DESCRIPTION OF SCOPE OF WORK – CARSON/TAHOE/GARDNERVILLE/MINDEN:

Nevada revised Statutes (NRS) 484C.160 requires that all persons arrested on suspicion of driving under the influence submit to a test to determine the alcohol or drug content of the suspects' breath, blood or urine. The Department of Public Safety, Nevada State Police (hereinafter referred to as the "NSP") has deemed it necessary and appropriate to seek professional services (hereinafter referred to as the "PROVIDER") in collecting evidentiary samples of blood for appropriate laboratory testing. NRS 484C.250 (1), (a), (1, 2) describes the qualifications for persons who may draw evidentiary blood samples.

The PROVIDER shall ensure that only persons who are appropriately licensed and meet the qualifications described in NRS 484C.250(1)(a)(1) or (2) withdraw blood samples pursuant to this Contract. The PROVIDER shall also ensure those qualified persons who withdraw blood samples pursuant to this Contract are instructed on their exemption from civil and criminal liability when requested by a police officer or the person to be tested as provided for in NRS 484C.250(3).

This agreement requires collection of evidentiary samples on request, 24-hours per day, 7 days a week, at no additional cost to the NSP for after-hours calls. The PROVIDER agrees there will be no additional cost if the arrestee is unable to sign a waiver for emergency room services, therefore requiring NSP to sign on the arrestee’s behalf, in order to ensure medical clearance into a detention center. The PROVIDER will submit invoices to the NSP for services rendered.

The PROVIDER must be located within the Carson City, Tahoe, Gardnerville, or Minden area to ensure compliance with the time requirements outlined in NRS 484C.110(1)(c), which mandates that alcohol concentration measurements be obtained “within 2 hours after driving or being in actual physical control of a vehicle…”

The PROVIDER agrees the qualified person who withdraws the blood sample(s), pursuant to this Contract, must keep the sample(s) in his or her sole custody and control and in substantially the same condition as when he or she first obtained it until delivering it to a peace officer employed by the NSP.

The PROVIDER shall ensure that all evidentiary blood draws are conducted with strict adherence to chain of custody protocols and that samples are handled in a timely and professional manner to preserve evidentiary integrity. Any deviation from standard procedures must be documented and reported to the NSP immediately.

The qualified person who withdraws a sample of blood from another for analysis by an expert, pursuant to this Contract, will be required to complete an affidavit or declaration made under penalty of perjury for each evidentiary blood draw. The affidavit or declaration must comply with the requirements set out in NRS 50.315(4).

The PROVIDER agrees to ensure that all persons who perform evidentiary blood draws, pursuant to this Contract, are made available to appear for testimony in any administrative or judicial proceeding at the request of the NSP or the prosecuting authority. Except as necessary for judicial and/or

administrative proceedings, the PROVIDER will ensure the confidentiality of all information regarding the services performed for the NSP pursuant to this Contract.

The PROVIDER shall promptly notify the NSP of any issues that may affect service delivery, including but not limited to personnel changes, delays in response times, or incidents during sample collection.

Open and timely communication is essential to ensure uninterrupted compliance with legal and procedural requirements.

The PROVIDER will advise the NSP of any change in prices for this service, which will require an amendment to this contract.

The PROVIDER will remit invoices for services rendered monthly. All invoices will be sent to nhpfiscal@dps.state.nv.us. Invoices will include an invoice number, invoice date, date of service for the phlebotomist draw, Nevada Highway Patrol incident number, patient name, and cost of the phlebotomy draw. All blood draw affidavits during that billing period will be sent with the invoice.
