrative reasons.

1.6.14 Identification of Contractor Employees: All contract personnel conducting training, attending meetings, answering Government telephones, and working in other situations where their contractor status is not obvious to third parties, are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. They must also ensure that all documents or reports produced by contractors are suitably marked and disclosed as contractor products and approved as such by the COR.

1.6.15 Contractor Travel: The contractor shall be required to travel to training locations. In accordance with

Navy policy, charges for official travel shall not include overhead general and administrative expense (G&A). Travel costs for transportation, lodging, meals and incidental expenses are allowable if incurred by contractor personnel as part of official performance under the contract, according to the Joint Travel Regulation. Travel-related costs shall be reasonable, in accordance with the Joint Travel Regulation.

Costs for transportation may be based on mileage rates, actual costs incurred, or a combination thereof, provided the method used results in a reasonable charge. Costs incurred for lodging, meals and incidental expenses shall be considered reasonable and allowable only to the extent they do not exceed on a daily basis the maximum per diem rates in effect at the time of travel. See FAR 31.205-46 for more information on travel costs. Travel costs are further limited by funds specified in this contract. All travel requires Government approval/authorization and notification to the COR prior to traveling.

For training locations in foreign countries, the contract instructors are responsible to meet all travel requirements established for the Area of Responsibility (AOR) in which training will take place. Classes may be taught in webinar format when resident classroom training is not feasible due to pandemics, natural disasters or emergent situations.

1.6.16 Shipment of Course Material: The contractor shall be required to ship training aids and instructional material to training locations. There is no separate reimbursement for shipping costs. 1.6.17 Data Rights: The Government shall retain exclusive, unlimited rights to all documents, materials, and source codes of any software provided by the Government under this contract. These documents and materials shall be used only in the performance of this contract as directed herein, and may not be otherwise used or sold by the contractor. All contractor-provided instructional materials supplied to the Government under this contract shall remain the property of the Government; the Government retains sole and exclusive right to all government-provided inputs and/or templates appearing on course materials. The contractor shall not use, sell, duplicate or provide any government-provided inputs, templates or materials except as directed herein. This right does not abrogate any other Government rights.

1.6.18 Notification: The Government will issue Task Orders at least 30 days prior to the start of scheduled class convening dates for courses held in the continental United States (CONUS), Alaska and Hawaii.

The Government will issue Task Orders at least 60 days prior to the start of scheduled class convening dates for courses to be held outside the Continental United States (OCONUS). There is the potential for course convening’s to be added to the schedule during the period of performance if there is a student demand and funding is available. In such cases, the courses shall be scheduled with the concurrence of the contractor.

1.6.19 Student/instructor ratios must be such that there is an adequate number of instructors at all times to ensure effective coverage of the entire course. Additionally, instructors shall provide student remediation during class hours, and ensure at all times the safety of the students and class environment. The contractor is responsible for ensuring that two qualified instructors provide on-site or virtual instructions for the duration of the course (see Section 3 below).

1.6.20 The Government reserves the right to cancel a convening for any reason. If a cancellation is required, the contractor will be notified no later than fifteen (15) days prior to the first day of the class.

1.6.21 Invoices may be submitted via the Wide Area Workflow (WAWF) system within three (3) days following the last day of each class. All invoices shall include the fixed price cost for the completed convening and for any travel and per diem claimed under the convening. DD form 250 and receipts for all travel claims shall be provided to the COR via email in conjunction with submitting invoices through WAWF. The contractor shall notify the COR via email at the time of each invoice submission.

2.1.2 Definitions

A demonstration is a method of instruction whereby the instructor(s) actually performs the procedures or tasks that are being reviewed. The instructors are expected to at a minimum demonstrate use of rescue equipment.

A workshop is a method of instruction whereby the students are allowed to perform the procedures or tasks that have been demonstrated to them by the instructor(s). Workshops must be accomplished under the supervision of the instructor(s) at an appropriate height. No workshops should require students to climb to levels resulting in high risk training.

