About this file
This document contains Performance Requirement Standards (PRS) for the National Qualified Representative Program administered by the Public Resources and Communications Division of the Executive Office for Immigration Review under the U.S. Department of Justice. The PRS establishes performance indicators, standards, acceptable quality levels (AQL), and surveillance methods for contractor-provided qualified representative (QR) services to NQRP Respondents.
The contractor must ensure QRs perform initial case assessments and client meetings with 100% completion; enter appearances with immigration courts or the Board of Immigration Appeals (BIA) within required timeframes at a 95% AQL; evaluate safeguards and prepare legal filings and supporting documentation with 95% accuracy and timeliness; provide representation at all covered immigration court hearings at 100% completion; develop and execute release from DHS custody and/or repatriation plans meeting specified requirements at a 90% AQL, which may include securing housing, transportation, and coordinating medical, psychiatric, or psychological services; maintain confidentiality and secure case records in accordance with applicable laws at 100% compliance; maintain complete and organized case files documenting services, legal filings, correspondence, and outcomes at a 95% documentation rate; perform all services in accordance with professional responsibility rules, contract requirements, and applicable laws with zero substantiated ethical violations or material noncompliance findings; and submit accurate and complete reports, metrics, and deliverables such as Program Operation Plans by required deadlines at a 98% on-time submission rate with accurate data. Surveillance methods include contractor self-reporting, periodic file reviews, review of E-28/E-27 filings in EOIR's CASE system, compliance monitoring, and analysis of submitted reports and deliverables.
