Attachment I

STATEMENT OF WORK

DELIVERY OF MEALS

1.1 SCOPE

The Department of Homeland Security (DHS), U.S. Immigration & Customs Enforcement (ICE), Office of Enforcement & Removal Operations (ERO) has a requirement for freshly prepared meals. Contractor shall furnish freshly prepared meals and special bag meals daily, from Monday through Sunday (7) days a week. The Contractor shall furnish all labor, supplies, supervision, materials, equipment, and transportation to provide these meals to the address shown below:

1.2 GENERAL REQUIREMENTS

a. Contractor shall utilize Daily Menu Meal supplied by ICE in accordance with Attachment II.

b. All meals shall be prepared off-site. No food preparation is allowed within the Staging Area Facility.

c. The contractor shall deliver all meals by 7:00 am to the ICE/Operation Facility (see delivery address on Section 1.1). Contracting Officer Representative (COR) or ICE Representative will call the contractor the day before, no later than 3:00 pm to confirm the number of meals and water needed for the next day of delivery.

d. Contractor shall assure appropriate storage and timely transportation of all meals in containers that will assure compliance with temperature requirements as well as all applicable health and sanitation standards. Hot meals shall be delivered in suitable containers supplied by the contractor to maintain the temperature of meals until serving time.

e. Contractor personnel shall assist ICE personnel in unloading at the designated areas in the operations facility.

f. The contractor must obtain approval from the COR for substitutions or changes to the menu at least twenty-four (24) hours in advance prior to making the changes.

g. Contractor shall provide alternate meals if the meals are to be rejected by COR or ICE Representative. All alternative meals shall be prepared by packaging for temperatures, transport and delivery to adherence with the Statement of Work

(SOW).

h. Contractor shall be capable of commencing performance 15 days after contract award date.

ICE reserves the right to reject any food, product, or component thereof upon which the COR, or ICE Representative has determined unacceptable. The contractor shall be notified through a Contract Discrepancy Report (CDR) (Attachment III).

Number of meals* not meeting in accordance with the Statement of Work per month after the date of award.

Amount Withheld or Deducted from the monthly invoice.

*Meals does not refer to individual servings, rather, the whole meal, i.e., breakfast, lunch and/or dinner.

The Government may deduct amounts from the invoice if it determines the Contractor is failing to make substantial progress in meeting the schedule. The decision to withhold or deduct invoice amounts is solely at the discretion of the Government. Deducted amounts are not recoverable by the Contractor.

The contractor shall be monitored in accordance with Attachment IV – Quality Assurance Surveillance Plan.

1.3 FOOD PREPARATION, PACKAGING, AND TEMPERATURES

a. The contractor shall assure that all kitchen personnel have the necessary skills and training to comply with health and safety requirements for menu preparation, packaging, and delivery of food.

b. The contractor shall adhere to the United States Department of Agriculture (USDA), Food Safety and Inspection Services (FSIS), rules and regulations related to food handling, at-risk populations, meat preparation, poultry preparation, and products preparation.

1.4 CONTRACT DEFINITIONS AND ACRONYMS

a. Contract Performance Assessment Report System (CPARS). A report initiated by the COR and the report is issued to the contractor annually.

b. Contracting Officer's Representative (COR). An employee of the U.S. Government who is designated and authorized by the Contracting Officer (CO) in writing to coordinate the technical aspects of this contract and inspect items/services/invoices.

The COR will be authorized to certify invoices for payment.

c. Food. Any raw or processed substance, ice, beverage, including water, or ingredient intended to be used as food, drink, confection, or condiment for human consumption.

d. Food preparation. Packaging, processing, assembling, portioning, or any operation that changes the form, flavor, or consistency of food, but does not include trimming of produce.

e. ICE Representative. Detention/Removal Officer, or Government Technical

Representative who assist the COR in monitoring the technical aspects of the contract.

1.5 TRANSPORTATION & DELIVERY

In transporting and delivery of meals, the contractor shall adhere to the following standards, as well as other appropriate guidelines:

a. At the time of delivery, the contractor shall secure and account for and remove all equipment such as containers, utensils, packaging, tools, etc., used in the delivery of the meals in order to prevent misuse as potential weapons.

b. The contractor shall provide all necessary and appropriate condiments (salt, pepper, sugar, sugar substitute, mustard, mayonnaise, ketchup, salad dressing, etc.) in individually sealed ready to use serving containers or packets. Serving containers must be microwavable. All containers shall be within labeled expiration dates and contain no metal objects in order to be heated in a microwave.

c. The COR or ICE Representative shall inspect the food upon delivery in order to assure that it is palatable in terms of flavor, texture, temperature, appearance and has not been physically compromised in any way during packaging or transport.

The COR or ICE Representative shall determine suitability and palatability before signing for receipt of delivery.

d. The COR or ICE Representative shall issue a CDR for any necessary corrective action and actions to prevent recurrence for any discrepancy or problems with the delivery of meals.

