4. RFP

If an archaeological monitor is needed will WIHCC Hospital $10,000 allowance cover contractor’s expenses with delays, setting equipment and possible remobilization?

COR

As stated in the solicitation, if an archaeological monitor is needed, Option CLIN 0009 will be exercised via a modification and thus invoiced based on the daily reports submission of hours worked.

5. RFP Will there be hydro-mulch or reseeding required? COR No since the existing conditions do not have vegetation.

6. RFP What are the hours we are allowed to operate equipment? COR Normal business hours and as per contract documents. There are no current limitations for equipment operation.

12. RFP

Regarding the 20% bond requirement, the surety company is seeking confirmation on whether this project complies with tribal laws. Could you please confirm via email that the solicitation 75H701-24-R-00010 for the Winslow and Dilkon Health Care Facility Demolition/Abatement is a federally funded project that will adhere to US federal laws, and not tribal laws, despite being located on an Indian reservation?

CO

This project is federally funded and both the solicitation and resultant contract are FAR (Federal Acquisition Regulation) compliant and governed. Any work performed on tribal land, even on a government leased facility, must adhere to tribal laws; but the governing contracting law is the FAR. There are clauses provided within the solicitation that provide information regarding a contractors’ responsibility to adhere to the local tribal laws (TERO office, Navajo tax, reservation regulations, etc.). Reference applicable clauses in the solicitation.

Also, the 20% bond requirement is for the bid bond (20% of the contract price or $3M, whichever is greater). The resultant contract will require payment and performance bonds equal to 100% of the contract price.
