About this file

This document is an attachment containing required affidavits for bidders, offerors, and contractors seeking to contract with the Commonwealth of Kentucky under Kentucky Revised Statutes (KRS) 45A.110 and 45A.115. The affidavits are effective for one year from the date of execution and must be completed by an authorized representative of the contracting party, notarized, and submitted to the Commonwealth prior to contract award or renewal. The document includes three distinct affidavit forms: a general Required Affidavit affirming that the contractor has not knowingly violated Kentucky campaign finance laws and that contract award will not violate any campaign finance provisions; a Resident Bidder Status Affidavit for entities claiming resident status, requiring attestation that the bidder is authorized to transact business in Kentucky, has filed corporate income taxes for one year prior to bid advertisement, has made payments to the Kentucky unemployment insurance fund, and has maintained an active workers' compensation policy; and a Qualified Bidder Status Affidavit for entities claiming status as nonprofit corporations furthering Kentucky purposes or qualified nonprofit agencies employing individuals with severe disabilities at no less than seventy-five percent of direct labor hours.

All affidavits require notarization and include signature lines for authorized representatives with printed name, title, and date. The Commonwealth retains the right to request updated affidavits at any time and may request supporting documentation to verify claimed status. Failure to provide requested documentation upon demand will result in bidder disqualification or contract termination. The bidding agency bears the authority to determine whether documentation sufficiently supports claims of resident or qualified bidder status.
