About this file

This is a Reseller Agreement template for the Kentucky Department of Education (KDE) KETS Network Products and Services contract, governing the participation of resellers authorized by Original Equipment Manufacturers (OEMs) in providing goods and services to Kentucky K-12 public school districts. The agreement establishes compliance requirements for resellers participating under KETS Network contract MA #2700000070. Resellers must execute the agreement to participate in contract-related activities and must maintain current authorization from their OEM. Resellers are required to maintain eligibility and good standing in the Federal ERate Program, with compliance certified in writing and immediate notification required if eligibility status changes. The agreement remains in effect for the duration of the KETS Network contract term and permits enforcement actions including suspension, removal, or disqualification from minibid participation for non-compliance with agreement terms.

Resellers must meet or exceed minimum discounts off Manufacturer's Suggested Retail Price (MSRP) as established by the OEM and approved under the contract, with all pricing offered to Kentucky public school districts required to be contract-compliant, transparent, equitable, and auditable. All quotes must specify defined validity periods with expiration dates and remain valid for the stated term. For ERate minibid Requests for Quote (RFQs), resellers must obtain OEM signoff and approval prior to submission. Resellers must designate a Single Point of Contact (SPOC) for all KDE communications, provide a dedicated email mailbox for ERate-related correspondence monitored by multiple authorized staff, and maintain knowledge of the KETS Master Plan, contract details, the minibid process, and the Federal ERate Program. Specific support personnel must be assigned and kept current for ERate program support, technical support, sales/account management, and warranty and post-sale support.
