FDA acknowledges that the AWS MAP Program or similar programs has sole discretion of accepting or rejecting any business application developed under this contract into the AWS MAP Program or similar programs and the amount of the incentive/credit that the Food Drug Administration (FDA) shall receive.

The Contractor shall notify the COR and CO the estimated amount of AWS MAP Program or similar program incentives/credits and timelines that the Contractor shall receive in the following areas once they become known:

Step 1: Assess Your Readiness Step 2: Mobilize Your Resources Step 3: Migrate and Modernize Your Workloads

The Contractor shall reimburse FDA for all incentives/credit intended to facilitate and expediate the migration of FDA business applications that the Contractor receives from the AWS MAP Program or similar programs in the steps stated above. The approach chosen shall be executed via contract modification. The FDA prefers to apply any discount or incentive from CSP as a service credit to the FDA CSP consumption bill. In case of service credit, the Contractor shall work in a timely manner to provide required documents to FDA and FDA CSP Contractor to apply for the service credit.

The Contractor shall be responsible for complying with all of AWS MAP Program or similar program terms and conditions, including any changes associated with the incentives/credits that shall be received by FDA. The Contractor shall ensure that all information and documentation related to CSP Program and the use of credits is accurate, complete, and up to date. The Contractor shall be responsible for any costs associated with applying for and obtaining the CSPCSP Program incentive/credits. The Contractor shall keep the COR and CO informed about all the steps and obtain their approvals.
