Debarment, Suspension, Ineligibility and Voluntary Exclusion Certification

This document is a federal compliance certification form required by the City of Long Beach for vendors seeking City contracts that may involve federal grant funds. The certification applies to all current and potential vendors conducting business with the City of Long Beach and requires authorized representatives to attest that neither their business entity nor any principals have been debarred, suspended, declared ineligible, or voluntarily excluded from receiving federal funds. Prospective bidders must certify compliance with Executive Order No. 12549 and Title 2 CFR Part 180 Subpart C by confirming they are not currently under suspension or debarment, have not been suspended or debarred within the preceding three years, do not have a proposed debarment proceeding pending, have not been indicted or convicted of fraud or official misconduct within three years, and have not had public transactions terminated for cause or default within three years.

The City of Long Beach performs searches on the System for Award Management website at www.sam.gov to verify that awarded consultants are not debarred or suspended. Bidders must complete and submit the certification with their proposals, and any exceptions to the certification must be attached with detailed explanations including the applicable party, initiating agency, and dates of action. If a vendor's status changes at any time, written notice must be submitted within 21 days. False information on the certification may result in criminal prosecution or administrative sanctions. Questions regarding completion of the form should be directed to the Purchasing Division in the City of Long Beach Business Relations Bureau at 562-570-6200.

1. This bid/agreement/proposal or like document has the potential to be a recipient of Federal funds.

In order to be in compliance with Code of Federal Regulations, the City requires this completed form. By signing and submitting this document, the prospective bidder/proposer is providing the certification and acknowledgement as follows:

2. The terms “covered transaction,” “debarred,” “suspended,” “ineligible,” “lower tier covered transaction,” “participant,” “person,” “primary covered transaction,” “principal,” “proposal,” and “voluntarily excluded,” as used in this clause, have the meanings set out in the Definitions and Coverage sections of rules implementing Executive Order 12549.

3. The certification in this clause is a material representation of fact upon which reliance was placed when this transaction was entered into. If it is later determined that the prospective recipient of Federal assistance funds knowingly rendered an erroneous certification, in addition to other remedies available to the Federal Government, the department or agency with which this transaction originated may pursue available remedies, including suspension and/or debarment.

4. The potential recipient of Federal assistance funds agrees by submitting this bid/agreement/proposal or like document that, should the proposed covered transaction be entered into, it shall not knowingly enter into any lower tier covered transaction with a person who is debarred, suspended, declared ineligible, or voluntarily excluded from participation in this covered transaction, unless authorized by the department or agency with which this transaction originated.
