About this file
This is an Annual Affidavit form required by the Commonwealth of Kentucky for bidders, offerors, and contractors seeking contract awards or contract renewals. The affidavit is effective for one year from the date of execution and is mandated under Kentucky Revised Statutes (KRS) 45A.110 and 45A.115. An authorized representative of the contracting party must complete the attestation, have it notarized, and submit it to the Commonwealth. The document serves as a sworn statement under penalty of perjury that the contractor has not knowingly violated Kentucky's campaign finance laws and that the contract award will not violate any provision of those laws. The Commonwealth retains the right to request updated affidavits at any time during the contract period.
The form includes additional attestation sections for bidders claiming "qualified bidder" status or "resident bidder" status. Contractors claiming qualified bidder status must certify they meet requirements under 200 KAR 5:410(3) and may identify as either a nonprofit corporation furthering purposes under KRS Chapter 163 or a qualified nonprofit agency for individuals with severe disabilities that employs such individuals for at least seventy-five percent of direct labor hours. Resident bidder status requires the entity to be authorized to transact business in Kentucky and to have filed corporate income taxes, made unemployment insurance fund payments, and maintained a workers' compensation policy for the year prior to and through the advertisement date. The bidding agency reserves the right to request supporting documentation for any claimed status and may disqualify bidders or terminate contracts for failure to provide such documentation upon request.
