About this file
This file contains required vendor affidavits for the Commonwealth of Kentucky, establishing compliance attestations that bidders, offerors, and contractors must submit to be awarded state contracts. The document outlines multiple affidavit forms that serve different purposes: a general Required Affidavit addressing campaign finance law compliance; an affidavit for entities claiming Resident Bidder Status, requiring one-year documentation of Kentucky business authorization, income tax filing, unemployment insurance contributions, and workers' compensation coverage; and an affidavit for those claiming Qualified Bidder Status under 200 KAR 5:410(3), which applies to nonprofit corporations and qualified nonprofit agencies for individuals with severe disabilities meeting specific employment requirements. Each affidavit must be completed by an authorized representative, notarized, and submitted to the Commonwealth prior to contract award. The affidavits are effective for one year from the date of execution, and the Commonwealth retains the right to request updated affidavits or supporting documentation at any time.
The Annual Required Affidavit for Bidders additionally requires attestation regarding compliance with Kentucky campaign finance laws (KRS 45A.110 and 45A.115), awareness of requirements and penalties under KRS 45A.485 for sales and use tax registration, and for non-bid contracts, disclosure of potential conflicts of interest involving immediate family members, officers, employees, or affiliated entities under KRS 121.056 and KRS 121.330. All contractors and subcontractors must demonstrate compliance with Kentucky workers' compensation insurance requirements under KRS Chapter 342 and unemployment insurance obligations. Failure to provide requested documentation supporting claims of resident or qualified bidder status may result in bidder disqualification or contract termination.