Training equipment is material that OSH and environmental professionals may encounter in the performance of their duties, i.e., respirators, monitoring equipment, protective clothing, etc. The contractor shall provide all training equipment listed as ATTACHMENT 5 REV 4 - HK 2 1HARNESS

and ATTACHMENT 7 SURFACE SHIP HARNESSES 2-330023059 JUL2020. The only Government Furnished Property (GFP) will be the two Afloat Fall Protection Rescue Kits (ATTACHMENT 8 USN BC R550 RESCUE KIT - 150_12_11_20) (100 lbs each) for the demonstrations and workshops.

Formal teaching experience is defined as time spent by an instructor in front of a classroom of students conducting training from a lesson plan. The training may take the form of lectures, oversight of students working in groups, working with students in a one-on-one basis in the resolution of academic problems, using audiovisual hardware and software in the presentation of a topic, supervising students during field exercises, and other similar activities.

2.1.3 References

The following documents form an essential part of the PWS. Subsidiary documents, referenced in the cited documents, are also applicable as referenced herein. In all cases of conflict between provisions of the PWS and the documents referenced herein, this PWS shall govern. These references are available on line or will be provided by the COR. SECTION 3. INSTRUCTOR QUALIFICATIONS

3.1. The contractor shall be responsible for employing appropriate, technically- and academically- qualified personnel to perform the instructor services outlined herein.

3.2. Education/Professional Experience: All instructors must have one or both of the following:

- 1) A four-year baccalaureate degree in any discipline, and at least four (4) years of work experience in one of the three, Afloat, Ashore, or Aviation Fall Protection to include knowledge of equipment and procedures specific to a marine environment;

- 2) A two-year associate’s degree in any discipline and at least seven (7) years of work experience in Afloat Fall Protection.

- If the instructor(s) has no degree, then he/she must have at least ten (10) years of experience in afloat fall protection instruction. Examples of the type of work that constitute “experience in one out of three, afloat, ashore and aviation fall protection” are, but are not limited to, the following: selection, use, and inspection of fall protection equipment; conducting fall risk assessments; teaching fall protection standards and risk mitigation procedures; development, implementation and management of a comprehensive fall protection program as either a consultant or employee for a private business or government agency; inspection of a fall protection program as either a consultant or employee of a private business or government agency.

- All instructors shall be capable of conducting performance assessments (hands-on training and practical demonstrations) of various personal fall protection equipment and other fall protection systems and equipment FOR one of the three, AFLOAT, ASHORE, OR AVIATION ENVIRONMENTS AND APPLICATIONS.

3.3. Teaching Experience: All instructors must have a minimum of three (3) years of formal teaching experience. As a reference, one year of teaching experience equates to a minimum of 160 hours of classroom training time per 12-month period. Instructors must also have at least one (1) year of experience instructing DoD or U.S. Coast Guard (USCG) personnel. DoD or USCG teaching experience may be in addition to the above three years of teaching experience or may be counted as one of the three years of teaching experience. Instructors shall also have experience in adult education, as well as knowledge, expertise, and experience greater than the category in which they are instructing. All instructors must have completed the training requirements for and have experience as a certified CPFP. The CPFP training shall include hands-on and practical demonstrations (performance assessment), and the following:

- Implementation of various Fall Protection systems

- Proper donning of the equipment

- Proper inspection and record keeping

- Recognition and identification of Fall-Hazards at work-site

- Verification of proper equipment installation techniques

- Confirmation of proper anchoring and tie-off techniques

- Assessment of risk and hazard ranking

- Preparation, updating, review and approval of Fall Protection and prevention plans, and rescue and evacuation plans.

