SECTION 01 11 00 SUMMARY OF WORK

PART 1 - GENERAL

1.1 SECTION INCLUDES

A. A summary of the Work.

B. A statement of the Contractor’s responsibility for the Work.

1.2 SUMMARY OF THE WORK

A. The Work described in these Specifications includes, but it not limited to:

1. Preparatory work including mobilization and demobilization of all necessary equipment, tools, facilities, field offices, materials, supplies, labor, equipment and other items necessary to complete work for Comanche Dam.

2. Preparatory work includes obtaining required construction permits and clearances from county, State, and Federal Agencies for Comanche Dam.

3. Work associated with compliance with the Contract Requirements to include, but not limited to, obtaining fire insurance coverage for duration of the Project to include all public and private property damage and loss of a minimum of ten million dollars ($10,000,000).

4. Install and maintain sediment and erosion control features during the Work and removal of these features in accordance with applicable permits when the Work is complete.

5. Improve and maintain site access roads to Comanche Dam.

6. Perform site preparation, including clearing and grubbing as specified herein.

7. Site demolition for Comanche Dam including existing handrails, instruments to be abandoned, and concrete as shown on Drawings.

8. Complete foundation excavation, cleaning and preparation as shown on the Approved Drawings and Specifications and described herein.

9. Perform dewatering and control of water at Comanche Dam to complete the Work.

10. Furnish and install all materials, labor, and equipment necessary to complete all Work associated with the outlet conduit extension as shown on the Drawings and described herein.

11. Furnish and install all materials, labor, and equipment required to install, drill, test, and protect dowels and anchors as shown on the Approved Drawings and described herein.

12. Furnish and install all materials, labor, and equipment necessary to complete all Work associated with installing the downstream RCC buttress as shown on the Drawings and described herein, including installing monolith joint drains.

13. Furnish all materials, labor, and equipment necessary to complete RCC test section for Comanche Dam work as shown on the Drawings and described herein.

14. Furnish and install all materials necessary to construct the new ogee auxiliary spillway and end sill as shown on the Drawings and specified herein.

15. Furnish and install all miscellaneous metalwork including new handrails at Comanche Dam as shown on the Drawings and specified herein.

16. Performing other miscellaneous work as shown on the Drawings and specified herein including, but not limited to placing random fill, riprap, bedding, and site reclamation and clean-up

B. The Contracting Officer reserves the right to delete any item in the Bid Schedule at any time. If a specific Work item is deleted, the value of the Agreement will be reduced by the Contractor’s bid amount for that specific item.

1.4 RESPONSIBILITY FOR THE WORK

A. Unless stated otherwise in these Specifications or related Contract Documents, completion of all Work described herein shall be considered to be the Contractor’s responsibility.

PART 1 - GENERAL

1.1 SECTION INCLUDES

1.2 SITE LOCATION AND INSPECTION

A. Comanche Dam is located in the Wichita Mountains Wildlife Refuge near Lawton, Oklahoma. The Project location and Work area is shown on the Drawings.

B. Technical inquiries concerning these Specifications and Drawings can be made by contacting:

C. Prospective bidders are required to attend a mandatory pre-bid conference and Site visit to become familiar with existing Project conditions. The pre-bid conference and Site visit will be scheduled prior to the bid opening.

1.3 CONTRACTOR USE OF SITE

A. Site Access: The Work Site and designated staging and stockpile areas can be accessed from Highway 49 as shown on the Drawings. The Contractor shall not enter lands adjacent to the Work Site or use other access roads unless specific use of an area is authorized in writing and approved by the Contracting Officer’s Representative

(COR).

B. Staging and Stockpiling: The Contractor’s staging, and stockpile operations shall be limited to the staging and stockpile areas and within the Limits of Work shown on the

Approved Drawings. Any staging and stockpile operations required that are outside of the Limits of Work shown on the Approved Drawings must be approved in writing by the Contracting Officer’s Representative.

