About this file
This document is an affidavit requirement form issued by the Commonwealth of Kentucky for bidders, offerors, and contractors seeking state contracts. The affidavit is effective for one year from the date of execution and is required pursuant to Kentucky Revised Statutes (KRS) 45A.110 and 45A.115. An authorized representative of the contracting party must complete the attestation, obtain notarization, and submit it to the Commonwealth to be eligible for contract award or renewal. The form establishes three distinct affidavit categories: a general campaign finance compliance attestation, a resident bidder status claim, and a qualified bidder status claim for nonprofit organizations serving individuals with severe disabilities.
The campaign finance affidavit requires contractors to swear under penalty of perjury that they have not knowingly violated Kentucky campaign finance laws and that contract award will not violate such provisions. For resident bidder status, entities must affirm they are authorized to transact business in Kentucky and have continuously filed corporate income taxes, made unemployment insurance payments, and maintained workers' compensation coverage for the year preceding contract advertisement. For qualified bidder status under nonprofit provisions, organizations must demonstrate they further the purposes of KRS Chapter 163 or meet specific criteria for nonprofits serving individuals with severe disabilities, including employing such individuals for at least 75 percent of direct labor hours on applicable products or services. The bidding agency retains the right to request supporting documentation and may disqualify bidders or terminate contracts for failure to provide such documentation.
