About this file

This Non-Disclosure Agreement (NDA) is between the U.S. General Services Administration (GSA) Assisted Acquisition Services (AAS) and a prospective offeror for a Managed Services contract. The services involve shipping preparation, receiving, secure storage, and inventory management of medical supplies and pharmaceuticals at a single, contractor-provided site designated as "Site G". The NDA strictly defines and protects "Confidential Information", which includes contractor bid/proposal information, trade secrets, proprietary information, government requirements, funding data, past performance information, cost details, and evaluation process information.

Key obligations for the prospective offeror include: not distributing confidential information to unauthorized personnel, requiring employees and subcontractors to sign non-disclosure agreements, using confidential information solely for contract performance, not making copies of confidential information, promptly reporting any unauthorized disclosure, and maintaining agreements with third parties whose proprietary information may be accessed. The agreement also warns that unauthorized information distribution could lead to disqualification from future government procurements and potential criminal, civil, or administrative penalties. The NDA is governed by United States laws and includes provisions protecting whistleblower rights and national security.
