About this file
The document is a Quality Assurance Surveillance Plan (QASP) for the DLA Disposition Services Southeast Region Tire Recycling and Disposal Contract. The plan establishes four primary Acceptable Performance Levels (APLs) that contractors must meet: 1) replacing trailers/containers, 2) removing all tires within 5 business days of notification, 3) mutilating tires with Demil Code B or Q to make them inoperable, and 4) submitting supporting documentation for all tire removals. The surveillance methodology primarily relies on the Contracting Officer's Representative (COR) reporting performance, with no allowance for failures during the contract period.
The QASP outlines potential consequences for failing to meet APLs, which include consideration taken against tire removal values, potential partial or full contract terminations, and options not being exercised. The Contracting Officer has discretion to apply remedies based on the specific circumstances of performance failures. The plan emphasizes that the government will evaluate whether performance deficiencies were caused by factors beyond the contractor's reasonable control, such as acts of God, government actions, strikes, or severe weather conditions. Contractors are expected to maintain consistently high performance standards throughout the contract period.

Quality Assurance Surveillance Plan (QASP) for DLA Disposition Services South East Region Tire Recycling and Disposal Contract
1. PURPOSE:
This document is to provide guidance on administering subject contracts such that the best possible quality in performance can be assured through appropriate surveillance and addressing of any performance failures as appropriate. The Acceptable Performance Level (APL) is the standard the U.S. Government (USG) expects the Contractor to meet throughout the life of the contract. In general, the DLA Disposition Services DSD South East Recycling and Disposal Contract will have four (4) APLs that will be used to measure Contractor performance though additional ones may be identified depending on the contract requirements. The standard APLs are Replace trailers/containers, remove all tires, Mutilate (MUT) all tires with Demil Code B or Q, submit supporting documentation for all tire removals.
2. ACCEPTABLE PERFORMANCE LEVELS:
| a. Replace trailers/containers | |
| (i). “each” in the standard and APL column means a single trailer or container. | |
| (ii). The APL is measured with every removal. | |
| b. Remove all tires |
(i). “timely and accurate” in the standard and APL column means that all tires must be removed within 5 business days upon written notification.
(ii). The APL is measured with every removal.
c. Mutilate all tires with Demil Code of B or Q (i). “Inoperable and non-repairable” in the standard and APL column means that all tires that are Demil Code B or Q must be mutilated before being removed from the site.
(ii). The APL is measured with every removal.
d. Submit supporting documentation for all tire removals (i). “documentation” in the standard and APL column means that is it required for both recycling and/or disposal.
(ii). The APL is measured with every removal
3. SURVEILLANCE:
| a. The primary method of surveillance for evaluating compliance is by Contracting Officer’s Representative (COR) reporting. The COR is responsible for reporting performance to the Contracting Officer (KO) promptly after the performance deadline has passed. The COR will provide when the action was required to be performed by the Contractor and the date it occurred. The COR shall also include what the negative impact of the Contractor’s failure to meet the APL was on the DLA Disposition Services site. |
| b. In instances where there are late tire removals, the COR shall determine if the late performance is caused by an occurrence beyond the reasonable control of the Contractor and without its fault or negligence such as, acts of God or the public enemy, acts of the USG either its sovereign or contractual capacity, fires, floods, epidemics, quarantine restrictions, strikes, unusually severe weather, and delays of common carriers. In such cases as there is an excusable delay, the Contractor will be deemed to have made the APL for the period. |
4. REDUCTION FOR FAILED APL:
| a. Throughout each performance period of the contract, including options, the Contractor is allowed no failures of recycling and disposal of the tires. After the failures the KO may take consideration for each additional instance of the Contractor not meeting the APL. |
| b. If a valid failure to meet an APL is identified and consideration is warranted considering the pertinent facts, consideration is taken against the tire removal. Consideration is taken against the individual value of the tire removal which is late. |
| c. In addition to the consideration and past performance annotation remedies available to the KO under the APL Matrix, the government may use such measures as partial or full terminations under FAR 52.212-4, not exercising options, and ending a contract early without these measures as long as it is IDIQ and has met its minimum government obligation for the period and a plan for a timely replacement contract is secured. |
