About this file

This document is an Annual Affidavit form required by the Commonwealth of Kentucky for bidders, offerors, and contractors seeking state and local contract opportunities. The affidavit serves as a compliance certification document with an effective period of one year and must be notarized. The form applies to bids and contracts in general and includes additional requirements for non-bid contracts (sole-source, not practical or feasible to bid, or emergency contracts). Bidders must affirm compliance with Kentucky campaign finance laws under KRS 45A.110 and KRS 45A.115, disclose information required by KRS 45A.485, maintain proper sales and use tax registration with the Kentucky Department of Revenue per KRS Chapter 139, and certify that they are not delinquent on state taxes or fees. Additionally, bidders must confirm they are not engaged in boycotts of jurisdictions with which Kentucky maintains open trade as defined in KRS 45A.607, and pledge compliance with prohibitions set forth in KRS 11A.236 for the previous ten years.

For non-bid contracts specifically, contractors must certify compliance with additional campaign finance restrictions under KRS 121.056, KRS 121.330(1)-(4), including limitations on contributions to gubernatorial campaigns and candidates with jurisdiction over the contract award. The form also includes optional affidavits for bidders claiming resident bidder status, which requires the entity to be authorized to transact business in Kentucky and to have filed corporate income taxes, made unemployment insurance payments, and maintained workers' compensation coverage for one year prior to and through the advertisement date. A separate affidavit addresses qualified bidder status for nonprofit corporations furthering KRS Chapter 163 purposes or qualified nonprofit agencies employing individuals with severe disabilities for at least seventy-five percent of direct labor hours. The bidding agency retains the right to request supporting documentation and updated affidavits at any time, with failure to comply resulting in potential bidder disqualification or contract termination.