- Assurance of understanding Fall Protection regulations and standards by personnel to be exposed to fall hazards

- Review and approval of plans and specifications

- Additionally, all instructors shall have teaching experience in compliance with ASSP/ANSI Z359.2 Standard

Titled Minimum Requirements for a Comprehensive Managed Fall Protection Program (latest version). An instructor with no experience teaching DoD or USCG personnel may substitute active duty service of at least three (3) years’ duration in the specified field of the DoD or USCG, with an honorable discharge.

3.4. Proof of current qualifications may be requested at any time by the Government and shall be provided by the contractor within two (2) business days.

SECTION 4. CONTRACTOR TASKING

4.1. Specific Tasks: The contractor shall provide, instruct and maintain up to 50 CPFP AFLOAT, Ashore and Aviation courses per 12-month period based upon references cited in paragraph 2.1.3. The contractor must be able to support simultaneous training located on the East Coast and West Coast when required based upon references cited in paragraph 2.1.3.

NOTE: Certain Instances such as pandemics, natural disasters, or other emergent situations may require courses to be held using a virtual/online delivery platform. During online taught classes, commands are required to provide students equipment outlined in Section 4 of the PWS for online courses which are determined by NAVSAFEVTRACEN or the COR.

If additional course materials (slides, handouts, audiovisual aids, etc.) are needed to meet the learning objectives, the contractor shall develop and submit the materials for government approval at least 10 business days prior to use. There is no predetermined list of specific training equipment, handouts, audiovisual aids, references (other than those cited in the course outline), manuals, etc., to be used in the course. The use of computer-generated graphics (e. g., PowerPoint) to supplement lectures is required. The use of training equipment (see definition of training equipment in paragraph 2.2) and handouts are required. The use of other audiovisual aids, such as video recordings, is encouraged. Contractors shall ensure each course includes all topics/discussion points contained in the course outline (APPENDIX A).

4.2. The contractor shall maintain all course materials and provide updates as required. These materials may include, but are not limited to, instructor lesson plans, student handouts, references, charts, manuals, tests, audiovisual aids, and training equipment. The following updates are required:

Formatting: Contractor shall update and maintain formatting for training materials as required prior to deployment, to ensure the NAVSAFTRACEN templates are applied. NAVSAFENVTRACEN templates will be provided by the Government as GFI.

Lesson Plans: Course materials listed in section 4.1 will be provided by the Government. Formal lesson plans are required to be provided by the contractor.

4.3. All modifications to course materials drafted by the contractor shall be submitted to the COR for review, comment and approval at least ten (10) business days prior to use.

4.4. By accepting contract award, the contractor agrees to provide only qualified instructors, as defined and specified herein, to perform under this contract (see Section 3 of the PWS). All contract instructors shall be thoroughly familiar with all presentation material, training aids, devices and equipment associated with the course and with student remediation procedures.

Within ten (10) days of receiving a task order, the contractor shall provide to the COR the name(s) and qualifications in accordance with Section 3 of the PWS, of the instructor(s) the contractor will deploy to fulfill the Task Order and the instructor who will serve as the alternate instructor. If any of the preferred instructors have not previously taught the Navy’s CPFP AFLOAT, ASHORE and AVIATION course under this contract, the contractor will also provide a resume and specified credentials for each instructor to the COR. The COR may request training certificates, transcripts, or other documentation from the contractor in order to substantiate the information proffered in the resume. The COR will review the resume and either accept or reject the proffered instructor(s) via written notification to the Contract Manager. If the proposed instructor is rejected, the contractor shall have three (3) days to offer qualified replacements or resolve the issues which led to rejection by the Government.

4.5. Contractor shall send to the CM a sanitized student attendance roster, with grades for each course, via email within ten (30) business days of course completion. Contact information for the CM will be provided within ten (10) business days of award or update.

