About this file
This is a Question and Answer document addressing clarifications and corrections to Solicitation 15JPSS26Q00000059 for the National Qualified Representative Program (NQRP).
The document contains six substantive government responses to offeror questions regarding key solicitation requirements and contract terms. Question 1 addresses a corrected pricing schedule (Attachment 2) that now includes the evaluated price for PWS 8.2.3.5 (Other Non-Specified Forms of Relief in Immigration Court) in all applicable subtotals and the Grand Total Evaluated Price for the Franco Base Period. Question 2 clarifies that the Transition-In Plan and Transition-Out Plan should be submitted within the Technical Approach volume as appendices within applicable page limitations, with the solicitation revised to align with this instruction. Question 3 confirms that the contractor will be paid fixed monthly installments for legal services, interpretation services, and expert witness services (excluding travel), with reconciliation processes applied as specified. Question 4 clarifies that the reconciliation process addresses actual case volumes reconciled against estimated quantities and that the PWS attached to the amendment takes precedence over all other versions. Question 5 confirms post-release funding remains available for certain National Program (NP) cases and references the revised PWS Section 15.1.2 reflecting this policy. Question 6 addresses baseline service billing, clarifying that reasonable expectations are baseline services will be incurred and billed in the first year of case activation and are not recurring billable expenses in subsequent option years. These responses collectively provide critical guidance on pricing structure, submission requirements, payment terms, and service billing protocols for proposal preparation.

| Question and Answer Form | ||||
| Question # | RFQ Part & Section Reference | RFQ Page# | Question | Answer |
| 1 | Attachment 2 - Pricing Schedule | Tab 1 - Franco Base Period | The formula for "TOTAL LEGAL SERVICES" on Tab 1 of the amended Pricing Schedule appears to omit the evaluated price for PWS 8.2.3.5, "Other Non-Specified Forms of Relief in Immigration Court" (cell J15). This omission would cause an understatement of the Franco Base Period total, CLIN 0001, and the Grand Total Evaluated Price. |
| Will the Government revise Attachment 2 so that the price for PWS 8.2.3.5 is included in all applicable subtotals, CLIN totals, and the Grand Total Evaluated Price? | The spreadsheet has been fixed to reflect the accurate totals for the Base Period (attachment 2 - corrected). | |
| 2 | Solicitation at L, "Submission of Offers" |
Solicitation at L, "Section 2. Management Approach (Evaluation Factor 2)"
Attachment 3 - Questions and Answers, Q63 Solicitation: 66, 69 The Government's answer to Question 63 confirms that offerors may include the Transition-In Plan and Transition-Out Plan as appendices to the Technical Approach volume, provided they are included within the applicable page limitations. However, Section L, Volume I, Section 2 – Management Approach states that, "As part of Section 2, the Offeror shall provide a detailed draft Transition Plan, to include Transition In and Transition Out, with its proposal."
1. Can the Government clarify whether the Transition-In Plan and Transition-Out Plan should be submitted within the Technical Approach volume, as stated in the response to Question 63, or within the Management Approach volume, as stated in Section L.2 of the Solicitation?
| 2. Will the Government amend Section L or its answer to Question 63 to provide one consistent submission instruction? | Solicitation has been revised to align with question 63. | |
| 3 | Attachment 2 - Pricing Schedule |
Attachment 3 - Questions and Answers, Q57, Q58, & Q68 In response to Question 57 regarding invoicing and payment, the Government stated, "No. The Government does not confirm that invoicing will be based on equal monthly installments for each CLIN. Attachment 2, Pricing Schedule, has been revised, see revised Attachment 2."
In response to Q58, the government stated, "Yes. The Government confirms that the contractor is expected to be invoiced and paid on a Firm Fixed price basis for the required legal representation services, with the exception of authorized travel costs. The pricing structure and invoicing approach will be clarified in the updated attachment 2, pricing schedule. Offerors shall use the revised Attachment 2 when preparing and submitting their proposals."
| Can the Government confirm that it intends to pay the contractor equal monthly installments for legal services, interpretation services, and expert witness services (but not travel), subject to the reconciliation process described in Question 68? | The Government is paying a fixed price for this contract, billed monthly, for incurred cost for legal services, interpretation services and expert witness services. | |
| 4 | Attachment 1 - PWS at 18.0 |
Attachment 3 - Questions and Answers, Q68 PWS: 13 In response to Question 68, the Government stated: "EOIR recommends that the following reconciliation language be added to the end of PWS 18.0: 'If the number of actual new cases falls short of or exceeds the amount estimated in the final Pricing Proposal, the Government and Contractor will engage in a reconciliation process at the end of the task order. This reconciliation process will ensure that the Government does not pay for services not rendered and, conversely, that the Contractor does not perform services without compensation.'" However, this language does not appear in the revised PWS issued with Amendment 0005.
1. Can the Government clarify whether the reconciliation process described in Question 68 is part of the solicitation requirements and resulting contract? If so, will the Government issue a formal amendment incorporating the reconciliation language into PWS Section 18.0 or otherwise identify the clause that governs reconciliation of actual case volumes against estimated quantities?
| 2. Can the Government further clarify what quantities will be reconciled - baseline services units, specific legal service units, interpretation services, expert witness services, or some combination? | The reconciliation process only refers to reconciling cases. This is not a reconciliation process referencing the baseline service units, legal service units, interpretation, etc. This serves as clarification and the PWS attached to the amendent takes precedence over all other versions. | |
| 5 | PWS 15.1.2 |
Attachment 3 - Questions and Answers, Q41 PWS: 11 The Government's response to Question 41 confirms that post-release funding remains available on NP cases in which the NP client is released, proceedings remain pending more than 35 days after release, and a Motion to Withdraw is denied or has been submitted but not adjudicated. However, that clarification does not appear in revised PWS Section 15.1.2.
| Will the Government amend PWS Section 15.1.2 to reflect this confirmation? | See the revised section 15.1.2 of the PWS. | |
| 6 | Attachment 2 - Pricing Schedule |
Attachment 3 - Questions and Answers, Q69 In response to Question 69, the Government confirmed that the individual categories of baseline services within the PWS are all combined for one unit of issue. Baseline services are ongoing and may recur throughout a case, including across option periods.
1. For a case that remains active across more than one period, can the Government clarify whether the Contractor may invoice one baseline-service unit in each period in which baseline services are required and performed?
2. For example, if a case is assigned and baseline services begin in the Base Period, and the same case remains active and requires continued baseline services in Option Year 1, may the Contractor invoice the applicable baseline service unit price in both periods?
3. If not, can the Government identify the event that makes a baseline service unit billable and explain how continued work in later periods is compensated? Reasonable expectations are baseline service will be incurred in year one of activation and billed up front and not a recurring billed expense in subsequent years.
