About this file

This is an Annual Affidavit document for the Commonwealth of Kentucky establishing required certifications and disclosures for bidders, offerors, and contractors participating in state procurement opportunities. The affidavit serves as a mandatory compliance instrument with a maximum effective period of one year and must be notarized. All bidding entities must certify compliance with Kentucky campaign finance laws under KRS 45A.110 and KRS 45A.115, confirm proper disclosure of subcontractor information per KRS 45A.485, verify registration with the Kentucky Department of Revenue for sales and use tax collection, affirm current payment status on all state taxes and fees, confirm non-participation in jurisdictional boycotts as defined in KRS 45A.607, and pledge adherence to restrictions outlined in KRS 11A.236 for a ten-year lookback period.

For non-bid contracts including sole-source, non-feasible-to-bid, and emergency contract awards, additional affidavits are required. Contractors must certify that neither they nor immediate family members with 10 percent or greater business interest have exceeded campaign contribution limits to the gubernatorial slate under KRS 121.056 and KRS 121.150. Contractors must also confirm that officers, employees, affiliated entities, and their spouses have not contributed more than $5,000 in aggregate to campaigns of elected officials with jurisdiction over the contract award per KRS 121.330(1) and (2), and have not directly solicited contributions exceeding $30,000 in aggregate for such campaigns under KRS 121.330(3) and (4). Optional affidavits address resident bidder status and qualified bidder status claims for nonprofits and agencies serving individuals with severe disabilities. The bidding agency reserves the right to request supporting documentation and may disqualify bidders or terminate contracts for failure to provide required documentation or maintain compliance throughout the affidavit effective period.
