About this file
This is a Conflict of Interest Affidavit required for submission with bids and proposals to the State of Maryland, specifically for the driveway and culvert pipe replacement contract opportunity in Talbot County. The affidavit, effective July 2024, references Maryland's conflict of interest regulations (COMAR 21.05.08.08) and requires all offerors, contractors, consultants, and subcontractors to disclose any activities or relationships that could impair their objectivity or create an unfair competitive advantage in performing contract work. Offerors must warrant that no relevant facts or circumstances exist that give rise to a conflict of interest, except as disclosed in the affidavit itself. The document defines "person" to include authorized representatives and agents with control or supervisory authority over the contract work.
The affidavit requires offerors to provide detailed explanations of any actual or potential conflicts of interest, with provisions for additional documentation if needed. Offerors are obligated to immediately disclose in writing to the procurement officer any conflicts that arise after the affidavit date, including a description of mitigation or neutralization actions. The affidavit must be signed by an authorized representative under penalties of perjury, affirming the truthfulness of all contents. This document must be submitted with the bid or proposal and serves as a binding commitment that the offeror will perform the driveway and culvert pipe replacement work in Talbot County without conflicts that would compromise impartiality or objectivity.