1.6 EMERGENCY PLAN

The contractor shall provide an emergency plan in case ICE makes a request for a higher number of meals during a surge than the estimated quantities. If a surge were to occur the COR will notify the vendor 2 hours in advance of the number of meals needed.

Historically, the meals requested ranged from 50-120 considering operational needs.

1.7 SECURITY

Contractor agrees that each person employed by their firm or any subcontractor will have a Social Security Card issued, and approved by the Social Security Administration and shall be either a United States citizen, naturalized citizen, or lawful permanent resident.

In addition, the Contractor shall verify each employee through E-Verify.

1.8 PERSONNEL

During all operations on Government premises, the Contractor's personnel shall comply with the rules and regulations governing the conduct of Government personnel and the operation of the facility. The Government reserves the right to require the Contractor personnel to "sign-in" upon entry and "sign-out" upon departure from the ICE areas.

1.9 CONTRACTOR MANAGEMENT RESPONSIBILITY

The Contractor shall appoint a Supervisor/Manager who will be the Contractor’s Authorized Representative for technical and administrative performance. The Supervisor shall provide a single point of contact through which all Contractor/Government communications, work, and technical direction shall flow. The Supervisor shall coordinate on behalf of the contractor, such technical direction as the COR or ICE Representative may issue within the terms and conditions of the contract.

2.0 DAILY RECEIPTS

The contractor is responsible for submitting a daily delivery receipt showing the number of meals, and the total of all items. Each delivery receipt must show the temperature of the meal at preparation site and the temperature of the meal upon arrival at Operations Area Facility. The contractor will submit a copy of the invoice to the COR or ICE Representative daily on a daily basis.

2.1 SANITATION AND HEALTH

a. The contractor shall adhere to the United States Department of Agriculture (USDA), Food Safety Inspection Service (FSIS) to meet the Sanitation Performance Standards.

b. Contractor shall comply with all contract specifications as well as all applicable law and ordinance of local, state, and federal health and sanitation department requirements with respect to food selection, storage, preparation, and delivery throughout the contract period. Appropriate current certifications shall be available for inspection by the CO and/or COR when requested.

c. The Contractor’s food preparers/handlers shall be free from infectious disease and have a physical examination, at contractor’s expense by a qualified medical physician, prior to performing any services related to this contract. This examination shall be completed prior to entry on duty and annually thereafter. COR.

d. Meals must meet minimum daily nutritional standards for men, women, and children as established by Food and Drug Administration and the American Dietetic Association (ADA).

e. Temperature requirements are per the definitions of the California Uniform Retail

Food Facilities Law.

f. Contractor shall have both a valid Hazard Analyze Critical Control Point Certification

(HACCP) and Serve Safe Food Certification prior to award of the contract.

Contractor may substitute the following in lieu of the HACCP and Serving Safe Food Certification: equivalent certification from an accredited college, university, or trade school in the field of Dietetics or Food Service with approval by the CO and COR.

g. Contractor shall forward copies of all required certifications to the CO five (5) days prior to the start date of the contract.

h. The contractor shall ensure that the supplies delivered under this contract comply with the Federal Food, Drug, and Cosmetic Act. The Meal Inspection Act, The California Uniform Retail Food Facilities Law, and other applicable local and state regulations. This requirement shall apply regardless of whether or not the supplies have been shipped by interstate commerce.

i. The contractor agrees that livestock products purchased for consumption under this contract shall be purchased only from firms conforming to the requirements of The Humane Slaughter Act of 1958 (7 U. S.C. 1901-1907).

j. ICE or any other compliance agency may conduct sanitation inspections and product examinations at any time and at any location where food or food products for this contract are processed, prepared, handled, stored, distributed from or served. The contractor shall supply the COR with a directory of all sources of supply. the time and date of receipt of raw materials, supplies, and schedules for food preparation at least 5 days prior to start date of the contract.

k. Contractor shall provide sample meals upon request for review by the COR, or ICE Representative in order to assure Contractor compliance. Such requests may be random and unannounced.

l. ICE may conduct, at its expense, laboratory sampling and analysis on any food, product, or component thereof provided under this contract. Frequency of Government verification laboratory testing shall be either on a lot by lot basis or skip lot basis. The frequency of sampling will be at the discretion of the COR or the CO. All government laboratory analysis shall be conducted in government or government approved laboratories with the exception that the Hobart Fat Percentage Measuring Kit, Model IOI, may be used to determine the fat of the ground beef.

m. ICE reserves the right to reject any food, product, or component thereof upon which the COR, or ICE Representative has determined unacceptable.

2.2 Contractor’s Good Standing

The contractor is expected to be in good standing during the contract performance and in compliance with local, state and federal laws and regulations. If the contractor’s permit is revoked or suspended the resultant contractor shall notify immediately the designated COR and the Contracting Officer. Failure to do so will result in immediate contract termination.
