About this file

This is a Data Use Agreement template document issued by the Colorado Department of Public Health and Environment (CDPHE) for the Unified Data Dissemination Project. The agreement establishes the terms and conditions under which external organizations may access and utilize confidential data provided by CDPHE. The Data User is obligated to use the confidential information exclusively for activities described in the associated Attachment A and must limit access to only those individuals necessary to perform the designated duties. The agreement requires that all persons with access to confidential data sign a separate Confidentiality Agreement prior to receiving any information.

The agreement imposes strict safeguarding requirements on the Data User, including mandatory use of secured telecommunications for transmitting identifying information and implementation of appropriate administrative, technical, and physical safeguards. The Data User must report any unauthorized use or disclosure of data within 48 hours of discovery and must destroy or return all records within 30 days of project completion. If the activity involves research, the Data User must obtain Institutional Review Board approvals and individual authorizations unless a waiver is granted. The agreement explicitly prohibits public release of confidential information, contact with data subjects or their relatives, and attempts to deduce individual identities. Additionally, the Data User certifies under penalty of perjury that they will not use Personal Identifying Information for Federal Immigration Enforcement purposes unless required by law or court order. The CDPHE retains all ownership rights to the data, and any publications or presentations derived from the data must include CDPHE attribution and notification.
