About this file

This is an Annual Affidavit document issued by the Commonwealth of Kentucky for bidders, offerors, and contractors participating in state procurement processes. The affidavit serves as a required certification mechanism for all entities seeking to contract with Kentucky state agencies. The document does not establish specific procurement timelines, response dates, or contract terms for individual solicitations; rather, it functions as a standardized compliance form that must be completed and notarized by authorized representatives of bidding entities. The affidavit remains effective for a maximum period of one year and must be renewed upon expiration or updated whenever bidder compliance status changes.

The affidavit contains multiple certification requirements addressing campaign finance law compliance under Kentucky Revised Statutes (KRS), sales and tax registration obligations, state tax payment status, boycott prohibitions, ethics statute compliance, and residency or qualified bidder status claims where applicable. Bidders must swear under penalty of perjury that neither they nor their affiliated entities have violated campaign finance laws, that subcontractors have complied with disclosure requirements, that entities are properly registered for sales and use tax collection, and that no state tax delinquencies exist. For non-bid contracts, additional affidavits address contribution limits to gubernatorial campaigns and restrictions on contributions to candidates with jurisdiction over contract awards. The document requires a notarized signature from a duly authorized company representative and permits procuring agencies to request updated affidavits at any time and to demand supporting documentation to verify claimed bidder status, with failure to comply resulting in disqualification or contract termination.
