If not eligible, work may resume with THPO concurrence. If eligible, the contractor must submit a supplemental treatment plan for Signatory Party review and implement it to resolve any adverse effects prior to resuming work, within five calendar days. Plan for Treatment of Unanticipated Discoveries

In the event that unanticipated archeological resources are discovered during construction or any other project related activities, or should known archeological resources be inadvertently affected in a manner that was not anticipated, the following procedures shall be implemented:

The project proponent and/or contractor shall immediately halt all activities in the immediate area of the discovery and take steps to stabilize and protect the discovered resource until it can be evaluated by a qualified archeologist.

The project proponent and/or contractor shall immediately notify Navajo Area THPO staff and COR to document and preliminarily assess the find and formulate a recommendation regarding whether the discovery is National Register-eligible and merits further consideration. The assessment shall address the following factors:

The nature of the resource, such as the number and kinds of artifacts, and presence or absence of archeological features.

The spatial extent of the resource.

The nature of the deposits in which the discovery was made.

The contextual integrity of the resource, damage related to the initial discovery, and potential impacts of the continued activity that resulted in the discovery.

If the preliminary evaluation concludes that the find is not a National Register-eligible property nor a contributing element of an historic property, or its documentation has exhausted the information potential, this conclusion and accompanying documentation shall be transmitted by IHS to the THPO. If THPO agrees within five calendar days of receipt, IHS may authorize resumption of the activity that resulted in the discovery.

If the preliminary evaluation concludes that the find is a National Register-eligible property or a contributing element of an historic property, or that its documentation has not exhausted the information potential, this conclusion and accompanying documentation shall be transmitted by IHS to the THPO with a Supplemental Treatment Plan. If the Signatory Parties determine that the Supplemental Treatment Plan is acceptable, IHS shall ensure that the plan is implemented to resolve the adverse effects. The Supplemental Treatment Plan shall be reviewed and revised pursuant to applicable stipulations of this Agreement, except that the period of review by the participating parties shall be limited to five calendar days. The project proponents shall not resume the activity that resulted in the discovery until IHS has determined that the adverse effect has been resolved and authorizes resumption of the activity.