4.6. The contractor will submit a sanitized course completion report via email to the COR within thirty (30) business days after the end of each class convening. The report shall include, at a minimum:

Course attendance roster A summary report containing student names and grades Student test answer sheets Student data records for walk-ins*

Drop/failure records (if applicable) Instructor comments/observations/concerns A detailed report of any safety mishaps A detailed report of any disciplinary issues during the course One copy of each student’s completed test

* Students who did not pre-register for the course and arrive on the first day of training are considered “walk-ins.” These students must provide the contract instructors with the following information: full name, rank/grade, unit or command, and the DoD ID # from the student’s CAC.

4.7. The contract instructors shall, upon request of the CM or COR, make academic comments concerning students.

4.8. The contract instructors shall ensure a dignified, harmonious and professional classroom atmosphere.

4.9. The contract instructors shall administer, grade, and review course examinations. Administration of a comprehensive, objective, knowledge-based test to demonstrate the student’s comprehension of Afloat Fall Protection training topics is required. A minimum test score of 70% (on a 100-point scale) is required to graduate from the course and receive a certificate of completion. The types of test questions asked are at the discretion of the contractor but tests must be approved by the COR prior to start of the course.

4.10. The contract instructors shall teach all assigned topics, in accordance with contract requirements, to achieve effective knowledge transfer and ensure student success within the allotted time.

4.11. The contract instructors and LCC shall examine all classroom/lab training equipment provided by the hosting activity prior to the start of instruction for a particular course convening, and again after the conclusion of the course. Contract instructors shall make a best effort to safeguard the classroom/lab training equipment from damage or theft, to include locking the classroom during periods of vacancy, if keys have been provided to the contract instructors.

4.12. The contract instructors shall perform operational checks on assigned training equipment, devices and aids prior to use in each class.

4.13. The contract instructors shall refer military student disciplinary problems to the LCC.

4.14. The contract instructors shall monitor class activities and equipment usage to ensure a safe environment and safe performance by all participants. The contract instructors are empowered to immediately correct safety violations.

Persistent safety violations shall be reported by the contract instructor to the LCC and COR.

4.15. Contractor shall ensure that all walk-in student data records (if applicable), attendance rosters, and student course critiques (Government-provided) are completed and submitted as required by the PWS. Contract instructors will complete a Drop/Failure Record (Government-provided) for each student who either fails or does not complete the course for other than academic reasons.

4.16. It is the responsibility of the contractor to ensure all contractor employees entering Government facilities conform to all safety, security, work conditions, regulations and procedures which may be in effect during the contract period, and shall be subject to such checks as may be deemed necessary to assure that no violations occur. No employee will be permitted on the Government facilities when such check reveals that the employee’s presence would be detrimental to the security of the facilities or accomplishment of work. Any deficits related to the exclusion of contractor employee(s) shall be assessed to the contractor; these include but are not limited to schedule disruption and related travel expenses for employee transfer/substitution.

4.17. The contract instructors are encouraged to identify and submit to the COR recommended changes to the program of studies. The content of the instructional materials shall not be modified until such changes are approved by NAVSAFENVTRACEN. Accepted changes will be considered during contractor performance assessments.

SECTION 5. COURSE REQUIREMENTS

5.1. GENERAL:

CIN: A-493-0103, Competent Person Fall Protection Course Length: 5 Days Max. Class Size: 25

Purpose/Objective of Course: The purpose of this course is to train and equip Navy Civilians, Navy Sailors E-1, and above, United States Marine Corps civilians and Marines E1 and above personnel who serve as the CPFP for afloat, ashore, and aviation commands or activities. Participants are provided with the knowledge to prepare and implement fall protection and prevention plans and fall-arrest rescue plans and procedures. Classroom tasks will equip attendees with the ability to perform the following tasks: identify hazardous and dangerous conditions encountered during Afloat, Ashore, and Aviation working-from- height operations; take prompt corrective measures; conduct fall hazard surveys and prepare assessment documents; inspect and install fall-protection systems; and ensure compliance with applicable policy documents.

