About this file

This is a self-certification form for Indian Economic Enterprise (IEE) representation required by the Indian Health Service under the Buy Indian Act authority.

The form establishes eligibility requirements for offerors seeking to qualify for set-aside or sole-source contract awards under the Buy Indian Act (25 U.S.C. 47). Offerors must self-certify that they meet the definition of an "Indian Economic Enterprise" with Indian ownership as defined in HHSAR 326.601. Eligibility must be maintained throughout three critical periods: at the time an offer is submitted, at the time of contract award, and during the full contract performance period. Contractors must provide immediate written notification to the Contracting Officer if eligibility is lost at any point. The form requires contractors to identify the federally recognized tribal entity, the 51% owner of the IEE firm, the business name, and the DUNS number. Successful offerors must also maintain registration with the System of Award Management (SAM). The form warns that false or misleading information submitted in an offer is punishable under 18 U.S.C. 1001, and false claims during contract performance are subject to penalties under 31 U.S.C. 3729-3731 and 18 U.S.C. 287. The Contracting Officer may require supporting documentation of eligibility before awarding contracts, and awards may be subject to protest if the offeror's eligibility is questioned.
