About this file

This is Addendum No. 1 to a Request for Bid (RFB) for Chemical Analysis Testing Services issued by the Commonwealth of Kentucky, specifically addressing clarifications and updates to the original solicitation requirements. The amendment provides vendor responses to inquiries regarding sample volume expectations, analytical capabilities, and operational procedures. The Commonwealth estimates an average of 25-35 samples per month, with silica analysis being the most frequently requested test, followed by occasional hexavalent chromium, acids, and organic solvent air samples. Samples are submitted from Kentucky Occupational Safety and Health (KY OSH) Industrial Hygienists and include air samples, bulk samples, and wipe samples. The Commonwealth requires all laboratory results to be delivered within seven business days of sample submission, with electronic copies via email being the acceptable reporting format.

The addendum clarifies several critical contract terms and conditions. Subcontracting is explicitly prohibited for any analytes, as multiple sample transfers between laboratories would increase turnaround time and compromise efficiency. Section 32 regarding subcontracts has been removed from the Terms and Conditions to eliminate this contradiction. Regarding the one percent daily penalty for missed delivery dates, the Commonwealth acknowledges that force majeure events such as instrument maintenance, severe weather, and equipment failures may warrant penalty waivers if the laboratory maintains communication with Commonwealth representatives. Any requests for expedited or rush analysis require prior approval from the laboratory and Commonwealth, with associated rush surcharges applied as a one-time charge through a Master Agreement modification. Specialty media charges not provided free of charge must be itemized in the extended description of each affected line item and included in unit pricing. Delivery terms specify F.O.B. Destination Freight Prepaid and Allowed, with all shipping costs the vendor's responsibility.

8 In Section 2: "While most samples will be air samples, bulks and wipe samples may also be submitted"

Can you provide and estimated breakdown or sample volume estimate that should be expected by the laboratory either on a weekly/monthly/quarterly basis? What do you expect the most frequently requested analysis to be?

Is there an estimated budget for analytical services?

The sample volume varies month to month throughout the year, but the average number of samples is estimated to be approximately 25- 35 samples per month. Silica seems to be the most frequently requested analysis along with occasional hexavalent chromium, acids, and organic solvent air samples. Samples can include any submission from the KY OSH (Kentucky Occupational and Safety Health) Industrial Hygienist that are not analyzed in-house.

Where should these additional line items be recorded on the bid sheet?

8 and 18 Section 2: "The use of subcontractors is not permitted for any analytes."

Section 32:

Subcontracts The contractor is permitted to make subcontract(s) with any other party for furnishing any of the work or services herein. The contractor shall be solely responsible for performance of the entire contract whether or not subcontractors are used.

The Commonwealth shall not be involved in the relationship between the prime contractor and the subcontractor. Any issues that arise as a result of this relationship shall be resolved by the prime contractor.

Section 32 contradicts the conditions in Section 2 that states: "The use of subcontractors is not permitted for any analytes."

Can you provided

The restriction on subcontractor is important because subcontracting sample can increase turnaround time. Samples would need to be transferred from the primary lab to the subcontracted lab for analysis, which could delay both the analytical process and the return of the final reports. This may impact timely reporting and overall eƯiciency of the laboratory services

12 B. DELIVERY (Pass/Fail) By submitting a bid to this solicitation, the vendor is stating that the results of the testing will be provided within 7 business days to the Agency.

The vendor agrees that when delivery is not made within the contracted due date, one percent (1%) per day shall be deducted from the vendor’s invoice for each day the vendor fails to meet the contracted delivery date.

Is the Commonwealth willing to clarify that in the event of instrument maintenance, laboratory capacity, severe weather events, or in instances where there are no instrument redundancies built in, that these

Air metals are performed in-house, and we will only be submitting those samples in the event that our instrument is down for an extended period. I think it's resonalble to say that there will be no penaly for missed TAT(Turn around time) in case of instrument failure, or severe weather events outside of human control, ( force majeure ) as long as the DLS staƯ are informed of the situation. We do not typically rush any testing, and if we ever do need expedited result, we will absolutely request prior approval before proceeding.

penalties would not apply, as long as the laboratory representative is in communication with the commonwealth representative? We have no redundancy for many analysis including metals and mercury.

Also, can you clarify that if additional expedited results are requested, that additional rush surcharges would apply and would have to be approved by the laboratory prior to submitting samples (ie Requests for rush analysis is not a guarantee depending on availability, capacity or method)

8 All results must be provided within seven (7) business days.

Are emailed electronic copies suƯicient or do you have any additional reporting requirements? ie hard copies or posting to a portal

Emailed electronic copies of the report is suƯicient.

15 Section 22: FOB Basis of Shipment – Vendor Responsible Quotations of unit prices on this solicitation shall be F.O.B. Destination Freight Prepaid and Allowed. The vendor shall be fully responsible for all shipments and freight charges involved to the ordering agency.

FOB Basis of Shipment- Vendor Responsible applies to expedited shipping. Any expedited requests will require mutual agreement between vendor and agency. Upon agreement a Master Agreement modification shall be processed by the OƯice of Procurement Services for the one time charge.

Does this include expedited shipping requests? Can you clarify

While the majority of media is provided free of charge, there are a few specialty media items that we do charge for. Is there a place to list out media charges or other line items at this time?

Specialty media charges are to be listed in the extended description of each line item that will cause this additional charge and the charge should be listed as part of the unit pricing.
