A.1 Type of Contract
The Department of Interior, Bureau of Indian Affairs (BIA) intends to award a firm fixed price contract from this solicitation for commercial services under Federal Acquisition Regulation (FAR) Part 12 Acquisition of Commercial Items and Part 13, Simplified Acquisition Procedures.
The North American Industry Classification System (NAICS) Code is 562111, Solid Waste Collection, with a size standard of $19.5m.
A.2 Contract Term
The Goverrnment anticipates awarding a (1) Firm Fixed Contract contract for services starting August , 2022 through August, 2023 plus 4 Option Years, see Period of Performance for more details.

C - Description/Specifications
C.1 LOCATION:
Bureau of Indian Affairs/Southern Plains Regional Office 1 mile North on Hwy 281 Anadarko, Ok 73005
C.2 SCOPE OF WORK:
STATEMENT OF WORK
RECYCLING WASTE SERVICES
The following services to be provided for:
SOUTHERN PLAINS REGIONAL OFFICE (SPRO)
1 mile North of City, Hwy 281 & Riverside Drive Anadarko, Oklahoma 73005 Purpose:
The contractor will be hired to provide weekly recycling services performed one day each week at the Bureau of Indian Affairs, Southern Plains Regional Office. Additional pick-ups may be requested on an as-needed basis at the rate specified within the contract.
Location:
Southern Plains Regional Office – the location or site under this Statement of Work will include the main building at the Southern Plains Regional Office located one mile north of Anadarko at Hwy 281 & Riverside Drive.
Description of Service:
1. Recycling containers already exist. Containers will be for collection of cardboard, aluminum, plastic and paper.
• The Southern Plains Regional Office maintains two recycle areas. Area 1 consists of one 3-in-1 container with 28-gallon receptacles for paper, plastic and aluminum, a ½ cubic yard tilt truck for paper and an area for cardboard. Area 2 consists of one 3-in-1 container with 28-gallon receptacles for paper, plastic and aluminum. Bagged shredded paper will also be placed at these locations.
Vendor shall schedule weekly collection of the recycling waste. Each container will be emptied and returned to its designated location and bagged shredded paper will also be removed. Additional pick-ups may be requested on an as-needed basis at the rate specified within the contract.
2. Vendor will maintain a clean and tidy environment upon servicing locations.
Required Contractor Reporting:
The contractor is responsible for supplying, completing, and submitting all reports required or requested by Federal, State, or local ordinances, which pertain to recycling waste services. The recycler will also submit a summary report at the end of the fiscal year summarizing the amount of materials recycled (estimated or actual) in pounds.
Additional Requirements:
1. The contractor shall provide all materials, services, equipment, and labor.
2. All materials and supplies shall be of suitable grade and highest quality or equivalent, free from any defects or imperfections for the purpose needed.
3. All services shall be performed in a skillful and competent manner.
4. All services shall be performed on weekdays, excluding Federal holidays, during normal business hours, 8:00 a.m., to 5:00 p.m.
5. All services comply with all applicable rules and regulations and applicable safety codes.
6. All services shall be coordinated with the Facilities Operations Specialist or his authorized representative.
Date of Service:
The time frame for authorized work under this purchase order will begin at the time of award.
Payment:
The vendor will submit a monthly invoice after completion of work to the Branch of Natural Resources or authorized representative for Natural Resources who will verify the work and cost, and will be paid by Invoicing Processing Platform at www.ipp.gov .

E - Inspection and Acceptance E.1 52.246-4 Inspection of Services-Fixed-Price (Aug 1996)
(a) Definition. “Services,” as used in this clause, includes services performed, workmanship, and material furnished or utilized in the performance of services.
(b) The Contractor shall provide and maintain an inspection system acceptable to the Government covering the services under this contract. Complete records of all inspection work performed by the Contractor shall be maintained and made available to the Government during contract performance and for as long afterwards as the contract requires.
(c) The Government has the right to inspect and test all services called for by the contract, to the extent practicable at all times and places during the term of the contract. The Government shall perform inspections and tests in a manner that will not unduly delay the work.
(d) If the Government performs inspections or tests on the premises of the Contractor or a subcontractor, the Contractor shall furnish, and shall require subcontractors to furnish, at no increase in contract price, all reasonable facilities and assistance for the safe and convenient performance of these duties.
(e) If any of the services do not conform with contract requirements, the Government may require the Contractor to perform the services again in conformity with contract requirements, at no increase in contract amount. When the defects in services cannot be corrected by reperformance, the Government may-
(1) Require the Contractor to take necessary action to ensure that future performance conforms to contract requirements; and
(2) Reduce the contract price to reflect the reduced value of the services performed.
(f) If the Contractor fails to promptly perform the services again or to take the necessary action to ensure future performance in conformity with contract requirements, the Government may-
(1) By contract or otherwise, perform the services and charge to the Contractor any cost incurred by the Government that is directly related to the performance of such service; or
(2) Terminate the contract for default

