About this file
This is a self-certification representation form for Indian Economic Enterprise eligibility under the Buy Indian Act, issued by the Indian Health Service (IHS), Office of Management Services, Division of Acquisition Policy.
The form requires offerors responding to IHS Sources Sought Notices, Requests for Information (RFI), or Solicitations to self-certify their status as an "Indian Economic Enterprise" (IEE) with Indian ownership as defined in HHSAR 326.601. Eligibility must be maintained throughout three critical periods: at the time of offer submission, at contract award, and during the full contract performance period. Offerors must immediately notify the Contracting Officer in writing if they cease to meet eligibility requirements at any point. Individual Contracting Officers may request documentation of eligibility before awarding set-aside or sole source contracts, and awards are subject to protest if the successful offeror's eligibility is questioned. Additionally, successful offerors must maintain registration with the System of Award Management (SAM). The form includes representation checkboxes for declaring whether the enterprise does or does not meet the IEE definition, and requires completion of fields for the federally recognized tribal entity name, business name, 51% owner name, DUNS number, certifying signature, and print name. False or misleading information submitted in connection with award consideration is punishable under 18 U.S.C. 1001, and false claims submitted during contract performance are subject to penalties under 31 U.S.C. 3729-3731 and 18 U.S.C. 287.