C. Disposal: Disposal of all waste materials, cleared and grubbed vegetation, and excess excavated materials shall be in an approved off-site facility. On-site disposal must be approved in writing by the Contracting Officer’s Representative (COR).

D. The Contractor shall not camp or recreate in the Work Site area or attempt to disturb, feed or manipulate fish and wildlife on the Refuge.

E. The Contractor is required to obey all Wichita Mountains Wildlife Refuge Rules and Regulations. If additional rules and regulations are required by the Refuge; the Refuge has the right to issue a Special Use Permit.

F. The Contractor is required to provide sufficient fire protection as outlined in Section 01 57 00 Temporary Controls.

1.3 WORK HOURS

A. The Contractor is allowed to work 24 hours per day if needed to expedite the construction and completed the Work on-time. Refer to Section 01 32 00 Construction Progress Documentation, for other work hour requirements.

1.4 LIMITS OF WORK

B. The Contractor shall use care to ensure that no Work is performed outside of the Limits of Work shown on the Approved Drawings. The Government Inspector in consultation with the Refuge Manager, will determine the final location of the Limits of Work in the field and has the right to require the Contractor to place fencing or stakes in critical Work areas to delineate the Limits of Work.

PART 1 - GENERAL

1.2 SUBSTITUTIONS

A. The Contractor shall provide all equipment, materials, and services as specified or noted on the Drawings, unless a written approval for substitution is obtained from the Contracting Officer’s Representative. The Contracting Officer’s Representative’s decision regarding the acceptability of substitutions shall be final.

1.3 MANUFACTURER’S SPECIFICATIONS

A. Materials, applications, and tests specified by reference to published standards of a society, association, code, or other published standards are included in these specifications as if written in their entirety.

B. Products and processes included in the Specifications shall conform to the manufacturer’s latest published specifications.

C. The Contractor shall provide sworn affidavits from manufacturers certifying that materials, products, and/or processes delivered and used on the Project meet the specified requirements. Affidavits shall not relieve the Contractor from the responsibility for full compliance with the requirements of the Specifications.

PART 1 - GENERAL

1.1 SECTION INCLUDES

A. A summary of the use of applicable codes, standards, and specifications.

B. A statement of the Contractor’s means and methods for completing the Work.

1.2 APPLICABLE CODES, STANDARDS AND SPECIFICATIONS

A. Unless stated otherwise, the Contractor shall comply with all codes and standards applicable to each type of Work and as listed in individual Specification sections.

Conflicts shall be resolved as follows:

1. Where a conflict occurs between referenced documents and the Specifications, the Specifications govern.

2. Where a conflict occurs between the Specifications and the Drawings, the Specifications govern.

3. Where a conflict occurs between different referenced documents, the document containing the more stringent requirement governs.

4. Where referenced documents are not specified by date, the latest published, applicable version as of date of the Bid Opening shall govern.

1.3 MEANS AND METHODS

A. Means and methods of construction shall be at the Contractor’s sole discretion; subject to the Contracting Officer’s Representative’s right to reject proposed means and methods which:

1. Constitute a hazard to the Work, persons, or property;

2. Will not produce finished Work in accordance with the terms of the contract;

3. Are contrary to specified means and methods required in the contract; or

4. Violates permit requirements or other agreements.

B. The right to reject means and methods of the Contractor shall not be construed or interpreted as acceptance of control of means and methods by the Government or the Engineer.

C. The Government or the Engineer’s approval or failure to exercise the right to reject means and methods shall not relieve the Contractor of the obligation to complete the Work required by the contract.

D. The Contractor shall be responsible for the control of all means and methods for all Work.

PART 1 - GENERAL

1.2 AUTHORITY

A. Measurement methods delineated in specific Specification sections are intended to complement the requirements of this section. In the event of conflict, the requirements of this Specification section shall govern.

B. The Contractor is responsible for making all measurements and computing quantities for payment. The Government Inspector will verify measurements and quantities submitted in the Contractor’s payment application.

