52.212-2 EVALUATION — COMMERCIAL ITEMS (June 2020)

a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Factor 1: Technical Management. Describe the company’s quality control program, tailored toward meeting the requirements of the solicitation, which will ensure prompt and quality service. Please address in the event of a vehicle breakdown, inclement weather or natural disaster and other emergency situations.

Factor 2: Technical Capability. Describe the company’s ability to provide ambulette services as described in the statement of work.

a) Describe the company’s ability to provide electronic invoicing with line item breakdown.

b) Describe how the Offeror intends to provide coverage when VA needs may be in excess of the Contractor’s own fleet.

c) Describe how the Offeror will ensure his/her ability to meet various peak time periods and ensure request for service response time meet SOW requirements.

d) Describe the computer technology that will be used in maintaining records of scheduled and unscheduled patient pick-ups and deliveries.

e) Offeror vehicles and personnel must meet Federal Department of Transportation regulations to provide special needs transportation in New York State to be considered for award. Offerors shall provide the following documents with their proposal:

a. Insurance certificate(s).

b. Business license(s).

c. List of all vehicles and vehicle identification number (VIN), as well as location of hub/main office.

d. Inspection report for all vehicles.

e. Copies of valid driver's/chauffeur license.

**Provide a maximum of 15 pages capability statement. All proposals must be received via email. Contractor must provide one redacted and one unredacted copy of their “technical capabilities” proposal.

Factor 3: Past Performance. A past performance questionnaire template is included with this solicitation, in Section D: Attachments. Offeror shall provide the questionnaire to at least three (3) references, to whom the Offeror has provided the same or similar services of the magnitude described in this solicitation. Completed questionnaires shall be submitted to the contracting officer by either the Offeror or the Reference. Completed questionnaires must be submitted to the VA contracting officer prior to the due date for receipt of proposals.

Factor 4: Price. All pricing will be evaluated on a total price basis based on the estimated quantities, to include option years of the contract. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
