ADDENDA TO FAR 52.212-2 – EVALUATION FACTORS – Commercial Items
1. EVALUATION PROCESS – Technical – Disposal Plan
1.1 Award will be made to the firm(s) with an acceptable Technical - Disposal Plan, then determined to be the best valued between Past Performance, and Price. Past Performance is significantly more important than Price. An Offeror with an unacceptable Disposal plan will not be eligible for award and will be eliminated from the competition prior to the best value trade-off analysis.
1.1.1 Evaluation of Technical - Disposal Plan. To be rated as “acceptable,” the Offerors Disposal Plan must include:
1.1.1.2 A completed Facility Profile Sheet (Attachment 6) for each firm that will be performing disposal and/or recycling support, and evidence of valid facility permits and/or licenses or confirmation of permit and/or license applications submitted with expected approval date, for ALL of the permit/license-required contract line items in the price schedule.
1.1.1.3 A completed Transportation Profile Sheet (Attachment 6) for each firm that will be performing transportation support, and evidence of valid transportation permits and/or licenses or confirmation of permit and/or license applications submitted with expected approval date, for ALL of the permit/license-required contract line items in the price schedule.
1.1.2. An Offeror with an unacceptable Disposal plan will not be eligible for award and will be eliminated from the competition prior to the best value trade-off analysis (past performance and price evaluation). Those with an acceptable disposal plan will move on to the reviews in 1.2 and 1.3.
1.2 PAST PERFORMANCE EVALUATION
1.2.1. The Government will conduct a Performance Confidence Assessment for each offeror based upon submitted current, relevant past performance information (PPI), consisting of past performance references or questionnaires, as it relates to the expectation of the offeror being able to successfully perform the requirement. There are two aspects to this evaluation. One, the determination of relevance to this requirement in scope, magnitude and complexity; and two, how well the offeror performed on their contracts. Past performance will be rated on an adjectival scale. Thus, an offeror with a higher confidence assessment rating for past performance will have a higher expectation of meeting the solicitation requirements than a firm with a lower confidence assessment rating. The Government’s subjective evaluation of the overall quality of an offeror’s submitted past performance will be a factor in determining the relative merits of the offeror’s proposal and in selecting for award the offeror whose proposal is considered the best value to the Government based upon the importance of the evaluation factors identified elsewhere in this solicitation.
1.2.2. In investigating an offeror’s past performance, the Government may consider information in the offeror’s proposal and/or readily available information obtained from other sources, including but not limited to the Past Performance Information Retrieval System (PPIRS), DLA Disposition Services personnel administering DLA Disposition Services contract references provided by the offeror, past and present customers and their employees, other government agencies, including state and local agencies, consumer protection organizations and better business bureaus; former subcontractors; and others who may have useful information.
1.2.3. Evaluation of past performance will be a subjective assessment based on a consideration of all relevant facts and circumstances. This is a matter of judgement. With regard to any performance deficiencies, the offeror’s response, or lack thereof, will be taken into consideration.
1.3 EVALUATION OF PRICE
1.3.1 The Government will evaluate offers for award purposes by reviewing unit pricing, and the contractor's ability to perform some, many, or all of the line items in attachment 1. Prices that are too high and cannot be considered reasonable, either based on historical pricing, market pricing, or other factors, may not be accepted and those lines will be left off of the Blanket Purchase Agreement, if the offer is selected for award.
1.4 Notice
A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a Blanket Purchase Agreement, without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