F - Deliveries or Performance F.1 Period of Performance
The Government is expecting to award a fixed price contract for a base year and four option years.
It is anticipated that award will be made by June 1, 2022. Work to start on approximately June , 2022- May 31, 2022.
F.2 Work Hours
The performance period established for this contract is based upon all work being conducted during regular working hours between 8:00am and 5:00pm, Monday, Wednesday and Friday, excluding government holidays. If a holiday falls on any scheduled work day, contractor will be required to work the following day if it falls on a Monday and Thursday, if it falls on a Friday. Contractor is still required to work 3 days each week.
F.3 Daily Check Sheet Log
When applicable, Material Safety Data Sheets must be kept with supplies in the Janitors Closet.

The following subsections describe the roles and responsibility of individuals who will be the primary points of contact for the Government on matters regarding contract administration as well as other administrative information. The Government reserves the right to unilaterally change any of these individual assignments at any time.

G.3 1452.201-70 Authorities and Delegations (Sep 2011)
(a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.
The Administrative Contracting Officer shall be:

(b) The Contracting Officer will designate a Contracting Officer's Representative (COR) at time of award. The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor. Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.
(c) The COR is not authorized to perform, formally or informally, any of the following actions:
(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;
(2) Waive or agree to modification of the delivery schedule;
(3) Make any final decision on any contract matter subject to the Disputes Clause;
(4) Terminate, for any reason, the Contractor's right to proceed;
(5) Obligate in any way, the payment of money by the Government.
(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum. The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the COR has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the COR's appointment, within 3 days of the occurrence. Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph (e) of this clause.
(e)The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph (d) of this clause. A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract.
(f) The Contractor shall provide copies of all correspondence to the Contracting Officer and the COR.
(g) Any action(s) taken by the Contractor, in response to any direction given by any person acting on behalf of the Government or any Government official other than the Contracting Officer or the COR acting within his or her appointment, shall be at the Contractor's risk. (End of clause)
G.3 DOI Electronic Invoicing and Payment Requirements – Invoice Processing Platform (IPP)
Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform System (IPP).
"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. The IPP website address is: https://www.ipp.gov. Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice. An invoice that has already been reviewed and approved by the COR outside of IPP and prior to creating an invoice in IPP.
The Contractor must use the IPP website to register, access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in CCR) will receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) within 3 - 5 business days of the contract award date. Contractor assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email ippgroup@bos.frb.org or phone (866) 973-3131.
If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation. (End of Clause)

H. 2 Government Furnished Supplies
The contractor shall provide all materials, services, equipment, and labor.

H.3 Background Clearance
A mandatory background investigation for security clearance purposes is required. The cost of the investigation will be paid by the federal government. If the background investigation has a negative clearance level, the selected individual will need to be replaced with someone that can pass the background clearance. Failure of the contractor to provide a person that has been cleared timely, will result in the contract being terminated.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records - Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. 28.307-2 Liability.
(a) Workers’ compensation and employer’s liability. Contractors are required to comply with applicable Federal and State workers’ compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer’s liability section of the insurance policy, except when contract operations are so commingled with a contractor’s commercial operations that it would not be practical to require this coverage. Employer’s liability coverage of at least $100,000 shall be required, except in States with exclusive or monopolistic funds that do not permit workers’ compensation to be written by private carriers. (See 28.305(c) for treatment of contracts subject to the Defense Base Act.)
(b) General liability.
(1) The contracting officer shall require bodily injury liability insurance coverage written on the comprehensive form of policy of at least $500,000 per occurrence.
(2) Property damage liability insurance shall be required only in special circumstances as determined by the agency.
(c) Automobile liability. The contracting officer shall require automobile liability insurance written on the comprehensive form of policy. The policy shall provide for bodily injury and property damage liability covering the operation of all automobiles used in connection with performing the contract. Policies covering automobiles operated in the United States shall provide coverage of at least $200,000 per person and $500,000 per occurrence for bodily injury and $20,000 per occurrence for property damage. The amount of liability coverage on other policies shall be commensurate with any legal requirements of the locality and sufficient to meet normal and customary claims.
(d) Aircraft public and passenger liability. When aircraft are used in connection with performing the contract, the contracting officer shall require aircraft public and passenger liability insurance. Coverage shall be at least $200,000 per person and $500,000 per occurrence for bodily injury, other than passenger liability, and $200,000 per occurrence for property damage. Coverage for passenger liability bodily injury shall be at least $200,000 multiplied by the number of seats or passengers, whichever is greater.
(e) Vessel liability. When contract performance involves use of vessels, the contracting officer shall require, as determined by the agency, vessel collision liability and protection and indemnity liability insurance.
52.217-8 Option to Extend Services. (Nov 1999) The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days.
