About this file

This is a Conflict of Interest Affidavit form issued by the State of Maryland in July 2024, applicable to the Division of Rehabilitation Services (DORS) Vehicle Equipment Adaptation Prescription Agreement (VEAPA) procurement. The affidavit requires all offerors, contractors, consultants, and subcontractors at any tier—including their employees and agents with authority to control or supervise contract work—to certify that no conflicts of interest exist that would impair their ability to provide impartial assistance or advice to the State or compromise their objectivity in performing contracted services. Offerors must disclose any relevant facts or circumstances that give rise to or could potentially create conflicts of interest, with detailed explanations attached if necessary. The form establishes that offerors warrant the absence of conflicts of interest except as specifically disclosed in the affidavit documentation.

The affidavit further obligates offerors to immediately notify the procurement officer in writing of any actual or potential conflicts of interest that arise after the affidavit's execution date, including a comprehensive description of actions taken and proposed to mitigate, avoid, or neutralize such conflicts. If the contract has been awarded and performance has commenced, the contractor must continue performance until the procurement officer directs otherwise. The affidavit must be executed under penalty of perjury by an authorized representative and submitted with the bid or proposal. This requirement is referenced in COMAR 21.05.08.08 and falls under the regulatory framework governing Maryland state procurements.
