About this file

This is a punch-out catalog implementation attachment for a Master Agreement solicitation issued by the Commonwealth of Kentucky. Respondents must indicate their willingness to implement a punch-out catalog system if awarded the contract. The punch-out catalog serves as an alternative procurement mechanism that enables direct integration between the Commonwealth's eProcurement System (eMARS) and a supplier's ERP system, allowing real-time product inventory and availability information to be displayed. When implemented, Commonwealth buyers will access the supplier's punch-out catalog website through eMARS, search for and select desired products and services, and have their shopping cart returned to eMARS as a new request. The formal purchase order process occurs only after the request proceeds through normal eMARS workflow steps and receives approval. Punch-out implementation will commence only upon request from the Commonwealth following contract award.

Successful vendors who agree to implement the punch-out catalog must bear all associated implementation and operational costs without passing expenses to the Commonwealth and must work with the eMARS management team to establish specific catalog requirements. Vendors agreeing to punch-out implementation must grant the Commonwealth and its eProcurement provider a non-exclusive, non-transferable, limited license to use, reproduce, transmit, distribute, and publicly display the punch-out catalog within eMARS, as well as a license to reproduce and display the vendor's trademarks, service marks, logos, and other branding designations identifying the products available under the contract. Vendors may decline punch-out implementation at the time of bid submission without penalty to their contract award eligibility.

ATTACHMENT E – PUNCH-OUT INFORMATION

Respondents shall indicate if they would be willing to implement a punch-out catalog if awarded a Master Agreement from this solicitation. Punch-out implementation will only start upon request of the Commonwealth. Vendors should include this attachment with their bid submission.

Yes, if awarded a Master Agreement as a result of this solicitation, __________________ agrees upon request, to work with the Commonwealth to implement a punch-out catalog.*

No, at this time ________________ cannot agree to implementing a punch-out catalog.

By agreeing to such, the successful vendor agrees to bear all costs associated with the implementation of the Punch-out catalog and shall not pass any costs on to the Commonwealth and agree to work with the eMARS management team to obtain specific requirements for the punch-out catalog.

The successful vendor will be responsible for supplying a punch-out catalog, which provides and alternative mechanism for suppliers to offer the Commonwealth of Kentucky access to products awarded under contract. The punch-out catalog also allows for direct communication between the Commonwealth’s eProcurement System (eMARS) and a supplier’s ERP system, which can reflect real-time product inventory/availability information.

Through utilization of the punch-out catalog model, a Commonwealth buyer will “punch out” to a supplier’s website. Using the search tools on the supplier’s Kentucky punch- out catalog site, the user selects the desired products and services. When complete, the user exits the supplier’s punch-out catalog site and the shopping cart (full of products and services) is “brought back” to eMARS. No orders are sent to a supplier when the user exits the supplier’s punch-out catalog site. Instead, the chosen products and services are “brought back” to eMARS as a new request. The user can then proceed through the normal workflow steps. An order is not submitted to a supplier until a purchase order has been created and approved in eMARS and sent to the supplier.

*For the purposes of this section, the respondent warrants and represents that it is authorized and empowered to and hereby grants the Commonwealth and the Commonwealth’s eProcurement provider but only to the extent of such third-party provider of eMARS eProcurement is working directly on behalf of the Commonwealth a non-exclusive, non-transferable, limited license to use, reproduce, transmit, distribute, and publicly display within eMARS the Contractor’s punch-out catalog site. In addition, the respondent warrants and represents that it is authorized and empowered to and hereby grants the Commonwealth’s eProcurement provider but only to the extent of such third-party provider of eMARS eProcurement is working directly on behalf of the Commonwealth a non-exclusive, non-transferable, limited license to reproduce and display within eMARS the respondent’s trademarks, (Name of Company)

(Name of Company) service marks, logos, trade dress, or other branding designation of the respondent that identifies the products made available by the respondent under the Contract.