C. The Contractor shall provide necessary equipment, labor, software, and survey personnel as required to measure and compute quantities.

1.3 QUANTITIES SPECIFIED

A. Quantities and measurements indicated in the Bid Schedule are for bidding and contract management purposes only. Only quantities and measurements supplied or placed in the Work, verified, and approved by the Government Inspector shall determine payment.

B. If the actual Work requires greater or fewer quantities than those quantities indicated in the Bid Schedule, the Contractor’s payment will be based on the actual quantities

Division 1, Page 12 placed and approved by the Government Inspector multiplied by the unit price bid for the specific item of work.

C. There shall be no adjustment in unit prices if the actual quantity required is within 25 percent of the quantity shown in the Bid Schedule.

D. The Government reserves the right to delete any item of Work in the Bid Schedule that is not required. If a Work item is deleted, the Contractor shall not be entitled to any payment for that bid item.

1.4 MEASUREMENT OF QUANTITIES

A. Measurement Devices:

1. Weight scales: inspected, tested, and certified within the past year.

2. Platform scales: of sufficient size and capacity to accommodate the conveying vehicle.

3. Metering device: inspected, tested, and certified within the past year.

B. Measurement by volume: Measured by cubic dimension using mean length, width, and height or thickness.

C. Measurement by area: Measured by square dimension using mean length and width or radius.

D. Linear measurement: Measured by linear dimension, at the item centerline or mean chord.

1.5 PAYMENT

A. Payment includes full compensation for all required labor, supervision products, tools, equipment, plant, transportation, services and incidentals, handling, stockpiling, rehandling, erection, application or installation of an item of the Work, including overhead or profit.

B. Final payment for Work governed by unit prices will be made on the basis of neat line measurements and quantities approved by the Government Inspector and multiplied by the unit price for the Work. There will be no payment for unauthorized Work or Work extended beyond the neat lines shown on the Drawings. Any additional work must be approved in writing by the Contracting Officer’s Representative for additional payment.

1.6 DEFECT ASSESSMENT

A. The Contractor shall replace the Work, or portions of the Work, not conforming to specified requirements as determined by the Contracting Officer’s Representative at the Contractor’s sole cost.

B. If, in the opinion of Contracting Officer’s Representative, it is not practical to remove and replace the Work, the following remedies will apply:

1. The defective Work may remain, but the unit price will be adjusted to a new unit sum/price at the discretion of the Contracting Officer’s Representative.

2. The defective Work shall be partially repaired to the satisfaction of the Contracting Officer’s Representative, and the unit price will be adjusted to a new unit sum/price at the discretion of the Government.

C. The authority of the Contracting Officer’s Representative to assess the defect and identify payment adjustment is final.

1.7 NON-PAYMENT FOR REJECTED PRODUCTS

A. Payment will not be made for any of the following:

1. Products wasted or disposed of in a manner that is not acceptable to the Contracting Officer’s Representative.

2. Products determined as unacceptable before or after placement.

3. Products not completely unloaded from the transporting vehicle.

4. Products placed beyond the neat line limits or the Limits of Work of the required Work without approval.

5. Products remaining on-site after completion of the Work.

6. Loading, hauling, and disposal of rejected Products.

1.8 MEASUREMENT AND PAYMENT OF BID ITEMS

A. Refer to individual specifications for specific measurement and payment requirements related to the Bid Schedule.

SECTION 01 31 00 PROJECT MANAGEMENT AND COORDINATION

PART 1 - GENERAL

1.1 SECTION INCLUDES

A. Required Project meetings.

B. Submittals.

1.2 PROJECT MANAGEMENT SUBMITTAL

A. A Project Management Submittal is required to be submitted with the Contractor’s bid and construction proposal and will be used to evaluate the bidder’s qualifications. The Project Management Submittal shall be submitted in accordance with the requirements of Section 01 33 00 Submittal Procedures and shall include the following minimum information.

a. The Contractor’s proposed schedule developed in accordance with the requirements of Paragraph 1.2A of Section 01 32 00 Construction Progress Documentation.

b. Resumes for the Contractor’s proposed Project Manager, Site Superintendent, and Safety Officer.

c. Resumes for the Contractor’s proposed RCC Superintendent and Batch Plant Operator that documents that the personnel meet the minimum requirements of Paragraph 1.5A of Section 03 37 23 Roller Compacted Concrete.

d. Resume(s) for the Contractor’s proposed Grouting Supervisor that documents that the personnel meet the minimum requirements of Paragraph 1.5A of Section 33 05 33 HDPE Outlet Conduit Extension.

