About this file

This file contains required affidavits for bidders, offerors, and contractors seeking to do business with the Commonwealth of Kentucky. The document establishes three separate affidavit requirements that must be completed, notarized, and submitted by authorized representatives of contracting parties. The primary affidavit attests that the contractor has not knowingly violated Kentucky campaign finance laws and that contract award will not violate any provision of the state's campaign finance laws. Each affidavit remains effective for one year from the date of execution. The Commonwealth retains the right to request updated affidavits at any time during the contract period.

Two additional affidavits address specific bidder classifications. The Resident Bidder Status affidavit requires entities to affirm they are authorized to transact business in Kentucky and have, for one year prior to and through the date of advertisement, filed Kentucky corporate income taxes, made payments to the Kentucky unemployment insurance fund, and maintained an active Kentucky workers' compensation policy. The Qualified Bidder Status affidavit applies to nonprofit corporations furthering the purposes of KRS Chapter 163 or qualified nonprofit agencies for individuals with severe disabilities that employ such individuals for at least seventy-five percent of direct labor man hours. The bidding agency reserves the right to request documentation supporting claims of resident or qualified bidder status, with failure to provide such documentation upon request resulting in bidder disqualification or contract termination.
