About this file

This document is Attachment 5 to a federal grant funding opportunity (W9127N-25-2-0002) containing required certifications that applicants must execute as a condition of applying for and accepting federal funding.

The document establishes two primary certification requirements. First, applicants must certify the accuracy and truthfulness of their application statements, provide required assurances, and acknowledge awareness of criminal, civil, and administrative penalties for false or fraudulent statements under U.S. Code Title 218, Section 1001. Additionally, applicants must certify that their organization does not impose confidentiality agreements or statements that restrict employees, contractors, or subrecipients from lawfully reporting fraud, waste, or abuse to authorized Federal investigative or law enforcement representatives. Second, under Public Law 103-227 (the Pro Children Act of 1994), applicants must certify compliance with environmental tobacco smoke restrictions in indoor facilities routinely used to provide health, day care, education, or library services to children under 18 when services are federally funded. Violations may result in civil penalties up to $1,000 per day or administrative compliance orders. Applicants must also ensure these certification requirements flow down to all subgrantees and subawardees providing children's services. The certification requires signature by a duly authorized representative of the applicant organization with printed name, title, and date.