B. Key personnel included in the above-mentioned Project Management Submittal cannot be replaced during the Project without submitting resumes of substitute personnel who have equal or better qualifications. The approval of substitute personnel will be at the COR’s sole discretion.

PART 3 - EXECUTION

3.1 PROJECT MEETINGS AND CALLS

A. The Contractor is required to participate in a pre-construction meeting prior to commencement of on-site construction, with representatives of the Refuge, the Government Inspector, the Engineer, and the Contracting Officer’s Representative before any Work is initiated on the Site. At the pre-construction meeting, the Contractor shall develop and thoroughly explain their construction schedule; safety programs; construction management procedures; proposed construction facilities; and construction layout plan for staging, stockpiling, and other key construction activities.

The Contractor’s Project Manager, Site Superintendent, and Site Safety Officer and key subcontractor personnel are required to attend the pre-construction meeting.

Project communication protocol between the Contracting Officer, the Contracting Officer’s Representative, the Engineer, the Government Inspector, and the Refuge shall be established at the pre-construction meeting.

B. At least once per week, the Contractor is required to participate in an on-site progress meeting with the Government Inspector, Contracting Officer’s Representative, Engineer, and Refuge Staff, and key-subconsultants during construction to discuss Work progress. Participation by the Government Inspector will generally be on-site and participation by the Contracting Officer’s Representative and others will generally be by teleconference.

C. During the weekly progress meetings, the Contractor shall provide a verbal report of Project progress during the last week. The Contractor shall also review the latest three-week, look-ahead schedule and present all conflicts, discrepancies, and other construction challenges for resolution. Prior to each progress meeting, the Contractor shall provide an updated detailed Work schedule for the next three-week and discuss key near-term milestones and Project coordination issues.

D. The progress meeting may occur more frequently as deemed necessary by the Government Inspector or Contracting Officer’s Representative to address any construction issues that may arise before the scheduled weekly progress meetings.

There will be no additional cost to the Government for more frequent meetings.

E. The Engineer or the Government Inspector will prepare a written summary of each progress meeting and distribute a meeting summary to the Contracting Officer’s Representative and the Contractor.

1.2 Schedule Submittals

A. The Contractor shall submit a Project Construction Schedule in accordance with Section 01 33 00 Submittal Procedures. The construction schedule shall be provided in a Gantt chart format and shall clearly illustrate the Contractor’s Work Breakdown Structure for the Project, and key schedule dependencies of all required Work tasks and subtasks. The schedule shall clearly illustrate the critical path of the Work and scheduled start dates, finish dates, and float time for all tasks and subtasks. The Project Construction Schedule shall be submitted in a portable document format (PDF) with color print to enhance its legibility if applicable.

B. The Contractor shall submit a printed, updated, Three-week, Look-ahead Project Schedule as part of the Project meetings described in Section 01 31 00 Project Management and Coordination.

PART 2 - PRODUCTS

PART 3 – EXECUTION

3.1 WORK SEQUENCE

A. With the exception of the key Work task sequencing required below, the Contractor shall develop the sequence of Work task and document this sequence in the construction schedule as described in Paragraphs 1.2A and 1.2B of this Section of Specifications.

1. All sediment and erosion control features required by the Construction Stormwater Pollution Prevention Plan (SWP3) shall be installed prior to disturbance along the access road, stockpile and staging areas, and in any Work areas.

