Addendum to FAR 52.212-2 Evaluation—Commercial Items
Basis for Entering into Basic Ordering Agreement and Evaluation Criteria
XX XXX 2022
This Addendum takes precedence over FAR 52.212-2 Evaluation—Commercial Items.
1.0 Introduction
1.1 General. This Addendum defines the criteria the Government will consider in its evaluation of each Contractor’s quote submitted for the Bird/Drone Detection Radar and Support Services Basic
Ordering Agreement (BOA) effort. The Government’s intent is to establish multiple BOAs with the responsible Contractors whose proposals meet all technical acceptability standards described in this
RFQ. The Government seeks to establish BOAs with Contractors who give the Air Force the greatest confidence that they will meet or exceed the requirements described herein. The Contractor’s RFQ submission shall be composed of the completed Administrative and Technical Volumes described in the Attachment 3 – Addendum to FAR 52.212-1.
1.2 Compliance with Terms and Conditions. Contractor is required to meet all solicitation requirements such as: terms and conditions, representations and certifications, SOW requirements, and those identified as factors. Failure to comply with terms and conditions of the solicitation may result in the Contractor being ineligible for receipt of BOA. Contractor must clearly identify any exception to the solicitation’s terms and conditions and provide complete accompanying rationale with its quotation.
1.3 Number of BOAs to be Awarded. The Government intends to select multiple contractors for
BOA award. However, the Government reserves the right not to award a BOA at all, depending on the quality of the quotes received.
1.4 Rejection of Quotes. The Government may reject any evaluated quote that fails to adequately address a significant portion of the requirement or contract terms and conditions.
1.5 Interchanges. Interchanges are fluid interaction(s) between the Contracting Officer (CO) and the Contractors that may address any aspect of the quote and may or may not be documented in real time. The Government intends to make award based on the initial submissions without conducting interchanges. Therefore, each quote should contain the Contractor’s best terms from a technical standpoint. However, the Government reserves the right to hold interchanges using Interchange
Notices (IN) if, during the evaluation, it is determined to be the best interest of the Government.
Contractor responses to INs will be considered in making the award selection decision. Interchanges may be conducted with one, some or all Contractors as the Government is not required to conduct interchanges with any or all Contractors responding to this RFQ.
2.0 Basis for Entering into Basic Ordering Agreement
2.1 Basis. A BOA will be established with each Contractor deemed responsible IAW FAR 9.1, as supplemented, whose quote conforms to the RFQ’s requirements (to include all stated terms, conditions, representations, certifications, technical requirements, and all other information required by the RFQ instructions) and is judged, based on the evaluation factors and subfactors, as capable of satisfying the Government’s requirements. This will be demonstrated by a rating of
“acceptable” on all factors and subfactors. While the Government Evaluation Team will strive for maximum objectivity, the evaluation process, by its nature, is subjective; therefore, professional judgment is implicit throughout the entire process. By submission of its quote, the Contractor accedes to all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors.
3.0 Evaluation Factors for Award
3.1 Factors. The Government will evaluate responses to this RFQ based upon the following factors and subfactors. No one factor or subfactor is more important than any other.
Factor 1: Personnel Qualifications
Subfactor 1(a): Resumes for Key Personnel
Factor 2: Product Capability
Subfactor 2(a): Radar Unit Performance
Subfactor 2(b): sUAS Detection Upgrade
Factor 3: Program Support
Subfactor 3(a): Set-up and Support Services
Subfactor 3(b): Delivery
Subfactor 3(c): Analytics and Data Management
3.2 Evaluation Process. In arriving at its decision, the Government will do the following:
(a) Following receipt of responses to this RFQ, the Government will review all quote sections for completeness and compliance with Attachment 3 – Addendum 52.212-1 Instructions to Contractors.
Incomplete or non-compliant quotes will be deemed “non-responsive” and may not be evaluated.
(b) The Government will evaluate the factors and subfactors of responsive RFQ submissions in the order listed in paragraph 3.1 above. The criteria for each factor is described below in sections 3.3 through 3.5 of this Addendum. First, Factor 1/Subfactor 1(a) will be evaluated on an acceptable/not acceptable basis. If the Subfactor receives an Acceptable rating, all requirements for Factor 1 will be considered to have been met, and the evaluation will progress as detailed in paragraph 3.2(b) below.