This course fulfills the training requirements delineated in OPNAVINST 5100.19 series, Chapter B13, Department of the Navy Fall Protection Guide, OPNAV M-5100.23, OPNAVINST 5102.1/MCO P5102.1(series), Naval Ships' Technical Manual Chapter 600_ Vol 3, NAVSUP 538 Management of Materials Handling Equipment and Shipboard Mobile Support Equipment, ANSI Z359 Fall Protection Code, and 29 CFR 1910, 29

CFR 1915.

The course is a group paced, criterion referenced, instructor led, student participation, lecture/laboratory type instructional system that uses firmly established training procedures. All procedures will be accomplished in accordance with up-to-date instructional techniques and learning methods.

5.2. The contractor is responsible for developing a student guide/manual to be provided at the beginning of each course, for each student to keep for future reference. A course syllabus is required to be in each student guide/manual, which outlines the topics to be covered by day and the approximate amount of time to be spent on each topic. The student guide/manual shall also include copies of any computer-generated graphics used, along with note-taking space. Material in the student manual shall follow the order in which the material is presented in class to avoid confusion, ensure students can easily follow the course progression, and maximize time on task.

Other handouts are subject to the discretion of the contractor, but shall be included in the student guide/manual.

5.3. The contract instructors shall prepare the classroom for instruction (e.g., ensure course materials are brought into classroom, arrange tables and chairs, layout course materials for each student) and ensure classroom is left in an orderly fashion at the end of each day.

5.4. Demonstration: The instructors shall demonstrate use of fall protection rescue equipment. All equipment for demonstrations shall be provided by the contractor.

5.5. Performance Based Instruction/Assessment: The instructors shall provide a workshop allowing students to don and doff the fall protection equipment and experience use of equipment at a height no more than 4 ft from the ground. Training shall be suspended immediately if any workshop provides experience of more than 4 ft.

5.6. Contract instructors shall provide remediation for any student demonstrating academic problems at any time in the course. Remediation may take the form of one-on-one discussion during or after class hours, extra study assignments to reinforce mastery of difficult material, a review of the results of the final exam, etc. The degree of remediation will be determined by the contract instructor on a case-by-case basis. It is expected that most remediation will be accomplished during regular class hours. However, there may be a need to briefly assist a student on an occasional basis after class. Student remediation shall be performed at no additional cost to the Government. There is no compensation beyond that included in the contract. Any demands on a contract instructor’s time considered excessive and beyond the scope of the contract should be brought to the attention of the COR. The contract instructor shall notify the COR and CM of any student experiencing academic problems.

5.7. The CM will add students into the Learning Portal (SAKAI) prior to class completion which allows students to complete the online critique and download their course completion certificate. In the event that tests cannot be graded before students are dismissed on the final day, it is the responsibility of the contractor to ensure students are notified of their test results and provided their graduation certificate as appropriate within ten (10) business days. Course completion certificates shall be kept under careful control by the contractor and only issued directly to the student successfully completing the course. Contractor must destroy any unused certificates.

5.8. Any student missing more than 20% of a class will fail the course and will not receive a graduation certificate. In this case the contract instructor shall contact the COR and CM immediately upon occurrence to discuss the student’s situation. The Government retains the right to make the final decision on whether or not a student will be allowed to stay for the remainder of the course.

SECTION 6. GOVERNMENT RESPONSIBILITIES

6.1. The Government will provide course files and classroom space, with chalk/dry marker boards and projection screen/monitor as available. For classes taught in Norfolk, the Government will provide a projector and computer workstation. However, in locations other than Norfolk, the contractor is responsible to provide a projector and computer unless the CM or LCC indicates this equipment is available at that location.

6.2. The awarding of Continuing Education Units (CEUs) and/or CIH/CSP Certification Maintenance Points shall be the responsibility of The Safety Community Manager, located at the NAVSAFENVTRACEN, and not that of the contractor. However, the contractor may be required to provide course data so that course certification may be obtained.

