About this file
This is a contractor employee legal status certification form required as an attachment to a federal contract opportunity. The contractor must certify compliance with the Immigration and Nationality Act of 1952 and all related laws and regulations enforced by Homeland Security, Immigration and Customs Enforcement, and the U.S. Department of Labor as they pertain to non-immigrant foreign nationals working on the contract. The contractor certifies that it will not knowingly employ, contract, or subcontract with illegal aliens or foreign nationals whose immigration status is in violation of U.S. admission terms and conditions while providing services to Department of Veterans Affairs patient referrals.
The form establishes that failure to comply with these requirements may result in the Department of Veterans Affairs prohibiting the non-compliant foreign national from working at the contractor's facility servicing VA patient referrals and may constitute grounds for contract termination for breach. The contractor must obtain similar certifications from all subcontractors. The certification requires the contractor to sign and date the form, provide typed name, title, and company name. False, fictitious, or fraudulent certification exposes the signatory to prosecution under 18 U.S.C. Section 1001. This certification is required for the Q509 Acute Bedside Dialysis Contract IDIQ solicitation (36C26026Q0549) with the Department of Veterans Affairs Veterans Health Administration Veterans Integrated Service Network 20.