If the Subfactor is rated Not Acceptable, the evaluation process will stop.
(c) Subfactor 2(a) will be evaluated on an acceptable/not acceptable basis. If Subfactor 2(a) receives an Acceptable rating, the next Subfactor will be evaluated. If it is rated Not Acceptable, the evaluation process will stop. This process will repeat for each of the subfactors under Factors 2 and 3 respectively. Any single subfactor evaluated as Not Acceptable will result in the Government not evaluating the response any further.
(d) Contractors that receive an Acceptable rating on all evaluation subfactors will receive a BOA.
3.3 Factor 1: Personnel Qualifications
This factor will be used to determine if the contractor has personnel with the necessary knowledge and experience for detection and avoidance of aerial hazards with radars, or has the capacity to recruit individuals with the required skillsets to implement delivery and support of radar detection systems.
This factor is met when the Contractor provides resumes of personnel on staff or with letters of employment acceptance with a resume that demonstrates the minimum academic and professional experience requirements to build, maintain, and support bird/drone detection radars. Only resumes will be accepted as sufficient documentation for review, and must include content addressed in the
SOW at Paragraphs 3.1.1 and 3.1.2. The Government will evaluate this factor based on the following:
Acceptable indicates that the company identifies critical, required personnel on-staff or that prospective employees that have accepted tentative employment with the company to meet the minimum requirements of the SOW.
Not Acceptable indicates that the company lacks at least one critical position requirement for fulfillment of the BOA. Each critical element is identified in Section 3.1.1 and 3.1.2 of the
SOW.
Note: Quotes with a NOT ACCEPTABLE rating in Factor 1 will not be eligible for a BOA.
3.4 Factor 2: Product Capability
This factor will be used to determine if the contractor has a commodity that meets the performance specifications and detection capabilities required in the SOW at Paragraphs 5.1, 5.2, and 5.6 along with applicable subparagraphs. This factor is exclusively focused on the function of the radar and does not include other support services, ensuring that the quality of materials presented as BOA solutions are acceptable investments for the Air Force.
This factor is met when the Contractor provides evidence of technical performance and/or examples of practical application. Evidence could include, but is not limited to, marketing publications, technical statements of capability, peer-reviewed research materials, briefing slides, product demonstration multimedia, or summaries of radar detection unit application at other locations. The
Government will evaluate this factor based on the following:
Acceptable indicates that the Contractor has provided evidence that demonstrates a technical capability that lacks at least one performance element, but offers an acceptable solution for
SOW consistency.
Not Acceptable indicates that the Contractor insufficiently demonstrated at least one technical performance capability in the evidence provided and did not provide an acceptable solution to fulfill the SOW requirement.
Note: Quotes with a NOT ACCEPTABLE rating on any Subfactor in Factor 2 will not be eligible for a BOA.
3.5 Factor 3: Program Support
This factor will be used to determine if the contractor has demonstrated an understanding for the support services required and identified in the SOW at Paragraphs 5.3, 5.4, and 5.5 along with applicable subparagraphs. Support services are critical to the successful implementation of this BOA, providing assurance that the commodities delivered, while technically sufficient, are appropriately supported into an operational environment.
This factor is met when the Contractor provides an explanation for how each contractor will fulfill support services that meet realistically meet the deadlines and performance requirements of the SOW.
Explanations may be complemented with case examples of past performance on government and/or non-government orders, reinforcing the credibility of the proposed service approach. The
Government will evaluate this factor based on the following:
Acceptable indicates that the contractor has provided a detailed approach to services required in this SOW, but may lack sufficient information for a maximum of one performance metrics.
The contractor has provided information that will compensate for this performance shortfall.
Not Acceptable indicates that the Contractor did not include a detailed approach for at least one service element under this SOW without a proposed solution to mitigate this deficiency.
Note: Quotes with a NOT ACCEPTABLE rating on any Subfactor in Factor 3 will not be eligible for a BOA.