6.3. The local Course Coordinator will be responsible for coordinating the field exercise.

6.4. The Government will provide the following administrative supplies: Student information for pre-registration will be provided to the contractor NLT 10 days prior to class start date. Students who complete training will receive a link from the NAVSAFEVTRACEN Learning Portal (SAKAI). Course Critique will be completed online using Survey Monkey, and Completion Certificates will be printed or downloaded upon completion of the Course Critique. Sanitized Attendance Sheet, Course and Student Drop/Failure Record will be emailed to the COR within 30 days of class completion. Documents will be emailed to instructors no later than ten (10) business days prior to each course convening.

6.5. The Government reserves the right to require the contractor to administer unscheduled tests to selected students.

SECTION 7. INSTRUCTOR STANDARDS

7.1 Grooming: The contractor shall ensure that all contract instructors and supervisors maintain a standard of grooming and personal appearance suitable for a semi-formal business environment. The contractor will be notified by the COR of contract instructors who fail to meet the standard. The contractor shall have three (3) days to address complaints and provide a course for corrective action in writing to the COR. Habitual failure to meet the standard may result in the contract instructor’s rejection for future courses. Contract Instructors and students may wear coveralls or other suitable clothing during the field exercise.

7.2. Decorum: The morale and motivation of student and instructional personnel must be maintained at a high level to ensure a favorable learning environment. Contract instructors shall conduct themselves as though they were teaching students in any public place of higher learning (i.e., college, university, technical school). Speech, gestures, photos, videos, etc. which might be construed by a reasonable person to be offensive may result in a formal complaint against a contract instructor. If the infraction is deemed to be egregious, the CM or COR may decide to immediately suspend instructor duties of the offending instructor. In the event a contract instructor is suspended from instructor duties, the contract manager will be immediately notified and the contractor will have 24 hours to replace the instructor with another qualified instructor approved by the COR, at no additional cost to the Government.

SECTION 8. COMPLAINTS AND REMOVAL OF INSTRUCTOR

8.1. In the event that a complaint is made regarding the conduct of contractor personnel, the LCC shall immediately notify the COR and Course Supervisor. The COR will notify the Contract Manager. In situations in which student safety is threatened, the Government is empowered to immediately take appropriate steps to mitigate the situation, to include relieving contract instructors of instructor duty. In this case the contractor shall provide within 24 hours another qualified instructor approved by the COR, at no additional cost to the Government.

The Contract Manager, in conjunction with the COR and Course Supervisor, will investigate complaints made against contract instructors. If the results of the investigation determine the complaint(s) to be valid, the Contract Manager shall have a maximum of three (3) working days to propose a corrective plan for resolving the matter and preventing future similar occurrences. This plan shall be submitted in writing to the Contracting Officer and COR. In the event that the Government deems the corrective plan insufficient for resolution of the problem, a written response to the Contractor Manager shall be provided within three (3) working days.

8.2. Instructors may be relieved of instructor duties for poor performance, as determined by the Government, and replaced by a COR-approved instructor at no additional cost to the Government.

8.3. In the event that an instructor is unable to teach or continue to teach a class for any reason, the contractor shall replace that instructor within twenty-four (24) hours of notification, with a COR-approved instructor, at the contractor’s expense.

8.4. The Government shall periodically audit the contractor’s course and instructors. Audits shall include review of course material, classroom management, and overall student learning. The COR, CM, or Training Support Department Representative may audit the course.

SECTION 9. SAFETY AND SECURITY

9.1. The contractor shall conform/comply with all applicable safety instructions as outlined in the following instructions:

Any safety related problems shall be addressed and reported immediately to the CM and COR.

9.2. The CM and Command/Installation Safety Officer shall conduct an investigation into all accidents/mishaps occurring on Government property involving contract employees and report the initial findings in writing of such an investigation to the COR within three (3) calendar days after the occurrence. The contractor and contract instructors are required to cooperate with any investigations and provide written statement and/or testimony as required. There is no additional compensation under the contract for cooperating or providing written statements or testimony.

