About this file

This file is an attachment containing required affidavits and attestations for bidders, offerors, and contractors seeking to contract with the Commonwealth of Kentucky for the procurement of lumber for KCI. The document outlines three distinct affidavit requirements that must be completed, notarized, and submitted by authorized representatives of bidding entities. The primary affidavit requires contractors to attest under penalty of perjury that they have not knowingly violated Kentucky campaign finance laws and that contract award will not violate any provision of such laws. The affidavit is effective for one year from the date of execution, though the Commonwealth reserves the right to request updated affidavits at any time. Additionally, bidders claiming resident bidder status must affirm compliance with KRS 45A.494(2), demonstrating that on the date of contract advertisement, the entity is authorized to transact business in Kentucky and has maintained Kentucky corporate income tax filings, unemployment insurance fund payments, and workers' compensation policies for the year prior to and through the advertisement date.

Bidders claiming qualified bidder status must attest that their entity and all subcontractors meet requirements under 200 KAR 5:410(3) and will maintain such compliance throughout the contract term. Qualified bidder status includes nonprofit corporations furthering the purposes of KRS Chapter 163, or qualified nonprofit agencies for individuals with severe disabilities that are organized in the interest of such individuals, comply with occupational health and safety laws, employ individuals with severe disabilities for not less than seventy-five percent of direct labor man hours in manufacturing or providing listed products or services, and maintain registration in good standing with the Secretary of State. The bidding agency reserves the right to request supporting documentation for any claimed status, with failure to provide such documentation upon request resulting in bidder disqualification or contract termination.