2. The Government will issue the Notice-to-Proceed as soon as possible to allow for Work related to access road improvements, staging stockpile areas and initial submittals to ensure the project schedule can be complete on time.

3. Any reservoir controls must be installed and approved by the Government Inspector before Work can begin at Comanche Dam. Contractor must maintain the reservoir water surface elevation in accordance with Section 01 57 00 Temporary Controls.

4. The Contractor shall obtain permission from the Government Inspector before removing any temporary reservoir control systems.

3.2 WORK HOURS AND NOTIFICATIONS

A. The Contractor shall establish normal Project Work hours and Work days. The Government Inspector shall be notified at least seventy-two (72) hours in advance of any changes in normal Project Work hours or Work days. Work outside of the normal established Work hours may require approval by the Contracting Officer’s Representative.

B. The Contractor is required to provide written notification to the Government Inspector at least seven (7) days in advance of placement of any concrete or roller compacted concrete (RCC).

C. The Contractor shall provide at least ten (10) days written notice prior to the date of the final Project Inspection.

3.3 PROJECT COORDINATION

A. Deer and Elk hunting occurs on the refuge in November, December, and January. The Contractor shall coordinate their work activities with the Refuge prior to and during these seasons.

SECTION 01 33 00 SUBMITTAL PROCEDURES

PART 1 - GENERAL

1.1 SECTION INCLUDES

A. This section includes requirements for providing submittals to the Contracting Officer’s Representative Engineer.

1.2 DEFINITIONS

Work-related submittals of this Section are categorized for convenience as follows:

A. Product Data: Product Data include standard printed information on materials, products, and systems not specifically prepared for the Work, other than designation of selections from among available choices printed therein.

B. Shop Drawings: Shop Drawings include specifically prepared technical data for the Work, including drawings, diagrams, performance curves, data sheets, schedules, templates, patterns, reports, calculations, instructions, measurements, and similar information not in standard printed form for general application to other contracts.

C. Samples: Samples include both fabricated and unfabricated physical examples of materials, products and units of Work; both as complete units and as smaller portions of units of Work, either for limited visual inspection or, where indicated, for more detailed testing and analysis.

D. Miscellaneous Submittals: Miscellaneous Submittals related directly to the Work include construction permits, project photographs, survey data and reports, physical Work records, quality testing and certifying reports, copies of industry standards, Record Drawings, field measurement data; and similar information, devices and materials applicable to the Work and not processed as Product Data, Shop Drawings or Samples.

E. Days: Days shall be calendar days.

1.3 REVIEW AND PROCESSING OF SUBMITTALS

A. Refer to FAR 52.236-5 Materials and Workmanship, and Specifications and Drawings for Construction.

B. A summary of required submittals, but not necessarily all required submittals, is listed in Table No. 1. The Contractor is required to make all submittals required by the Contract documents, including these Specifications. Detailed submittal requirements are included in each section of these Specifications.

C. The Engineer will review submittals only for general conformance with the design concept. Such review by the Engineer shall not relieve the Contractor or any Subcontractor of responsibility for full compliance with agreement requirements; for correctness of dimensions, clearances and material quantities; for proper designing of details; for proper fabrication and construction techniques; for proper coordination with other trades; or for providing all devices required for safe and satisfactory construction and operation.

D. Submittals reviewed by the Engineer and returned to the Contractor shall be marked with one of the following designations:

1. No Exceptions Taken

2. Make Corrections Noted

3. Revise and Resubmit

E. The Contractor shall not proceed with procurement, manufacture or fabrication of items for review until such submittals have been designated by the Engineer as “No Exceptions Taken” or “Make Corrections Noted,” unless specifically authorized in writing to do so by the Contracting Officer’s Representative..

F. Processing of submittals that do not require resubmission:

1. Each copy of the submittal so designated by the Engineer will be identified accordingly by being so stamped and dated.

2. One copy will be returned.

3. Construction shall be carried out in accordance therewith and no further changes made therein except upon written instructions from the Engineer.