9.3. Contractor employees performing under the contract shall meet all requirements for gaining access to

Government Installations. When providing instruction at locations overseas, the contract instructors may be required to complete computer-based training courses or attend briefings as mandated by the Area of Operations Commander. Such computer-based training courses may include, but are not limited to, Level One Anti- Terrorist training; Survival, Evasion, Resistance and Escape (SERE) 100, Code of Conduct Level B Training;

Human Rights Training; and any Country Specific Training. Contract instructors may also be required to complete an Isolated Personnel Report (ISOPREP) also known as a PRO-file. NAVSAFENVTRACEN will provide direction and assistance to the contractor in the completion of this training. Some of the training modules are quite extensive but can be completed in the 60-day window between notification of an overseas course and start of travel.

The completion of such training shall be reported to the COR. The contractor shall not receive any additional compensation for this training. Periodic refresher training may be required.

9.4. The contractor shall maintain control over any assigned keys and return keys to the LCC at the completion of instruction.

SECTION 10. TRAVEL

10.1. The contractor shall conduct all travel in accordance with Joint Travel Regulations (JTR). Travel shall not exceed that allowed in the JTR.

The contractor shall be required to travel to training locations. Travel costs for transportation, lodging, meals and incidental expenses are allowable if incurred by contractor personnel on official company business. Travel related costs shall be reasonable. Costs for transportation may be based on mileage rates, actual costs incurred, or a combination thereof, provided the method used results in a reasonable charge. Costs incurred for lodging, meals and incidental expenses shall be considered reasonable and allowable only to the extent they do not exceed on a daily basis the maximum per diem rates in effect at the time of travel. See FAR 31.205-46 for more information on travel costs. Travel costs are further limited by funds specified in this contract. All travel requires Government approval/authorization and notification to the COR prior to traveling. For training locations in foreign countries, the contract instructors must meet the travel requirements established for the AOR in which training will take place.

NOTE: Certain Instances such as pandemics, natural disasters, or other emergent situations may require courses to be held using a virtual/online delivery platform. No travel shall be conducted during online courses which are determined by NAVSAFEVTRACEN or the COR.

SECTION 11. CONTRACTOR UNCLASSIFIED ACCESS TO FEDERALLY CONTROLLED

FACILITIES, SENSITIVE INFORMATION, INFORMATION TECHNOLOGY (IT) SYSTEMS OR

PROTECTED HEALTH INFORMATION

Executive Order 13467, Reforming Processes Related to Suitability for Government Employee, Fitness for Contractor Employees and Eligibility for Access to Classified National Security Information, Homeland Security Presidential Directive (HSPD)-12, requires government agencies to develop and implement Federal security standards for Federal employees and contractors. The 5 CFR 32 Part 157 in concert with DoD Manual 1000.13, Vol 1, implements the Federal Standards.

APPLICABILITY

This text applies to all DoD sponsored individuals who require CAC eligibility (or login and P/W if acceptable per contract) for: Physical access to DoD facilities or non-DoD facilities on behalf of DoD; Logical access to information systems (whether on site or remotely); or remote access to DoD networks that use only the CAC logon for user authentication, or access to sensitive and protected information. This applies to the Office of the Secretary of Defense, the Military Departments, the Office of the Chairman of the Joint Chiefs of Staff and the Joint Staff, the Combatant Commands, the Office of the Inspector General of the DoD, the Defense Agencies, the DoD Field Activities and all other organizational entities within the DoD (hereinafter referred to collectively as the "DoD Components").

Each contractor employee providing services at a Navy Command under this contract is required to obtain a Department of Defense Common Access Card (DoD CAC). Additionally, depending on the level of computer/network access, the contract employee will require a successful investigation as detailed below.
