About this file

This document is a Preliminary Jurisdictional Determination letter from the US Army Corps of Engineers Norfolk District, addressing a specific site in Goochland County, Virginia. The letter pertains to an approximately 7.5-acre project area located on Hockett Road, north of 1600 Portugee Road, involving a wetlands and waters delineation for a proposed fire station project. The document confirms the presence of aquatic resources that meet wetland criteria and have an ordinary high-water mark, which may require permits from various agencies including the Corps, Virginia Department of Environmental Quality, Virginia Marine Resources Commission, and local wetlands board.

The preliminary jurisdictional determination is valid for five years and serves as a precursory step for potential future development, specifically the Fire-Rescue Station 7 West Creek project. While not a legally binding jurisdiction determination, the document highlights potential permitting requirements for any dredged or fill material discharges. The site coordinates are noted as 37.641654; -77.678075, and the delineation was based on a map prepared by Timmons Group dated February 22, 2021. The letter recommends further consultation with USDA program participants and suggests obtaining an approved jurisdictional determination for definitive Corps jurisdiction.

NOTIFICATION OF PRELIMINARY JURISDICTIONAL DETERMINATION

Southern Virginia Regulatory Section NAO-2021-02618 (Broad Branch)

Ms. Wendy Grady, Goochland County C/O Timmons Group 1001 Boulders Parkway, Suite 300 Richmond, VA 232

Dear Ms. Grady:

This letter regards your request for a preliminary jurisdictional determination of the aquatic resources (e.g., wetlands, streams, and ponds) on a site containing approximately 7.5 acres of land (Project Area) located on the east line of Hockett Road, north of at 1600 Portugee Road (Tax Parcel 7725-17-3839) at 37.641654; -77.678075 in Goochland County, Virginia. Your request has been reviewed.

The enclosed map prepared by Timmons Group, entitled, “Figure 4: Wetlands and Waters Delineation Map, Hockett Road Fire Station,” dated 2-22-21, received by this office on 9-24-21, and on file at this office provides the location of the aquatic resources on the Project Area. This letter is not intended to confirm the Cowardin classifications of the aquatic resources.

The aquatic resources exhibit wetland criteria as defined in the of Corps’ 1987 Wetland Delineation Manual and the Regional Supplement to the Corps of Engineers’ Wetland Delineation Manual: Atlantic and Gulf Coast Region. The Project Area also contains aquatic resources with an ordinary high-water mark.

This preliminary jurisdictional determination and associated delineation map may be submitted with a permit application.

Please be aware that you might be required to obtain a Corps permit for any discharge of dredged and/or fill material, either temporary or permanent, into the aquatic resources. Furthermore, you might be required to obtain state and local authorizations, including a Virginia Water Protection Permit from the Virginia Department of Environmental Quality (DEQ), a permit from the Virginia Marine Resources Commission (VMRC), and/or a permit(s) from your local wetlands board and locality.

This delineation and preliminary jurisdictional determination might not be valid for the Wetland Conservation Provisions of the Food Security Act of 1985, as amended.

Therefore, if you or your tenant are US Department of Agriculture (USDA) program participants, or anticipate participation in USDA programs, you should discuss the applicability of a certified wetland determination with the local USDA service center, prior to starting work.

The Norfolk District has relied on the information and data provided by you to make this preliminary determination. If it is determined such information and data are materially false or materially incomplete, a new preliminary determination would be necessary.

This is a preliminary jurisdictional determination and is not a legally binding determination regarding whether Corps jurisdiction applies to the aquatic resources in question. To determine Corps’ jurisdiction, you may request and obtain an approved jurisdictional determination.

This delineation of aquatic resources can be relied upon for no more than five years from the date of this letter. New information may warrant revision. Enclosed is a copy of the “Preliminary Jurisdictional Determination Form”. Please review the document, sign, and return one copy to me.

If you have any questions, please contact Ms. Elaine Holley in the Richmond Field Office at 9100 Arboretum Parkway, Suite 235, Richmond, Virginia 23236, (804) 994- 7662, elaine.k.holley@usace.army.mil.