G. Processing of submittals requiring resubmission:

1. If corrections to the submittals are required, one copy will be returned to the Contractor for correction.

2. Resubmissions will be handled in the same manner as first submissions.

Direct specific attention, in writing or on resubmittals to revisions other than

Division 1, Page 23 the corrections requested by the Engineer on previous submittals using the notation specified in Paragraph 3.1.B.

3. The Contractor shall promptly notify the Engineer, if any correction indicated on submittals constitutes a change of the Contract documents.

1.4 SUBMITTAL SEQUENCING AND SCHEDULING

A. Coordinate preparation and processing of submittals with performance of the Work so that Work will not be delayed by submittals.

B. Coordinate and sequence different categories of submittals for the same Work, and for interfacing units of Work, so that one will not be delayed for coordination with another.

C. The Contractor shall make all submittals far enough in advance of scheduled installation dates to provide all time required for reviews, for possible revisions and resubmittals, and for placing orders and securing delivery.

1.5 SCHEDULED DELAYS

A. No adjustments to the agreed completion date shall be allowed due to the following:

1. Engineer’s review of submittals or resubmissions.

2. Delays in Work as a result of rejection and subsequent submission of Submittals, including multiple resubmissions.

PART 3 – EXECUTION

3.1 SUBMITTAL PROCEDURES

A. Electronic copies of submittals are acceptable, if the Engineer judges the submittal to be legible. If electronic submittals, such as detailed shop drawings, are not considered by the Engineer to be legible, the Contractor shall provide the Engineer with at least six, legible printed copies of each submittal or resubmittal.

B. All submittals shall be transmitted with the pre-printed letter of transmittal form, dated and signed, with the job title and section(s) of the Specifications requiring this submittal clearly indicated. The forms shall be sequentially numbered. Resubmittals

Division 1, Page 24 shall have the original number together with an alphabetic suffix (A, B, etc.) indicating the number of resubmittals.

C. By providing the submittal, the Contractor shall certify that review, verification of products required, field dimensions, and coordination of information is in accordance with the Work as specified in the Contract documents.

D. Provide space for the Contractor’s stamp and Engineer’s review stamp (approximately three and one-half inches by two and one-half inches [3.5” x 2.5”]). Submittal shall contain Contractor’s executed review and approval marking. All submittals shall be provided by the Contractor to the Engineer and Contracting Officer’s Representative.

Submittals that are received from Subconsultants or other sources other than through Contractor’s office will be rejected without review.

E. Distribution:

1. Distribute copies of reviewed submittals to all Subcontractors and Contractor’s crews whose Work will interface with the subject of this submittal.

2. Provide additional distribution of submittals (not included in other copy submittal requirements specified in this Section) to Subcontractors, suppliers, fabricators, installers, governing authorities, and others as necessary for performance of the Work.

3. Include such additional copies in transmittal to the Engineer and Contracting Officer’s Representative where required for status before final distribution and show such distribution on transmittal form.

3.2 PRODUCT DATA, SHOP DRAWINGS, AND SAMPLES

A. Product Data

1. Collect required data into one submittal for each unit of Work or system;

and mark each copy to show which choices and options are applicable to the Work. Include manufacturer’s standard printed recommendations for application of labels and seals, notation of field measurements that have been checked, and special coordination requirements.

2. Maintain one (1) set of Product Data (for each submittal) at the Project Site, available for reference by Government Inspector, Contracting Officer’s Representative and others.

3. Submit number of copies in accordance with Paragraph 3.1.A.

4. Mark each copy to identify applicable products, models, options, and other data. Supplement manufacturers’ standard data to provide all information unique to this Product.

5. After review, distribute in accordance with Paragraph 3.1.E.

2. After review, distribute in accordance with Paragraph 3.1.E.

C. Samples

1. Provide units identical with final condition of proposed materials or products for the Work.

2. Include “range” samples (not less than three units) where unavoidable variations must be expected, and describe or identify variations that much be expected, and describe or identify variations between units of each set.

3. Provide full set of optional samples where the Contract Officer’s Representative selection is required. Prepare samples to match Engineer’s samples where so indicated.

4. Include information with each sample where so indicated. Include information with each sample to show generic description, source or product name and manufacturer, limitations, and compliance with standards. Samples are submitted for review and confirmation of color, pattern, texture and “kind” by the Contracting Officer’s Representative.

5. Engineer will not “test” samples (except as otherwise indicated) for compliance with other requirements, which are therefore the exclusive responsibility of the Contractor.

3.3 MISCELLANEOUS SUBMITTALS

A. Construction Permit:

1. Contractor shall acquire, maintain, and submit two copies of all construction permits that are required to execute the Work.

B. Manufacturers’ Certificate:

1. When specified in individual Specification sections, submit two copies of manufacturer’s; certificates to the Engineer.

2. Indicate that a material or product conforms to or exceeds specified requirements. Submit supporting reference date, affidavits, and certificates, as appropriate.

3. Certificates may be recent or pervious test results (within one year), on material or product, but must be applicable to product and acceptable to the Engineer.

C. Tests and Test Reports:

1. Classify each as either “Project related” or product data, depending upon whether report is uniquely prepared for Project or a standard publication of workmanship control testing at point of production, and process accordingly.

2. All test equipment used shall be verified to be in calibration at the time of each test and test reports shall so indicate. No test shall be made without such verification. Submit calibration certificates in accordance with Paragraph 3.1.A.

D. Modifications Cost Proposals:

1. Refer to FAR52.243-4, Changes, for requirements for submitting modification cost proposals.

E. Delivery Tickets:

1. Submit to the Government Inspector one legible copy of each delivery ticket as required by Table No. 1 of this section of the Specifications.

SECTION 01 35 00 SAFETY PROCEDURES

PART 1 - GENERAL

1.1 SECTION INCLUDES

A. Responsibility and requirements for Site health and safety.

1.2 SUBMITTALS

A. The Contractor shall prepare and submit a Site Health and Safety Plan (HASP) in accordance with the requirements specified in Section 01 33 00 Submittal Procedures.

The Engineer and Contracting Officer’s Representative will review the plan for general conformance with these specifications. The review by the Engineer and Contracting Officer’s Representative will not constitute an approval of the plan or relieve the Contractor of full responsibility for Site health and safety. The Contractor’s Site Health and Safety Plan shall include the following minimum items:

1. Details of on-site safety procedures and emergency communication procedures.

2. A list and location summary of on-site safety features, such as first aid kits, fire extinguishers, fire tool boxes and a list of persons trained in first aid.

3. The name of the Contractor’s on-site Safety Officer and the Safety Officer’s designated alternate when the Site Safety Officer is not on-site.

4. Emergency response plan including location and routes to local medical facilities and a list of emergency phone numbers.

5. Procedures and actions to be taken if there is a fire or explosion.

6. Cautions and procedures to address local wildlife around the Site.

1.3 CONSTRUCTION SITE SAFETY

A. The Contractor shall provide, erect and maintain all necessary barricades, danger signals and signs, and shall take all necessary precautions for the protection of the Work and safety of the public.

B. The Contractor shall assume full responsibility and liability for compliance with all applicable Federal, State, local, and Refuge regulations pertaining to the protection of workers, visitors to the site, and persons occupying areas adjacent to the site, including the provisions of 29CFR1910 and 29CFR1926 of the Code of Federal Regulations.

The Contractor shall hold harmless the Government and Engineer for failure to comply with any applicable safety or health regulation on the part of himself, his employees, or his subcontractors.

C. Provide personal safety equipment and training commensurate with the hazards which may exist at the work site. The personal safety equipment and training shall be determined by a thorough hazard analysis of all work site areas. The safety program available at all work sites shall include a minimum of:

1. One non-freezing type fire extinguisher in each workshop, shed, and Work area. Place in location readily accessible to construction personnel.

Additional fire suppression tools are required as specified in Section 01 57 00: Temporary Controls.

2. A first aid kit for use of construction personnel commensurate, with size of project, with items necessary for first aid treatment of all injuries.

3. The Contractor shall conduct regular on-site safety inspections and all construction personnel shall receive a safety orientation.

4. Post telephone numbers of nearest hospital, ambulance service or flight for life, and fire station in conspicuous location. Advise all workers of location of telephone numbers.

The Contractor shall not require a laborer, mechanic, or person employed in the performance of the Contract to Work in any conditions that are unsanitary, hazardous, or dangerous to health and safety, as determined under construction safety and health standards promulgated by the Secretary of Labor under Section 107 of the Contractor Work Hours and Safety Standards Act (40 USC 327 et seq.) as amended. Construction Safety and Health Standards promulgated by the Secretary of Labor may be obtained from the regional or area office of the Occupations Safety and Health Administration, U.S. Department of Labor.

D. The Contractor shall maintain an accurate record of, and shall report to the Contracting Officer’s Representative in the manner prescribed by the Contracting Officer’s Representative, all cases of death, occupational diseases, or traumatic injury to employee or the public; and property damage in excess of two thousand, five hundred dollars ($2,500.00), incidental to performance of Work under this Contract.

E. The rights and remedies of the Government provided in this paragraph are in addition to any other rights and remedies provided by law and this Contract.

F. In the event there is a conflict between the FAR clause referenced for this Contract;

specifications paragraphs; Contractor’s approved safety program; referenced safety and health codes and standards; or the U.S. Department of Labor construction safety and health standards, promulgated under Section 107 of the Contract Work Hours and Safety Standards Act (40 USC 327 et seq.) as amended; the more stringent requirement shall prevail.

G. Comply with all relevant health and safety regulations governing the Work being performed.

H. Become familiar with the potential hazardous health and safety conditions and risks associated with the Work to be performed.

1.4 SITE SAFETY OFFICER

A. The Contractor shall designate a qualified person to be the Site Safety Officer. The designated person shall have a thorough knowledge of the potential safety hazards, prevention, and remedial actions concerning general construction activities. The Site Safety Officer is allowed to participate in other Work at the Project Site.

B. Responsibilities:

1. Be present whenever construction operations are in progress.

2. Assure compliance with the Site Health and Safety Plan.

3. Provide routine health and safety briefings to the Contractor’s employees and subcontractors.

1.5 POSTING

A. Post signs at all Work areas that describe personnel protection equipment requirements.

1.6 STOP WORK ORDER

A. When violations of the health and safety requirements or unsafe conditions are called to the attention of the Contractor by the Contracting Officer’s Representative or Government Inspector or by anyone on the Project Site, the Contractor shall immediately take remedial action.

B. If, following anyone’s request for remedial action, the Contractor fails or refuses to take prompt corrective action, the Contracting Officer may issue an order to stop all or

Division 1, Page 32 portion of the Work. When satisfactory corrective action is taken, an order to resume Work will be issued. The issuance by the Contracting Officer of a Stop Work Order does not relieve the Contractor of full complete responsibility for Site Safety. The Government and the Engineer are not responsible for lost time due to Stop Work Orders.

1.7 HAZARDOUS WILDLIFE ON-SITE

A. The Contractor shall be aware of all hazardous wildlife that may be present at the Project Site. A list of some but not all hazardous wildlife will be provided by the Refuge and includes:

1. Buffalo,

2. Copperheads,

3. Ticks,

4. Long horn cattle, and

5. Rattlesnakes.

1.8 FIRE SUPPRESSION

A. The Contractor shall be aware of the day to day fire danger at the Project Site for the duration of the Work. All Work areas shall have easily accessible fire suppression equipment as specified in Paragraph 1.3C of this Section.

B. The Contractor shall maintain liability coverage during the Project to include all public and private property damage on or in the vicinity of the Refuge caused by the Contractor’s operations with a minimum coverage of ten million ($10,000,000) to perform Work under this Contract.
